Dear Sir/Madam,
I, Shubham Kansal, advocate, represent the complainant (Vehicle Owner) in this matter. My client purchased a Mahindra XUV700 (UP15ER6627) from Jai Kumar Arun Kumar (JKAK), authorized Mahindra dealership, on January 1, 2025. The vehicle, running only 4600 km, developed a clutch plate issue. Initially, Shree Shyam Dealer, Meerut, diagnosed a flywheel issue, but JKAK disputed this, causing confusion and harassment.
This conflicting assessment has led to mental distress, financial loss, and unfair trade practices, violating the Consumer Protection Act, 2019. We request:
- *Immediate Resolution*: Rectify the clutch plate issue under warranty
- *Joint Inspection*: Conduct a joint inspection by Mahindra & Mahindra representatives
- *Compensation*: Provide compensation for mental harassment and service costs (₹49, 000)
- *Action against Dealers*: Take action against Shree Shyam Dealer and JKAK for unfair practices
- *Refund/Replace*: Refund or replace the vehicle if issues persist
