Hi All,

Please be aware of Realtors like Remax, Hanu reddy, cresents, LG hooker, Rootestate where you find them in Propertyfeast.com. They are cheating people. If the cost of the House is 20 lakhs, they are quoting around 80 lakhs and if cost of property is around 40 lakhs their price is 3.5 cr-8cr. But none of them are sold as nobody in this world can offord this price. Pls dont think real estate prices are increasing. Prices are coming down from 2009 and still you have to wait for 1 or 2 years. If you plan to buy a PLOT, Always ask the sellers for 300-500 RS per sqft and if it is an Apartment, dont pay more than 15 lakhs. Dont get fooled by these realtors unecessarily though they are not ready for your price. You will end up paying the loan until you die or commit suicide.

Note: Realtors are planning to sell one property, make profile and buy 10 properties and traveling in luxury cars like
AUDI, BMW whereas normal employee or a software is not able to becaz they are fools. And goverment is also getting lot of
money and free Plot and Villas from Builders, so they are supporting Builders and Village people. That is the reason so many projects are coming up in Bangalore. They are not building properties for people, it is only for money. Have you ever seen Residents in Manyata techpark. All the residents are politicians and fraud people. They are aquiring free lands every corner and making an Assets for thier children and granchildren.

Forget to add few more Builders like Ferns, Roshan Realtors, Essel garden, LG lake dew, Asha Township, Sonam layout, Kanakashree, BDS nagar in and around Hennur road who are cheating people though the layouts are not converted or Approved and there is no cauvery water and if you dig Borewell you wont get a drop of water. People have bought properties here for 10-50 RS per sqft 5 years back and now selling it for[protected] Rs per sqft. If the goverment aquires your land/Plot, goverment will not pay a single amount of your investment as this is Revenue plots or in Green belt. If you want to get fooled pls go ahead or else negotiate for 100 RS.

    REAL ESTATE COMPANIES ON ASSURED RETURN BASIS IS AGAINST SEBI & RBI ACTS AS PER COURT ORDER DATED 29.08.2012

    Division Bench, consisting of the Hon'ble Acting Chief Justice and Hon'ble Mr. Justice Rajiv Sahai Endlaw of the High Court of Delhi, on a public interest litigation WP(C) 5324/2012 filed by an investor, have issued directions to the Reserve Bank of India and Securities & Exchange Board of India to investigate against real estate companies who are inviting booking of property from the public with assured returns. The Hon'ble High has also further issued directions to take further remedial steps not only in restraining inviting booking on assured returns but also to take other action as permissible under law as well.

    ORDER / 29.08.2012

    1. This petition is filed in public interest. The petitioner has brought to the notice of this court that respondents no. 7 to 10, real estate development companies are inviting deposits from public with assured returns with buy back options. The submission is that the same amounts to banking activity within the meaning of Section 45-IA of the Reserve Bank of India Act, 1934 as applicable to non-banking financial corporations and is without the permission of the Reserve Bank of India as well as SEBI and cannot be undertaken by respondents no.7 to 10. It is further pleaded that not only are the said activity illegal but it is possible that small time investors having limited funds would be duped by such companies.

    2. We find that the petitioner had sent a representation to the Reserve Bank of India and SEBI only on 10.7.2012. Learned counsel for SEBI has appeared on advance notice and has submitted that on the representation of the petitioner, action has been initiated and the matter is under investigation. He has produced copies of letter dated 06.08.2012 addressed to respondents no.7 to 10 asking them to submit required documents to take further action.

    3. Since the matter is already under examination by the concerned authorities, it is not necessary to entertain this stage except for directing the RBI and SEBI to conduct and conclude the probe at the earliest and if it is found that respondent no.7 to 10 are not eligible to undertake such activities, take further remedial steps not only in restraining these respondents but also to take other actions as permissible under law as well. Petitioner shall be intimated about the outcome of the proceedings of the SEBI. In case the petitioner remains aggrieved by the action taken by the concerned authorities, he would be at liberty to approach the Court.

