[Resolved]  Flipkart — fraud, empty box delivered instead of redmi note 4

I placed an order for redmi note 4 (Dark grey, 64 gb) on[protected] and paid through net banking before hand. It was expected to be delivered on following monday (31st july 2017). On monday i received a message from flipkart application notifying that the product has been delivered, but the product was not actually delivered. I called the customer care and complained that i haven't actually received any product, but i received a message that the product has been delivered.

The next day (Tuesday), the courier partner delivered a package at the specified address. I opened the package only to see an empty box in it. There was nothing in the package except an empty box. The seal of the empty box (The empty box was that of the phone, i suppose) was tempered. I immediately called the customer care, told them that i was delivered an empty box. They assured to help me. I also called the courier partner, and he told me that cannot say if there was actually anything inside the package. He also added that his job is just to deliver the package.

Few days later, after repeated complaints, a staff of flipkart called me and said that a replacement has been sent and i will receive the product by 9th of august 2017. I also received a message from flipkart app notifying that the replacement has been sent. But before the replacement was actually delivered, the flipkart cancelled it themselves leaving me with nothing but an empty box for the rs.12, 999/- i paid.

I have repeatedly called them ever since and asked them to refund my money to compensate for my loss. They only extend their apologies and excuse themselves citing that they have technical issues. They dont appear to have any intention of actually performing their part of the contract.

I request the community here to inform me about the legal recourse that could give me justice. Thank you.

I don't understand what flipkart means by 'internally'. Nothing has changed, my issue is not solved. Flipkart has not delivered anything for the Rs .12, 999/- I paid, except an empty box. I have suffered huge loss in terms of money and time.

I request the community here to guide me about the legal proceeding that I could initiate against flipkart for the damages I have suffered.

This kinds of fraud should not be tolerated in India. No Company should be allowed to deceive a citizen of this country.
