[Resolved]  www.eBay.in — Ebay Fraud: eBay Guarantee* for Claim Number – 18209

I purchased the following item from eBay "GEB[protected] New Sennheiser CX 300-II For IPOD
GEB[protected] New Sennheiser CX 300-II For IPOD ". The product I received was fake. When I raised a the claim for refund claim was denied from eBay saying "You have received the Product as per description".
eBay guarantee program is totally fraud. Details are mentioned below:


1. I received the item on 5th Aug and same day I replied to the seller stating that it’s a duplicate item. This is my first email to seller on 5th Aug 2010.

I received the item today. It's of very poor quality. Poor finish, poor sound quality. Definitely it is a fake duplicate item, not an original one.
This is cheating.

2. I got this reply from the seller. This seems like a straight forward reply from the seller that yes I am selling the fake products.

In the listing it was nowhere mentioned that this is a fake product.


3. I replied back to the seller stating that the product is fake. But seller did not bothered to reply back after that.

4. I mailed eBay support.

Customer Concern: Hi,

Paisa pay id for item is [protected].
I received the item. But when I checked the item then it is of very poor
quality. It is a fake duplicate item. Tried contacting the seller but it
replied only once and not to my other message. E Mail reference ID

I am not at all satisfied with the transaction since seller has cheated
on me selling me some duplicate fake item.

5. I got following reply from eBay support.

6. I further had a series of mail with customer support but nothing was helpful. I opened a case against seller. This was also not helpful. I was simply told that it was your decision to buy the item.

7. I created a claim #18209 for refund. Refund request was rejected with the following reply from eBay.

Dear eBay ,Member

We would like to inform you that the claim filed by you under eBay
Guarantee* for Claim Number – 18209 has been denied as you have received
the Product as per description

We request you to get in touch with your seller and resolve the matter
amicably.

May I know how the product was as per description when the seller has not mentioned in the listing that the product is fake? This is cheating on seller's part and eBay's as well. Tell me what is a fake item according to you? This is how fake items are sold. All the description and pic was for a genuine item, even price mentioned was for a genuine item. And what I received was a fake item. This is fraud.

www.eBay.in — Sold the product through ebay, don't get payment

Dear sir/madam,
I have sold my HP Mini Laptop to the buyer shanu soni through e-bay site. They promise me that they will credit the amount into my account on producing the POD(proof of delivery) of courier. I believe on the site and couriered the product by DTDC courier. After oneday of getting the courier, the buyer changed the product and said that he got the Modem in place of HP Mini laptop. I send the scan copy of POD to the ebay site. The company is not doing justice with me. I want your shelter. Kindly save me from this loss. I send my genuine HP mini laptop to the buyer on the assurance of the customer care executive. I am at the verge on losing my laptop. Kindly help me.

E-bay.in — Frauds

Hi everybody, I just created an account with this [censored]in website called ebay.in and went for a bid for a prov=ogue sunglasses and i won the bid for 1560 and when i contacted them they blocked my acct for no reason and all they tell me is that for securty reasons.
Do not ever create an account with these . They are frauds, the sellers who auction on ebay are also scamsters.
Is any one looking in to this. Please hepl all the poeple who have lost their money with these MFs.

recently, I am also an victim of a fake product (laptop battery) bought from ebay. I am not sure, how in India the consumer is protected. And also dont know what I can do further
You guys are lucky as you got at least got something. I got a fake Nokia mobile phone and when I sent it back to ebay according to guarantee, it ended up seller sending me again the same box and guess what nothing inside it. When contacted ebay they acted like a fool and said your case is closed. For me I ended up paying more than 3000 and got nothing... not even fake ...

I was buy an product amont RS 2800 ,and the seller send an empty parcel ....The ebuy customer care didn't help me ....

I placed order for a dell mini laptop on 26-6-12 with parfumcorner (a seller on ebay website) and received the product on jul 01, 2012. On my attempt to register the product on dell website, it was found that the product was sold in 2010 and its warranty was over in january 2012. It was also found that the battery supplied was one of 3-cell and not a 6-cell one. Hence the charge stays only for 3 hours and not more than 7 hours as described in the eaby website. Moreover I didn't receive the bill of the product. I contacted the seller regarding all these and he responded to do good within a short time. But after 2 weeks gone by when I DID not receive any result, I decided to raise a claim under ebay guerantee on[protected] and on 17-7-12 I was confirmed my claim ID. I was made to understand that my issue will be resolved within 7 days. But after one month gone by when I DID not receive any response from ebay I contacted the customer support on[protected] and then on 17-8-12 one mr. Mukesh called me up and said that as because the product was lying with me for over 1 month, my claim cannot be entertained. Moreover, he closed the case with a note that the issue has been resolved by the buyer with a mutual understanding with the seller, which is an absolute lie. Under the circumstance I want replacement of my product or refund of my money, if replacement is not possible.
I am reporting my grievances in nutshell as follows:
1) no bill of purchase as yet received. I have also come to know from dell website that the product was sold in uk during 2010 and its warranty is over in 2012.
2) the battery provided with the product is a 3-cell battery and not a 6-cell one. The battery life as claimed (more than 7 hrs.)Is far from reality -- it only lasts maximum up to 3 hrs.
3) the adapter plug does not fit into the socket.
