This is regarding the property finalised in Arcade Dreams listed on NoBroker portal. We initiated the purchase in December 2023 through NoBroker RM, opting for their end-to-end service package, including legal, loan process, and Khata Transfer.
The legal verification process faced significant delays due to document unavailability and inefficiencies from thier legal team. Our agreement was signed on 8th Feb 2024, but due to these delays, we approached HDFC Bank independently for the loan, which failed due to insufficient documentation from the seller's end.
Subsequently, we approached their loan team, for assistance with LICHFL on 3rd March 2024, with a promise of completion within a week. However, there were significant delays, lack of process control, and unmet timelines from their team. This necessitated multiple trips from Whitefield to Yelahanka to get status updates directly from the bank manager.
These delays exceeded the 60-day timeline in our agreement (drafting was done by your legal team), causing the seller to back out and demand a 10% penalty, citing delays from our side. Moreover, the property was relisted on NoBroker portal on 18th April 2024, despite our agreement not being canceled.
Efforts to resolve the issue through your senior employee failed, as the seller lost trust in our timelines. The seller has now only refunded ~50% of the advance and is unwilling to refund the token amount or complete the sale deed.
After sending a legal notice and filing a police complaint against the seller, we are left with no option but to pursue legal action. We are incurring significant losses in time, effort, and money due to their team's delays.
NoBroker is the one who is responsible for the seller turning rogue, losing confidence in us and hence we have to pursue the matter legally. Given these circumstances, we request a full refund of INR 37, 000 and compensation for damages amounting to INR 30, 000.
Additionally, we had also sent a mail to NoBroker on 5th June 2024, however, there is no response from their to even address the matter.