    With the aforesaid directions, the petition stands disposed of.

      Imperia Structure director's the Batra's refused to pay the committed return @ 12.5 p.a. from a April 2012 onward to all investor on their investment in Imperia Residency at Greater Noida K P V which they have to pay every monthe as per written M.O.U. till the occupation of entire building..They have told to us that we should accept their offer in Toto which is as follows;-
      "The investor should accept thee return up to 30the Sept 2012 and forget the further return thereafter and clear their balance dues and take the possession of the unfinished Studio apartment without obtaining the completion certificate as well as occupation certificate from Greater Noida Autheority(which is the builders responsibility as per norms).They also saying that they can not do more than this."
      we all investors are being cheated by builder in this way.
      Pl advice what to do next.

        I am Asha Uppal, resident of House Number E-47, Vishwas Park, near Tar Factory, Rajapuri, Uttam Nagar, New Delhi-110059. Builder Floors are constructed by a builder at House Number E-44, E45 and E-46, Vishwas Park, near Tar Factory, Rajapuri, Uttam Nagar, New Delhi-110059 due to which there are cracks in my house in all the rooms. I have attached the photographs for reference. I spoke to builder, his name is Pankaj Jain, and he said that he is in MCD. Please help me and take necessary action against Pankaj Jain.

        Newly Built House — Damaged flooring

        Sir

        I builted a house through a contractor 1.5 years back - now one bed room's tiles were automatically coming out, also some of the tiles were going down in to the ground - huge gap is found - due to this the cub board got cracked (1") gap found.

        Is it possible to claim commonsation - please guide me

        Hi Sir,

        I am Asha Rani Uppal, resident of House Number E-47, Vishwas Park, near Tar Factory, Rajapuri, Uttam Nagar, New Delhi-110059. Builder Floors are constructed by a builder at House Number E-44, E45 and E-46, Vishwas Park, near Tar Factory, Rajapuri, Uttam Nagar, New Delhi-110059 due to which there are cracks in my house in all the rooms. I spoke to builder, his name is Pankaj Jain, and he said that he is in MCD and started abusing.

        Please help me and take necessary action against Pankaj Jain his Mobile No is [protected].

          My Dad had bought a flat in Bhayander (E) in 1994 for Rs.2,25,000. He had given the amount of 1,50,000 through Bank loan and the rest of 75,00 was to be given through cash. My father had given this amount and he has two reciepts of Rs 2,00,000 and Rs. 25,000 as token, which makes the total sum of Rs.2,25,000. However, the builder had not given possession of our flat since 1994 as he said that the 75,000 were not paid. Whenever my dad used to visit him he used to tell that he wants the original documents of the flat then only he will talk on this issue. On Jan'12, my father recieved the property documents from Bank after full payment of the loan and we approached the builder.

          But now he says that we have to pay up Rs. 13,50,000 which is actually the cumulative interest of 18% on Rs. 75,000 since 1994. Only then he will give the possession. Or he says he will give us Rs. 1,50, 000 which bank paid him and we should surrender the property to him.

          We have all the original documentation of the property with us. But due to financial condition, we cannot file a case against him. Please advise how we can proceed in this case.

            Hi, I booked units in Imperia Residency in 2010 in Greater Noida, KP V. I was informed that Imperia had tied up with Clark Hotel and would give assured rentals of Rs.18000 pm for 1 bhk. But recently I was given the letter stating that I would get only 6% returns on my investment. They have also given possession letter without receiving completion certificate from authorities.

            In agreement, there was no clause of cancellation because they knew that such situation will arise. When I asked them to refund they are deducting 24% assured returns and 20% cancellation totalling to 44%. This company has a history of doing frauds without any fear.

            I appeal to all those investors who have their hard money stuck with Imperia, to revert on this compaint so that we as a group can file ca case against them.

