I am registering this public grievance against Kotak Mahindra Bank's asset recovery division (Loan Ref: SPLN90680849, Ex-Standard Chartered Portfolio Pool) for severe jurisdictional harassment, violation of the RBI Fair Practice Code, and arbitrary rejection of a settlement offer. I have already filed an official government complaint under National Consumer Helpline (NCH) Grievance Number: 10224146.I am a permanent resident of Surat, Gujarat. Due to unexpected and catastrophic losses in my commercial business, I suffered a financial default on a personal loan credit line. Prior to this business collapse, I acted in absolute good faith and successfully repaid 29 consecutive monthly EMIs of ₹19, 231 each, transferring an aggregate sum of ₹5, 57, 699 directly to the bank .Despite recovering over ₹5.5 Lakhs and knowing the default is due to involuntary commercial insolvency, Kotak Mahindra Bank has bypassed normal financial channels (Section 25 of the PSSA Act). Instead, they have aggressively weaponised the criminal judicial machinery by registering a private complaint under BNS Sections 316(2), 318(4) [Cheating], and 61(2) [Criminal Conspiracy] in the 14th Judicial Magistrate Court at Calcutta (Case No: CS/303294/26).Filing a criminal case in West Bengal against a distressed borrower living in Gujarat (2, 000 km away) constitutes gross jurisdictional harassment designed solely to cause logistical distress and prevent a fair legal defense. Furthermore, the local Surat branch has arbitrarily rejected my good-faith, lump-sum One-Time Settlement (OTS) offer of ₹1, 00, 000, which would bring the bank's total asset recovery to over ₹6.5 Lakhs.I demand that Kotak Mahindra Bank’s central compliance cell intervene immediately, place the Kolkata court proceedings (scheduled for September 29, 2026) in abeyance, overrule the local team's arbitrary rejection, and issue an official corporate OTS Sanction Letter for ₹1, 00, 000 with a clean withdrawal clause. I am cross-filing this case directly with the RBI Integrated Ombudsman. Was this information helpful? |
