I, along with my wife - co-borrower and co-owner of the property financed under Loan Account No. HOU/GHA/0516/285825 with PNB Housing Finance Ltd.
We have formally requested the company to issue a No Objection Certificate (NOC) to enable execution of a registered Release / Relinquishment Deed, whereby I intend to transfer my 50% ownership share in favour of my wife. The loan account is regular and there is no default of any kind.
Despite multiple written communications and physical visits to the Noida branch, the company has failed to provide a clear timeline or confirm issuance of the required NOC. Instead, we are receiving repetitive acknowledgements and vague responses without definite procedural clarity.
Further, shockingly, after more than 10 years of the loan being sanctioned and active, the company is now demanding fresh loan processing fees and additional charges. We have been verbally indicated that unless such fees are paid, corrections and required documentation (including NOC) will not be processed.
This demand is arbitrary, unjustified, and appears coercive in nature. There is no restructuring of loan, no enhancement, and no new sanction involved. The request pertains only to relinquishment of ownership share, while borrower liabilities remain unchanged.
The conduct of the opposite party amounts to:
Deficiency of Service under the Consumer Protection Act, 2019
Unfair Trade Practice through arbitrary and unexplained charges
Coercive conduct by linking essential documentation to payment o[censored]njustified fees
Mental harassment and procedural hardship
Lack of transparency and accountability
The continued delay in issuing NOC and illegal demand for fresh processing fees after 10 years is unreasonable, unjustified, and exploitative.
Relief Sought
The Complainant respectfully seeks:
Direction to PNB Housing Finance to issue the required NOC within 15 days without imposing arbitrary conditions.
Cancellation of illegal and unjustified demand for fresh processing fees.
Full written disclosure of applicable charges with legal basis.
Compensation of ₹1, 00, 000 for mental harassment, coercive conduct, and inconvenience caused.
Litigation costs.
