My joining date was on 17th May 2023 in HCL Noida but due to some medical reasons i couldn't join HCLbut informed HR and Reporting
manager on the same date of joing in evening at 8pm over email and phone by giving medical reasons. Before Date of joining, I uploaded all documents and signed the pre-formalities mandate docs
that is 'Joining Docket' as Terms & Conditions of Employment Agreement .
But on the specified joining date, i was not physically available in designated HCL office. So formally my joining was/is not done because it was my physical joining in HCL.
As a responsible person i informed them over email and phone on the same date i.e 17th May 2023, that i am not going to continue with HCL
and request that please circulate the same message to other department also but HR recruiter didn't informed others.
After that salary had been credited in my account on 1st june 2023 for May 2023 month and the amount was around 50k.
As i saw that salary is credited in my account, i connect HR recruiter and inform them and sent a mail again for the same thing on the same day.
After that, HCL started to send me notice over email and postal adderss.
The Notice and My Reply are mentioned below:
FirstNotice - 2nd june 2023 & Replied -2nd june 2023
Second Notice - 9th June 2023 & Replied -14june 2023
Third Notice - 16th June 2023 & Replied -19th June 2023
After 3rd notice, they sent me a FnF Settlement recovery notice on 27th July 2023 which says 177272.21 LPA as recovery amount i have to pay to them.
I didn't take any electronic assests/laptop, neither they provide any trainings.Didn't take any advantage of HCL instead of this
i always replied them over email whenever they sent me notice over email.
On 5th October 2023, i got a legal notice demand from SRCS advocate which is for paying 177272.21 LPA as recovery amount to HCL.The fact is i don't have money and i am still unemployed.I don't have money to pay this huge amount to HCL and I am not going to pay HCL whatever amount they are claiming. This is mentally torture & harassment which has been done by HCL from long time.
I have proof of all the emails that I have sent and replied to their notices, still they want me to drag in this matter.
I was not availavle in HCL campus on the date of joining, i didn't take laptop/assets and any kind of training.Not attained any meeting, no involvement since beginning still they are charging this huge amount as recovery amount.Now it became a serious matter for me and my family because HCL is now harrasing us by sending this legal notice.Please help me to get out of this situation permanently. I am very disappointed with HCL & management, the way treat with peoply who don't join them.
