[Resolved]  Triveni Infrastructure Pvt. Ltd. — Cheque Bounce

Hi,

I have booked a Flat in Triveni's Faridabad Project in Sec-78 but due to not implementing project i asked for cancellation and got Post Dated Cheques in the month of August, 2008 with the effective date as 15th January, 2009. When i presented the cheque on 15th January, it bounced with the reason as "ACCOUNT BLOCKED"

I contacted Builder and he is saying that there is Income-Tax Raid and they blocked our account and when it will be unblocked then only he can make payment and there is no end date for unblock of account.

What is the solution in this regard?

I also agree with te comment posted here. I too had applied for a refund and i was given three post dated Dec 2009, Jan 2010 and Feb 2010 (this happend in Feb 2008) cheques by Triveni when i raised concerns over it i was told that these cheques would get enchased. All the three cheques also had silightly different signatures. Treveni reps told me to get in touch with back to verify the signature. I went to the Axis Bank, GK-I, New Delhi branch. There bank officials told me that the cheques will get encashed on those signature.

When i deposited cheque related to Decmber month. The cheque got bounced with a message, account blocked. I called up Trveni and explained the situation to them. they said sir situation is not good we are not refunding anyone's money.

I have also written formal mail but have not got any reply.
I spoe with one of their marketing (refund) manager, he said deposit other cheques as well and then you can proceed for legal action if they also get bounced.

This is a cheating. what we need is our money and nothing else. I don't think comany has any intention to paying our money.

I was told that there is some case which is going on in high court agaist Trveni and decision could come in our favour but nothing is happening as these folks are able to take date after date from court.

We may need to organize ourselves and collectively represent to get our money.

Dear Sir,

I, Sumon Mukherjee R/o C-25, Gagan Enclave, Amrit Nagar, G.T. Road, Ghaziabad, U.P. have booked for purchasing a 2 Bedroom Flat measuring 1100 sq.ft. situated at N.H. 24, Ghaziabad as described in your offer/brochure in the name of my wife Mrs. Ayesha Mukherjee from M/s Triveni Infrastructure Development Company through Jaydaad.Com i.e. M/s Globar Infocom Ltd. and paid a cheque No. 027220 dated 24.06.2006 for Rs. 3, 25, 000/- in Delhi in favour of Triveni Infrastructure Development Company Ltd. A/C P-02 and again paid money on their demand. They also have issued receiving of Rs. 4, 50, 000/- on[protected]against said as Instalment No.1/part payment,

2. That the plot of land where the said flats/building had to be constructed was disputed land and the Company had no locus standi regarding right to sell of aforesaid plot/flat. The above-named offender Companies have illegally gave advertisement, issue/sold brochures and sold the flat/plots to the innocent public and started collecting consideration amount against said illegal sales of the flats/plots, which are still disputed and as a result of that the offender Companies have failed to construct any building/apartment on the said land and/or failed to hand over the possession of the same of its respective purchasers.


3. That both the Companies hereby cheated the General public as well as cheated us with a malafide intention to extort money in a planned way, which is a serious non-bailable criminal offence U/s 406/ 419/420/468/461/474/120-B/34 of Indian Penal Code (punishable for 7 years imprisonment and fine) and all of you are severally and jointly liable to punish as per law.

4. It is most important to note that after cheating, Mr. Aseem Anand, (Asstt. Manager Marketing), Jaaydaad.Com i.e. M/s Globar Infocom Ltd. And Mr. S. K. Jain, CMD & founder of Global Infocom Ltd. Had closed their office at W-13, Lower Ground Floor, Patel Nagar West, New Delhi – 110008 and left to some unknown place and running cheating business as a mediator through website (www.Jaaydaad.Com), emails and cell-phones form the spot of constructions.

Hence I request you to investigate the case and take necessary action forthwith to prevent crime and to save innocent public from cheating and register a case against them.

My case is similar.I was given 2 cheques of Rs 5.5 lakhs by builder which got bounced.
I am planning to lodge a case against the builder.
I have heard that the case which ws going in Delhi High Court has asked the builder to pay invertor money...If anyone has a clue, pl update

I totally agree with the comments above. I am myself a victim of their fraud.These criminals should be put behind bars .I am ready to join with a group for taking strong action against these criminals.
i do fully agree with the above. This company has played fraud with many people which includes me also.

Another Victim of Triveni. I and two of my friends have the flats in Sector 78, Faridabad. The problem is that we have given teh full payment as demanded by them. Should we continue giving the payment in future if demanded or we should stop. If we cancel the flats, we will get nothing from this Triveni as lot of others are experiencing. What to do?

I have booked flat in Ninja Floors, Sector-89, Faridabad, joint venutre of triveni and pal in June 2009 . I am so far not aware about the status of project. There are around 120 flats in Ninja Floors and trying to find out all those persons who had applied for Ninja Floors. If we join together we can put our case in a stronger way. I have also booked a flat in Ninja floors in july 09. The possession was promised in december 10. There is no construction activity in this site and Triveni is giving excuses such as delays in approvals etc. The intention of the builder does not seem right. Sometime back I got calls from them offering an alternate flat in one of their other site. It is surprising that the authorities are allowing such benami builders to swindle the savings of common people and get away. They have reportedly cheated many people in the past.
The only solution is to file a case under sec 138 against the builder.It might take around 2 yrs to get the money back.

My case is in District Court, Saket. Has anyone else filed case against the builder. pl contact me @ [protected]

i am also victim of triveni for rs.7.5 Lac and the cheque issued for interst also but bounced. Triveni has cheated the public without any fear of police and government and this can be done only with the help of police and government officials only.

I have also invested in the triveni heights projects aprrox 10 lakhs.
after lot of fights in the nehruplace office these guys gave me refund promise in the form of post dated checqs..but now when i have deposited the first pdc it has bouced..lets unite and do some action against them.

I also booked a flat in Sector-89 for Ninja Floors for 3 bhk and gave them 3.59L as booking amount. on 3-Jan-2011, when I visited Triveni office at A27 Mohan Estate, Mathura Road and asked the status of project, they told me that project is delayed but you can switch over on another project. When I enquire about the cost of new project, that was 36L for 2 BHK & 45L for 3 BHK. Now you can think why they are not building ninja floors. Now they don't want to give the flats on such a low cost.
When I asked them to refund my booking amount, they told me that they can't give that because case in High Court, if you want your money go to court but you will get on 80% of your money or if you want your full refund then they can give post dated cheque ony dated after 1 year. I think they will never build ninja flats because of such a low cost and also they are not willing to give refund. My Question is how to get my full money quickly.