            Totally fraud, cheater, lier, unethical managment of imperia, having records of not keeping his promise, only aim to take money ftom investor & give tension by handing unfinished office space, not leasing it out, number of court case pending against them, all project having same status so think millions of time before investing in Imperia

              Yes, I'm also one of the victim of "SRI CHOWDESHWARI BUILDERS AND DEVELOPERS", headed by Mr. Raghu Veera D.
              He played with our hard earned money for almost 1.5 years and then later on he said either you pay Rs 2500/sqft and plus plus or you can come out of the deal..
              We went with trust. but he is not the person to be believed...
              Beaware of these kind of developers who plays with our hard earned money...

                    Sir,

                    In 1976 or so when I retired from the Armed forces I booked a plot in a layout as advertised as HERITAGE about 20 kms from Whitefield, Bangalore in the area of Varthur.

                    I have paid all the installments and the receipts are available with me.

                    There was a split in the share holders of the earlier Company and now the project is being handled by SUN CITY developers.

                    The chairman has been nice and promising that he would shortly allot the plot and get the registry done but in vain. He accepts that the payments have been received and the records also say so. However, no action has been taken.

                    Now he says that the land is not being converted and that he cannot assure the time frame in which this would be possible.
                    Hence either I wait or I take back the money as paid to him with double the amount.

                    So if I have paid 5 L then I get 10 L now. Whereas the valus of land there has gone up from Rs 90/- per sq ft to Rs 750/- per sq ft. This is almost 8.33 time the original valus whereas he is offering just double!

                    What is the legal options open to me please?
                    Retirment from the Army at that time I had put in all the savings in it and now I am taken for a ride.
                    I have been meeting him quite regularly but in vain.

                    Please advise.

                      मेरी परेशानी ये है कि मैंने और मेरी बड़ी बहन ने मिलकर एक फ्लैट ख़रीदा है. जिसकी नीलामी 6 june 2011 को नगर पालिका की ओर से हुई थी जिसकी सरकारी कीमत 7,50,000रु. राखी गई थी. नीलामी में शामिल होने के लिए 75,000 रु. जमा करवाए गए. नीलामी में ये फ्लैट 8 ,71 ,000 रु. में हमारे नाम पर छोड़ा गया. जिसकी 25% राशी+ नीलामी में शामिल होने वाली rashi हमसे तुरंत जमा करवाई गई और बाकि 75% राशी 22 july 2011 तक जमा करने के लिए महुलत दी गई. जो कि हमारे द्वारा 22 july 2011 को जमा कर दी गई. और हमें फ्लैट कि चाबी नहीं दी गई और R.I कि तरफ से ये बताया गया कि उस फ्लैट toilet की निकासी और पानी की व्यवस्था नही है जो कि अगले 15 दिनों तक हो जायेगीऔर आपको चाबी दे दी जाएगी.
                      लेकिन 3 महीने से ज्यादा हो गए है न तो उसमे कोई काम हुआ है और न ही हमारी कोई सुनवाई हो रही है इन 3 महीनो में 4 आवेदन दे चुके हैं.
                      अब मै बहुत ही ज्यादा परेशांन हो चुका हूँ . कृपा कर आप मेरी मदद करें.

                          NA orders for Tuljapur,Osmanabad district are pending from last 4 months.
                          In tahsil almost 12 NA Orders are pending irrespective of completion of all documents.
                          Tahsiladar and nayak Tahsildar at Osmanabad,Tuljapur are not signing a single NA order and unnecessessary harrasing land owner.
                          Its hampering our busness.
                          One side of life we talk about IT,eGovernance and work on single click and on other side officers are delaying whole sceen for months.
                          How can we expect India to be growing and superfast with such governance?

                            Dear @ MCHI,

                            This is Rakesh Thakur, I am residing in Kalyan and booked a flat in Tawripada, Near Filter Plant, Kalyan.
                            My Apartment has been completed but yet to receive the Completion certificate from the Local Authority.

                            Few days back I have recd a letter from My Builder stating that the Service Tax and VAT is now applicable on purchase o[censored]nder construction flats and need to deposit the same asap. As per him the High Court had instructed all the Builders to collect the 2.575 % Service Tax and 1% VAT from the end user (buyer) and deposit the same to them. The payment is scheduled to High court every month on 21st so he is insisting to deposit the same before this 21st otherwise penalty would be levied on the total taxes.

