[Resolved]  Microtek International — mental harassment and unlawful termination of services

Dear Sir/Madam,
This is in respect of my appointment on the position of Executive Assistant in Microtek International Pvt. Ltd., Udyog Vihar, New Delhi (hereinafter referred as “Your Office”).That I received a call from your good Office on 14thSept 2017 and was telephonically inquired about my interest for the abovementioned post. That at the said time, I was already working with prestigious VPS Rockland Hospital, Qutub Institutional Area, New Delhi, on same designation (EA to CEO).That in furtherance of telephonic conversation I was called upon for an interview on 16th Sept 2017 at Your Office. That soon after the interview, I was informed through an e- mail ([protected]@microtekdirect.com) dated 18th Sept 2017, that I have to undergo a “ Scientology: Oxford Capacity Analysis Test” formal selection. That amidst of above I was also requested to share my salary slip from the previous Office, which I instantly shared vide my e-mail dated same day i.e. 18th Sept 2017.That it is pertinent to mention here that during the course of my interview I was inquired from the representatives of Your O Office Ms. Nisha that from which date I would be comfortable to join the Your Office, to which I replied, that there are no as such strict notice requirement in my previous Office but, since it is already more than half month which has passed, I may only be able to join Your Office after completion of one full working month (1st Sept-30Sept’2017 ) as in any other case they may forfeit my salary for all the days I have already worked for in said organization. That during the interview I was categorically informed that in case I would be selected, I may be required to join Your Office at a very shorter notice, may be even before the conclusion of left days of the working month. That I was promised by your HR manager that in such case Your Office shall buy my payout period and shall give the salary of entire 20 days for which I have already worked in my Previous Organization (VPS Rockland). That specific noting to aforesaid effect was done by your manager on my job. On the 8th september 2017, I was telephonically informed that Your Office has selected me for the post of Executive Assistant to Mr. Rajesh Goel and is going to buy my payout days. That I was further informed that my formal joining in Your Office would be from 20th Sept 2017 and that I would be paid salary for all the past 20 days of Sept’2017 for which I have already worked in VPS Rockland. That in furtherance of above on 19th Sept 2017 Letter of Intent was emailed to me wherein the date of joining was mentioned as 20th Sept 2017.On the basis of your representations I joined Your Office on 20th June 2017. That on the very first day of joining I was informed to reach Office at sharp 9.00 Clock in the morning. That in furtherance of Your Office instructions on 20th Sept 2017 (first day of joining) I reached the Office at 9.00 Clock in the morning but from the very first day I was surprised see the temperament of Your Office Personals and especially of Mr. Rajesh Goel. That from the very next date of joining I was asked by the management of Your Office that Mr.Goel wants me to wait till he sits in the Office. That I objected to the same, as Mr. Goel usually sits in the Office till 7.00-7.30 PM. I stated Your Office is situated is an industrial area & the environment is not at all conducive for late night shifts. Further there is no easy direct commutation available at the door step of Your Office in such late hours and in devoid of aforesaid there is an imminent woman security issue. That I also brought the fact to your knowledge that I reach Office by 9 AM (for which I leave home at 8 AM) and by all standards the 8 hours Office shifts ends at 5 PM. That I further apprised the management of Your Office that any person may understand an occasional aberration of an hour or half to above said timing but post 6 PM it is even physically impossible to sustain your energy for any work. That I further noticed that strangely all the female start of Your Office in routine manner left the place latest by 6-6.30 PM and that I was the only woman who was constrained to remain in Your Office post 6.30 PM at the special Directions of Mr. Goel. That whenever I tried inquiring the above fact from the HR personal of your Office I was informed that Mr. Goel specifically wants me to remain in the Office till he sits there. The unprofessional attitude of Mr. Goel was not only astonishing but on the same disturbing and harassing. That I completed all my assignments meticulously within time before 6 PM and there was no rhyme or reason for making me wait till the time Mr. Goel wants. But, still on the instructions of Mr. Goel I was pressurized sit in an Office where there was no other staff woman left rather, on the contrary, very few staff members otherwise left, for the purpose best known to him and Your Office. That I have brought the above instances in the knowledge of Your Office and requested the management to take appropriate steps. That to my extreme shock and surprise instead of taking a remedial action I was informed that Mr. Goel still wants me to be with him in the Office till the time he does not leaves Office and that I may not have much choice in said regard. That Your Office has duped me and made me leave my previous job and landed me into a situation wherein you left no easy choices for me. I was constrained to succumb to the instances of your exploitation as narrated in preceding paragraphs or to leave. That in view of above ordeals, without any other rationale choice, I was constrained to take a call on my health & security on one hand and the job on the other. That without going into the merits, herein now, I just request you to release my pending dues. That in addition to above I hereby also demand a compensation of at atleast2 Month’s Salary towards the mental trauma and harassment faced by me due to the un-professional behavior of Your Office. You must note that I am the sole bread winner of my family and have financial commitments & responsibilities to carry. That sudden loss of job has prejudicially affected me and the aforesaid compensation is necessary as it will take care of my basic needs till the time I do not have a b. At the end I request you to pay the above Salary along ith compensation at the earliest, not later than 7 days of receipt of this letter, in devoid whereof I would be constrained to take legal remedies available to me against Your Office at your cost and expense.
