Sub: complaint against the irctc for refund in case connecting train misses

This is to inform you that on 1st april, i had to catch two trains for my journey to mumbai.
I was travelling from bhilwara to ratlam (First train) details of which are as follows: train name: ju indb exp (14801)
Pnr no.: [protected]
Timings : 15:06 to 20:40
Then, i had booking from ratlam to mumbai (Second train) details of which are as follows: train name: jp mmct supfast (12956)
Pnr no.: [protected]
Timings: 21:52 to 7:40
Charges: rs. 1325 + 300 (Agent charges)

My first train i. E train no. 14801 was running late for 2 hrs. And therefore it reached at bhilwara station at 17:00 hrs. Instead of 15:06 i. E 2 hrs late. Due to the first train running late, i missed my connecting train without any fault of mine. Pursuant to which i requested the station master of the ratlam station to connect my ticket with some other train for reaching my destination.

However, my request was refused on the grounds that it was not permissible under law, and i had to purchase a new ticket for my journey from ratlam to mumbai which again costed me rs.1400 + 300 (I. E station ticket) i bring to your attention in the default of services by indian railways or train getting delayed for any reason. How is it a fault of consumer who booked the particular trains keeping in mind the reasonable time gap between both the trains.

On the very same day i called and inquired on 139 for the refund and losses suffered by me. Moreover, i was informed that refund of money would not be made as there is no such rule of refund. I had to take another ticket for the same journey in spite of me having no fault. This is illogical and unfair towards consumer.

There were so many passengers who suffered losses due to the deficiency of service by indian railways and is misusing their monopoly.

This is nothing but misuse of their power and monopoly and forceful situation of paying for another ticket because of no option being left in the midst of journey. This is a fraudulent practice and unfair trade practice of indian railways.

However, when passengers had already paid the amount in advance for the tickets and were not able to catch the train for mumbai due to no fault of their own, despite this, the indian railways did not cooperate with us and we had to buy a new ticket. This conduct of the opposite parties amounts to unfair trade practice.
There are catena of decisions of district and state consumer in our country wherein order was passed in favour of consumer for refund with compensation by indian railways.

Kindly note that i now hereby request for the refund of my entire amount of rs. 1665/- for train that i have missed due to the first train running late..
This is to bring to your notice that they are conducting unfair trade practices under section 2 (1) (R) of the consumer protection act. Consumer protection act gives consumers the right to refund against deficiency of services.

Kindly note if my issue is not resolved within 7 days and if the full amount is not refunded, i reserve my right to file civil/criminal proceeding against indian railways for my losses, harassment and inconvenience seeking higher compensation with the legal costs.
