Delhivery — misdelivery and handling failure of shipment

This complaint is being filed against Delhivery Company the misdelivery, mishandling, and negligence in the delivery of my shipment. Despite multiple follow-ups, the shipment has not been delivered as per the agreed terms and conditions, and the company has not provided adequate compensation for the damages and losses incurred.

• Item Description: Mobile Phone: One mobile phone, valued at ₹28, 000, in brand-new condition and securely packed.
• Current Issue:
• The shipment was wrongly delivered to a customer in Mumbai, and despite several assurances from the courier company, there has been a significant delay in retrieving and delivering my package to the correct address.
• The courier company has continuously failed to provide clear and timely updates or take responsibility for the mistake.
• I have been offered a compensation amount of ₹2, 000 which is grossly inadequate considering the value of the items in the shipment and the significant inconvenience caused.
• The company’s failure to follow through on their commitments has caused both financial losses and considerable stress.
• Legal Grounds:
• The company’s actions constitute a breach of contract as they failed to deliver the goods as promised, violating the Indian Contract Act.
• The consumer’s right to fair treatment and compensation under the Consumer Protection Act has been breached, as the company has not adequately responded to the consumer’s claim for damages.
• The consumer is entitled to compensation for the mishandling of goods, as per the provisions under the Indian Consumer Protection Act (2019).
• Expected Resolution:
• Immediate retrieval of the shipment from the incorrect recipient in Mumbai.
• Full compensation for the loss and inconvenience caused, amounting to at least the actual value of the items in the shipment.
• Timely delivery of the goods to the correct address in Mangalore, without any further delay.
• If the goods are damaged or tampered with, a full refund for the value of the damaged items in addition to the cost of shipping should be provided.
• Consequence of Inaction:
If this complaint is not resolved promptly, I will be forced to take further legal action, which may include:
• Filing a formal complaint with the Consumer Court under the Consumer Protection Act.
• Seeking compensation for financial loss, as well as legal fees and damages for the emotional distress caused.
