I, Dr. Debashis Pramanik (Age 60.6 years as of 16.7.2021) is a contractual employee (Guest Faculty - Professor) in the Tool Engineering Dept. of Delhi Institute of Tool Engineering (DITE/affiliated under GGSIPU), Okhla, New Delhi.
My house (H3/116 A, FF, CORNER PLOT, MAHAVIR ENCLAVE BENGALI COLONY, PALAM DABRI ROAD, NEW DELHI - 10045). Sir, my 2 ft long portion roof (chajja) fell and extra 6 ft along edge long stretch up to balcony overhead corner additional crack line occurred on 15 Jan. 2021. Past history is that my upper (2nd) floor owner (Mr. Amal Nath/Mob. [protected] & Mrs. Swati Nath/Mob. [protected]) was maintaining mini nursery in their balcony for last 7-8 years with around 15 concrete loaded tubs (10-13 kg weight of each) of ‘Paodha’ (even after repeated reminders), which caused severe damage of white cement between slabs, subsequent water seepage of through edges & corners and rusted (normally happens in oxidation months over months) major iron thin rods (sarias). However, I never encouraged him/them to maintain ‘balcony garden’ over our chajja. Since chajja fall, I followed up the matter 6 times (till 27 May 2021) with him also and had been receiving the same verbal message from him. It is also marked that the builder’s constructed wall patches are poor due to mix salty water use since construction, which couldn’t be struck or pointed out by Valuer of Allahabad Bank (house loan provider) also.
Anyway, I have been humbly requesting my overhead flat owner to get it repaired, but he is not agreeing to pay the total amount. Then I agreed to pay material cost for the masonry work and thereafter reminded him a minimum of 6 times. Now, he is ignoring the totally risky thing (without getting chajja repaired or giving repairing cost), rather secretly sold (at Rs. 25.5 Lakhs recently disclosed) the flat and taken plan for SHIFTING (or TRANSPORTING HOUSEHOLD ITEMS) to 1600 kms distant place Burdwan, West Bengal on 07.08.2021 leaving my very risky balcony’s chajja/roof dangerous condition. Surprisingly, his son has been working in MALAYSIA, son-in-law is in American Express Bank and they are intrinsically in very good financial state of affair. I have heard that he is a13-14 years back retired (from Aya Nagar) MWO (promoted) of IAF. I too have many contacts (even worked together as MR university faculty & Tata Energy Research Institute’s Fellow/colleague) in retired/on-role IAF very highly qualified Senior Officers (Col. Sachin Marwah, Col. RK Singh, WgC Anil Chopra, Late Col. Puri/ex-CAS, Grp. Cpt. Rajiv Seth/ec-Registrar & many others), but never seen such an evil/hostile/naughty (in continuity for number of semesters) person/human.
I would like to inform you that I have been suffering from high BP, prostate swelling, mild blood sugar and is extremely in urgent need of money for an operating prostate. It seems like my requests have fallen on deaf ears by the Nath Family and in case of my health deterioration, concerned they shall be held responsible for causing immense mental harassment and financial pressure. To my utter shock, I never expected this kind of bluffing, maintaining silence and intentionally delaying my legal claim of receiving payment of chajja/roof repairing from them.
My family members are scared throughout and even to stand at that balcony because of this next chance/moment of roof fall problem. Kindly urgently instruct Mr. & Mrs. Nath to get my chajja/roof repaired urgently (before leaving Delhi) or give the cost of its repairing to bring it to original condition as I had been alerting the overhead owners since 2016. Is it possible for you to contact me & him/them (overhead owners), inspect the broken chajja, knock/stop them by your esteemed Authority and get my roof repaired shortly and positively? I have a request to you, Sir, to urgently recover the cost of my balcony’s chajja repair from my overhead flat owner. Then, we can get it repaired soon to be safe and grateful to you. The cost estimate for chajja/roof patch repairing given by a third party promoter/builder is Rs. 35, 000.00.
I need your urgent kind attention, otherwise, we will remain in prolonged risk. I request you to issue necessary instructions to them as per law on house chajja/roof repairing or to process the payment of Rs. 35, 000.00 and issue the cheque of aforesaid amount.
