Kotak Mahindra Bank — Salaried Personal Loan Account (SPLN[protected] Grievance

COMPLAINT AGAINST KOTAK MAHINDRA BANK:

To Whom It May Concern:

I am writing this Complaint and Grievance after innumerous phone calls & visits to the nearest Branch of Kotak Mahindra Bank, WITH ABSOLUTELY NO HELP OR RESOLUTION.
I had availed a Salaried Personal Loan from the bank on 30-Sep-2019 of which, an amount of 6, 78, 276 was disbursed to me. I have always ensured payments of EMIs on time until I called Kotak Bank's Customer Care sometime in October 2020 in order to request for a FORECLOSURE LETTER so I can close the loan. It was not until then that I came to know that all my Personal Details were all WRONG, as I could not verify the details they have on my account, to proceed as per the process followed by the Customer Care Officer then. Therefore, obviously, I didn’t receive the foreclosure letter in my inbox.
I then had to Physically walk in to the nearest Kotak bank Branch in Shillong, Meghalaya (where I am currently at), to request them to correct my details. The branch Manager there was very helpful (although I'm afraid I didn't get her name), she called somebody in a Delhi Branch and requested if they could help correct the details, but in vain, they said they couldn't do anything as the details that were entered were done through an account I probably had when I joined my very first company AND, which I HAD LEFT BEFORE I EVEN RECEIVED MY KOTAK BANK KIT. THAT PARTICULAR BANK ACCOUNT WAS NOT EVEN ACTIVATED!!! So, I was told that whoever had entered my details for the loan account had just picked up some random details which DID NOT EVEN BELONG TO ME!!!
So, my FIRST QUESTION HERE IS, WHO GAVE PERMISSION TO THAT PERSON TO ENTER INCORRECT OR WRONG DETAILS AND LINK IT TO MY ACCOUNT??? IS THIS NOT FRAUD???!!
TWO: Because of this, I did not get any loan account details in my email because the email as per the bank's record currently, is totally INCORRECT.

Now, ever since, I have been calling to check if someone can help me correct the details but all the answer I get is, I have to visit a branch!!! How could I do that when you don't have a loan department where I am?? Surely the bank does not expect me to fly to Delhi for this, right? Moreover, why should I be the one to clean up somebody else's mistake???

