This is in reference to the refund form submitted on 13th April 2026. Despite a 24-hour window, I have received no confirmation. I am hereby highlighting the legal violations regarding the "60-day delay" claim made by your staff:
1. Deficiency in Service – Consumer Protection Act, 2019
Failure to conduct even a single interview for over a year and now failing to process the refund as per the agreed terms constitutes a clear "Deficiency in Service."
2. Unfair Trade Practice – Consumer Protection Act, 2019
Withholding my refund by citing a "60-day policy" that is NOT present in our signed Stamp Paper agreement is a deceptive and "Unfair Trade Practice."
3. Breach of Contract
Our signed Stamp Paper Agreement (Point 2) clearly mandates a refund in case of service failure. Your refusal to credit the amount immediately is a direct Breach of Contract.
4. Cheating & Dishonest Intent – Section 415 & 420 of IPC
Collecting ?60, 800 and now wrongfully withholding the committed refund of ?45, 600 suggests dishonest intent and qualifies under the sections of Cheating.
5. Criminal Breach of Trust – Section 406 IPC
You are holding my funds as a trustee for a service that was never delivered. Wrongfully retaining this money constitutes a Criminal Breach of Trust.
6. Mental Harassment & Financial Injury
Your inaction over the last year has caused me significant mental agony and financial stress. I reserve the right to claim additional compensation for this harassment in Consumer Court.
7. Claim for Litigation Expenses
If I am forced to escalate this to a formal legal proceeding, I shall claim all court fees, lawyer's charges, and incidental expenses from Oasis Visas.
8. Evidence of Claim:
Signed Evaluation Report: By Branch Manager Priyanka Sharma, confirming 75% Refund (?45, 600).
Legal Agreement: Stamp Paper showing no 60-day waiting clause in Point 2.
Signed Refund Form: Submitted on 13th April 2026.
FINAL DEMAND:
I hereby instruct you to credit the full committed amount of ?45, 600 within 24 hours. Failing this, I will proceed with a formal case in the Consumer Court and file an FIR for the aforementioned IPC violations.
