Runwal Group — Refund of 2.5% stamp duty from Ekveera Enterprises, 1.5% on stamp duty from Runwal, wrongfully applied interest & other charges.

Grievance against Runwal Gardens, Phase I, Dombivli East.

1.We booked the flat in Runwal Gardens Dombivli on[protected] by paying booking amount 53, 950 + 2, 698 GST. During booking Abhay Bhatt from runwal gardens assured us that we will get 2 X 10 square feet balcony to the master bedroom. He told that they will send the plan for reapproval.(Our booking was depending on that promise. otherwise we would not have booked the flat). But we didn't get the balcony and it's a loss for us.

2.On[protected] we paid 5% amount as per demand 2, 22, 203 + 2, 323 GST. Again we paid 8, 788 additional GST as per Runwal. (This 2, 22, 203 amount is not reflecting in the account statement (Interest ledger) given by Runwal).

3.Then after some days we have been asked to pay 2, 780 then again we have been asked to pay rupees 10 again. we don't know who and how they are calculating this amount.

4.On[protected] we paid stamp duty 2, 51, 500 (But in one cost sheet the amount was 1, 89, 000 and in another 1, 95, 500), registration amount 30, 000, legal charges 10, 000 (in cash). This amount was paid to Ekvira Enterprises introduced by Runwal.

5.On[protected] we received an email from Runwal, Deepa regarding that we will get 2.5% waiver on stamp duty from Government and 1.5% waiver from runwal side then when we asked her about the same she told us that that amount will be adjusted at the time of possession.

6.Registration was done on[protected] after a very long follow up from our side and one day prior to my departure to Oman. My flight to Muscat, Oman was on[protected].

7.After flat registration, the documents were not submitted to HDFC, Dombivli from Runwal side in time. They submitted the registration documents to HDFC on[protected], more than 4 months later from registration.
This delayed further payment to Runwal as per demand which is not our mistake.

8.After that upon appointment my wife visited HDFC for loan disbursement on[protected], then my wife Mrs Snehal Suhas Dharavane (My power of attorney holder for the said flat) disbursed an amount of 15, 17, 000 on same date as per demand.

9.Then again another demand came from Runwal then we did the disbursement on[protected] for the amount of 7, 83, 578.

10.Then another demand came but due to some glitch, on[protected] another disbursement of 9, 30, 861 was done to Runwal. Which was excess than Runwal's demand. (More amount paid in advance for which I had to pay more interest to HDFC more than 1, 20, 000).

11.We asked for a photocopy set of flat registration documents to Runwal CRM Deepa but after a very long follow up they gave us the copy after 1 year that is on[protected].

12. We received an email from Runwal on[protected] regarding OC received for tower T5 and to pay the balance amount. They sent the related documents along with interest lager of an amount 1, 14, 528. So we asked the justification of the same to her. CRM Deepa told us that there was no mistake from our side but she will check from their side to cancel the applied interest amount.

13. Regarding government stamp duty waiver 1, 39, 500 Deepa told us to co-ordinate with Ekveera Enterprises that they will refund us the balance amount. So we are following up with Ekveera Enterprises, Mr. Ketan Sakpal since[protected]. But they are also not responding properly they are just replying that we will get refund. Now they have stopped replying to us. We are also coordinating with Deepa for the same matter. Upon contact with Ketan he told us that because of e-registration of the flat he had paid the amount to another vendor and that vendor will pay us back. Same is informed to Deepa.

14.We also followed up for refund of 1.5% waiver on stamp duty from Runwal. But they verbally told us that that scheme was only for the people who booked the flat in Covid period not for the old bookings. But we have email communication on[protected]. So we need that 1.5% stamp duty refund from Runwal side 83, 683.

15.Time went by we kept on following up but nothing happened from Runwal side. we just got the assurance from Deepa that it will be done it will be done like that but nothing happened. Then my wife visited to their office Deepa told that you pay the balance amount and then we will get the refund of the stamp duty waiver amount and also their audit team and management is not ready to waive off the interest amount but still she will try from her side for the waiver of interest amount.

16.My wife paid all the balance amount (including 1 year building maintenance and 3 year common area maintenance) on[protected] except interest amount.

17. We kept on following up for cancellation of interest amount applied and refund of stamp duty from government and Runwal side and also possession of the flat.

18. My wife had a meeting with Mr Victor alongwith Deepa who was senior of Deepa and talked to him regarding the interest amount. He told that he will check and inform to us within 8 days. Eight days passed but we didn't receive anything from their side. After that we also kept on following up but we also got assurance from Deepa that it will be done like this only.

19.Finally on[protected] me and my wife visited directly to Runwal office there we met Deepa she told us the same thing. Then we told her that introduced us to any of her superiors who can resolve this issue. Then she introduce us to Mr. Zubair who introduced himself as a manager. We put the matter in front of him that what had happened. But he did not take interest in to that and didn't listen anything properly. He was arrogant, he also told that until and unless we pay the interest amount we will not get flat position so they blackmailed and forced us to pay the interest amount and left us no choice. He left the meeting and walked out of the room without resolving the issue.

20.Then my wife called to Deepa twice or thrice then after sometime she came. Then my wife told her that what happened. Deepa told us again that there is no mistake from our side, she also tried her best but their audit team and management is not ready to accept anything. But we have to pay the interest so they will waive off only 50, 000 from the interest amount and you have to pay the balance amount that is 68, 065. They gave us a fresh copy of interest ledger on[protected] of 1, 15, 068.

21. Deepa sent us a link to pay 68, 065 amount to Runwal's account then we paid the amount on[protected]. Since then we are following up for the possession of the flat and other refunds but still nothing happened.

22. We checked the interest ledger and we found so many mistakes into that the first one on the first page is that our registration date is mentioned wrong that our registration was done on[protected] but here they have mentioned registration date as[protected].

They have applied interest on 0 receivable amount and 0 balance amount marked in pink colour of interest ledger on page number 3, 4, 5, 6, 7 and 9.

Also Runwal has applied double interest on same date marked in yellow colour on page number 4, 5.

Payment from our side is not reflecting in that.

Demand letter of[protected] shows amount payable -4, 16, 900 and demand letter of[protected] shows an amount payable for -4, 80, 467 and demand later on[protected] shows amount payable -1, 87, 576.
That means this excess amount was paid by me and was in account of Runwal till that time for which I had to pay excess interest to HDFC.

23. Due to this negligence and irresponsible behaviour from Runwal we have had so much trouble and cost us more amount so we request us to refund as below till July 2023 end. (In next month onwards the amount will increase).

We have records of demand letters, payment receipts, email communication and can be shared upon request.

A.Support us to get refund from Ekvira Enterprises 2.5% of stamp duty amount. 1, 39, 471.

B.Refund of 1.5% on flat registration amount from Runwal. 83, 683.

C.Due to delayed possession of the flat by Runwal we paid extra rent since April 2023 till date (July 2023) 4 months.
4X10, 000=40, 000.

D.Since after receiving OC on[protected], Runwal kept possession of the flat with them only. EMI paid to HDFC by us from April 2023 to till date July 2023 (4 months).
4X50254=2, 01, 016.

E.Refund of interest amount applied to us.
68, 065.

F.Building maintenance from April 2023 to till date July 2023 (4 months).
4X3, 440=13, 761.

G.Common area maintenance from April 2023 to till date July 2023 (4 months).
4X4, 281=17, 124.

Total=5, 63, 120. (Refund from Runwal).
