[Resolved]  Olx India — The Seller sells a wrong Phone

Summary: I selected an used iphone 4s (with all accessories) on OLX India on my phone. It was mentioned that the phone is 3 months old and available with bill and all accessories. After selecting it i contacted the seller Kate (Olx Name) on [protected] and decided to pay 8000 for iphone 4s, 16GB with all accessories.

However, on meeting i got the phone with charger and duplicate USB cable. I bought the phone as it was in a good condition. The seller looked descent and very well behaved. On asking about the original headphones and charger, he confirmed that he would give me the original accessory on Monday evening. I agreed.

During the discussion, i understood that, the seller's name is Simon and not Kate.

I took the phone and came back home. I made the payment of 8000 Rupees online and transferred the money to the account no provided by him. (I can provide the account no if asked). The account no was of ICICI bank, Mumbai with account holder named as Angelo. It wasn't even 2 hours post buyig the phone, i discovered that it was a 8GB phone and not a 16 GB phone.

Then, I immediately contacted the seller and explained the same and said that i cannot use the phone as it is not 16 GB and also the charger isnt working, on which Simon replied that he would check and confirm back.

Later, when there was no call or message from Simon, i again called him back to check. He said, he was also not aware that it was 8 GB and agreed to return the money and take back the phone.

I waited for him to confirm the place and time, so that i can come and return the phone but he always made some excuses.

His excuses made me feel that i am now being cheated. he said " he spent all the money and he doesnt have money". " He is working to arrange money so that he can return it". "He is busy". "He will come and return the money in Marathahalli". etc etc but neither he came nor he called.

This is how i have been cheated. Please help in anyway possible.