                            As per my knowledge the Stay put by HC is still not been lifted, I proposed him that I will give an indemnity bond so that you will be out from this responsibility, but he says no to it.

                            I request you to please confirm is really the 2.575 % Service tax and the 1% VAT is to be paid on the property taken by me as possession on flat would be dependent on that.

                            Please let us know the current status of high court hearing on service tax & VAT for under construction property ?
                            As i made the sales of agreement on Aug 2010 and I will get the possession in May 2011.Now my builder is asking & charging service tax on under construction buildings.
                            Can we know that service tax stayed by high court on construction of buildings is liftet or still is there & ask them not to charge service tax…

                              Our builder is failing to provide any security to us. We've had 3 incidents of serious security lapses in the condominium. While the builder is charging us a high Rs 2 per sq ft for maintenance, the security provided is dysfunctional and ineffective.

                              Is there a law that can help us seek redressal to this?

                                Hi I live in the vicinity of Vihar Lake. The access of Saki Vihar Road from Morarji Nagar is like a bottle neck where we have shops and other vendors like fruits, grocery and fish market. Over the last five years i have seen tremendous amount of encroachment making it difficult for pedestrials or vehicles to make their way on the road. The complaint is in particular to the fish market around 2-3 vendors who is right under the nose of the beat police station. Can you beat it, last time it was demolished whenthey had temporary make shift places and now I see they have a freezer, with electricity supply and a proper shop with shutter. How come we allow this and then we speak about outside state people from north and south as encroachers. Now how are they paying the bill, and other taxes. the best part the fish is sold at exorbitant prices, does the govt ever bother to check how much they earn sometimes the fish goes for 4-500 rs, in fact they make more money than we do without any investment. India is a great country and mumbai in special to make money and encroach to such places. I think I should also make a tent and within few years have a shop established in my name. SO EASY

                                  I had booked a plot in Suvarna Bhoomi Venture at Kothavalasa, about 2 months back by paying approx Rs. 90,600/- through cash (vide recpt no. VIZ01896, DT. 16.12.2010).

                                  However, due to certain developments on my domestic front, i am forced to withdraw from the above mentioned investment. Please guide me as to the procedure to do the same.
                                  Mr Nagaraju, (your executive) through whom i had booked this plot, claims that the said amount will not be refunded to me under any circumstances. This attitude has me worried
                                  and anxious about my money.

                                  Kindly show me a way out. Your Organisation appears to be a reputed one and this type of reply has me stumped!!!

                                  I had booked a plot in infratech infrastructure at nagpur, maharashtra, about 8 months back by paying approx Rs. 460000/- through chq .i am forced to withdraw from the above mentioned investment.because of some personal problem.i gave withdraw application near about 3 months, but they cant replay, Please guide me as to the procedure to do the same.

                                    This is Prakash a koppal resident and a son of retired govt employee.

                                    I heard you are doing a good job for koppal district and even i seen few development activities when i visited last month.

                                    Sir/Mam i have a query here : From last 2 years the site values are jumped from thousands to lakhs[ex: 50 thousand rupees sites become minimum of 5 & max to 10 lakhs]
                                    the reason is lot many real-estate brokers are entered and they bought many sites and now they are selling those a minimum of 500 Rs per Square Feet.

                                    Really my father or a common man is frustrated and struggling to construct a house in koppal.

                                    Sir/Mam - i have an option here if you have authority to implement this please help :

                                    Option is : List all the areas/layouts and fix the amount per square feet.

                                      I have booked flat and entered into registration on 28th March 2010.
                                      Part of the payment is made before 30th June 2010.
                                      Completion certificate is dated 16th June 2010
                                      Balance payment is made in the month of July and August.
                                      Do I need to pay service tax in this case?

                                      My builder is insisting me to deposit service tax amounting to Rs.75,000/- or asking me to provide bank guarantee.
