I just want to apprise that honble supreme court dated 19.04.2012 against a civil appeal no.3631 of 2012 categorically stated that until consideration of appellant representation by the lt. Governor of delhi status quo with regard to the said land shall be maintained by all concern.
It was titled dalpat singh v/s govt. Of nct and anr. It further said that "and therefore any change in the status of the land shall be violation of the orders of supreme court for which contempt petition can be filed against the contemner. (Copy received from advocate of land owing deptt. Attached) sho vasant vihar is requested to meet director nihfw to get himself apprise of the reality of the land and take immediate action against removal of tower/ gen set before the contempt petition is filed, as it comes within the purview of the police who is also answerable before hon'ble supreme court. Grievance description : my entire family is living in great depression as a huge diesel gen set for operation of mobile tower has been illegally installed against the window of my house. I am chasing the matter right from unloading of gen set behind my house to various departments since 19th may 2016. About a month back it was commissioned when our ordeal started. My 2 year and 6 year old grand daughters family members continue to inhale diesel vapours omitted from huge generator and started suffering from respiratory problem being tender age. It is best known to mcd authorities as to how they adopt lenient view at the time of erection of tower despite my information to commissioner sdmc by not taking any action and preventive measures on 29.06.2016 by e mail. It not known under which pressure they are not removing the same as our each night is trauma for us. Prayer : kindly save us from the slow poison of diesel pollution, vibration and humming sound of generator being adjoining to my house. Please issue directions to commissioner-sdmc to remove illegally raised tower at the earliest on the humanitarian ground to breath our family and children pollution free fresh air. Thanking you. Man whosoever permitted to erect tower is not the owner of that land, he did so fraudulently. Hoping early reply
