[Resolved] Country Vacations — Refusal to cancel membership and refund token money | |||
I am Kunal Nandi, currently residing in Kolkata, phone number [protected]. My wife got a call from Country Vacations on 25-Jun and they informed that we won a lottery and asked to visit their City Centre 2, Kolkata office on 26-Jun. We visited and they told us some lucrative offers before handing over the gift of lottery. My wife was very busy to take care of my child so she could not listen most of the presentation. But, looking at the lucrative offers, I felt interested and wanted to take the 5 year country vacation membership in name of my wife (as they told if I take in name of my wife they will give more discount). But, my wife was bit reluctant to get into an agreement without understanding all the aspects of the agreement. She was very busy to take care of my baby and she left the office as it was time for my son to take his lunch. I was still discussing about different features of the offer. But, when they brought the legal agreement paper, I saw there was a field for my wife to sign as this was a family agreement. So, I told the sales representative that as my wife already left, we cannot go ahead with the agreement. The representative told that 26-Jun was the last date for that offer and she suggested that I could pay a token money (Rs. 10000/- in this case) and sign a draft agreement with them so that they can assign a membership against us to avail the offer, I can then go back to home and go through the draft agreement along with my wife and both o[censored]s need to come back to their office with some other pending documents on next day to sign the final agreement if we agree to go ahead with it, they also verbally told if we do not agree they will give the money back to us. I trusted them, I understood that in absence of my wife the legal agreement cannot be finalised as both the family member must sign the document. So, I paid the token money of Rs. 10000/- through Credit Card and signed the document on behalf of my wife (though she did not agree me to sign and there was no written authorization from her to sign on behalf of her, I did this as the sales representative convinced me that this was just a draft agreement). After returning home, when we go through the agreement, we found most of the details told by the representative are not present in the agreement (like: they told we will have a room with kitchen whereas the agreement clearly says it is without kitchen, they told we will be given the facility of free airport pick up and free CAB service for 24*7 during our stay at their resorts whereas agreement says we need to pay for those services), so we decided to cancel the membership which they already assigned to us on 26-Jun. I sent one mail to them on 27-Jun and asked to cancel the membership and refund the money as we were not satisfied with ambiguities between their verbal commitment and clauses written in agreement. But, they denied to refund the money and told that the money was non-refundable as written in agreement, I really found that clause mentioned in the agreement. They offered us to take a vacation from them for the same Rs. 10000/- amount. But, I felt uninterested as we have been cheated by them. After a few mail chains on the same topic, I wrote a new mail to them and clearly told that this was a draft agreement and it was also not signed by my wife, so this should not be considered as a valid legal agreement and the clause of non-refundable amount should not be applicable here. But, they are still not refunding the money and claiming that I am harassing them with false statements. I read your complaint and I was also cheated by the same people in Phoenix mall. I would like to know whether you got your money back or what solution you got from them.