Anyway, this is where all the frustration and anger start: once I realized that nobody could help me here, I stopped the EMIs requested from my bank account set up for this loan, thinking that someone would call me and help resolve this. But NO, instead, the Collection Agency OR RECOVERY TEAM (as they called themselves), started HARRASSING NOT ONLY ME BUT MY REFERENCES!!! As I understand, a REFERENCE is not a GUARANTOR, so clearly, a Reference has nothing to do with my loan or the repayment. THEN WHY WERE MY REFERENCES HARRASSED??? NOT ONLY WERE WE ALL HARRASSED BUT, WE WERE ALL THREATENED AS WELL. OUR RIGHT TO PRIVACY WAS VIOLATED AND MEN AND WOMEN WERE SENT TO MY REFERENCE'S HOUSE, WHICH IS INTIMIDATION!! ALL THIS WAS DONE/SENT BY THESE PEOPLE MENTIONED HERE: THESE APPARENTLY ARE ALL EMPLOYEES FROM THE: D -10, 1 & 2, 2ND FLOOR, LOCAL SHOPPING CENTRE, VASANT VIHAR, DELHI-57, BRANCH.
MR. SAURABH SHARMA – [protected] (he promised to waive off all the penalty, late fees and bounce charges verbally if I made a payment of 31, 441/- odd and also harassed my reference)
MR. ZEESHAN AHMED – [protected], email: zeeshan.[protected]@kotak.com ( Right to Privacy Violated: emailed my previous company, emailed attached)
MR. MADAN LAL (picture/ID attached) – [protected] ( Right to Privacy Violated and Intimidation: he showed up with another man at my reference’s residence, shouting from the road before he was called up to the door by my reference) and,
a female staff who had threatened me and my references and MR. Sharma claimed to have fired that lady.
Not only have they violated all my Privacy Rights, Mr. Zeeshan Ahmed has also gone ahead and emailed my Company, that I do not work for any longer, about my non payments!! Is this even LEGAL?? Doesn’t RIGHT TO PRIVACY apply here?? Or isn’t this a RIGHT TO PRIVACY VIOLATION??
They would start calling me and my references from early morning till late AFTER OFFICE HOURS, repeatedly and treating me like I was a Criminal!!! Initially, when I had told them of the problem I was facing, I and my family had tested Positive with COVID 19. Yet, they harassed the life out o[censored]s. MR. SAURABH SHARMA EVEN PROMISED ME VERBALLY (UNFORTUNATELY, I TRUSTED HIM AND HIS WORDS SO DIDNT ASK FOR IT IN WRITING), THAT IF I PAID 31, 441/-, WHICH I DID IN MARCH 2022, HE WOULD WAIVE OFF ALL THE PENALTY CHARGES!! BUT AFTER I PAID THE AMOUNT, I LEARNT THAT ABOUT 12000/- WORTH O[censored]NPAID PENALTY CHARGES WERE PENDING!!! WHAT IS THE MEANING OF THIS??
I did mention to them stating that I have only stopped payments until the bank corrected my details. Because the details on my account are NOT MINE. Yet, I have been paying all the BOUNCE, PENALTY AND INTEREST charges all along!!! For over ONE and a HALF years now, I HAVE PAID ALL THE CHARGES charged to me by, NOT ONLY KOTAK MAHINDRA BANK, BUT ALSO MY OWN BANK WHERE THE EMIs WERE COMING OUT FROM. SO, MY QUESTION HERE NOW IS: WILL THE BANK RETURN/ REIMBURSE AND COMPENSATE ME ALL THE MONIES CHARGED OR NOT?? FOR ALL THE HARRASSMENT I AND MY REFRENCES HAVE ENDURED OVER THIS PERIOD, MY CREDIT HISTORY HAS BEEN MESSED UP. SO, I DEMAND COMPENSATION AND, CORRECTION OF DETAILS WITHOUT HAVING TO ASK ME TO VISIT A NEAREST BRANCH, BECAUSE IF YOU GO BACK AND INVESTIGATE AND PULL OUT MY APPLICATION FORM, CORRECT PERSONAL DETAILS ARE RIGHT THERE. BECAUSE, A BANK’S REPRESENTATIVE HAS COMMITTED FRAUD IN THIS CASE, BY ENTERING DETAILS OTHER THAN THE ONES MENTIONED IN MY APPLICATION FORM THAT I SIGNED WHILST APPLYING FOR THE LOAN.

I HAVE SAID IT TO THE PEOPLE MENTIONED ABOVE AND TO ALL REPRESENTATIVES OF THE BANK, THAT I HAVE NEVER REFUSED PAYMENTS AND NEVER WILL BUT, I WANT A YEAR AND A HALF'S WORTH OF MONEY PAID, BACK. BECAUSE WHEN I WANTED TO CLOSE THE LOAN IN OCTOBER 2020, I COULD NOT. So, I HAVE HAD TO PAY ALL EXTRA CHARGES FOR THAT PERIOD TILL DATE.

NOW, I HAVE BEEN HARRASSED ENOUGH BY THE BANK’S REPRESENTATIVES, THEREFORE, I REQUEST THE BANK TO PUT A HOLD ON THE EMIs TILL THIS IS RESOLVED, RESOLVE THIS ASAP AND PAY ME BACK ONE AND A HALF YEAR'S WORTH OF INTEREST, PENALTY, BOUNCE, LATE FEES ( FROM OCT 2020 TILL DATE) PAID, BACK TO ME AND WITH MY DETAILS CORRECTED AND ALL THE AFOREMENTIONED PEOPLE TAKEN STRICT ACTION AGAINST, AND I WOULD LIKE TO TAKE THIS UP FURTHER WITH THE BANKS OMBUDSMAN IF NEEDED.
