[Resolved]  Spice Mobiles — NEW, but defective mobile instrument (need refund or replacement)

10 Jan 2015 Respected Sir / madam, Subject: complaint about the new spice mobile I am Dr. C. Dsouza, an advocate in the High Court of Karnataka, (Bengaluru) Bangalore. I have been using for many years, spice mobiles. However, the last one which I bought from you spice centre, is simply defective to such an extent that prima facie it manifests itself as a manufacture defect or a defective product. The product: Spice stellar, 362 (Black) IMEI no. [protected] (too small a font to decipher, as it is printed on the box) Purchased at: Spice Retail Ltd, 13 MTHF Extension, 80 ft road, RT Nagar, Bangalore At the instance of purchase: INVOICE / Customer id generated:[protected] Name given: C Dsouza (for the bill / invoice) My mobile no. entered for the bill:[protected] Date of purchase: 22 Dec 2014, for the valid consideration. NATURE OF THE DEFECT as IDENTIFIED BY ME: 1) Even after charging the unit completely, the mobile does not get on, after 30 – 40 attempts, and with the power charge still connected, it comes on. 2) After such a desperate switching on, the mobile during use or conversation – goes of, without any indication and again we will have to attempt 30 – 40 times to switch on. The instrument has not been put to use even for one hour Within 2 days, I complained to your customer care, I have lodged a complaint to your toll free number: and the reference is[protected] Owing to continuous holidays, I have submitted the instrument with all its contents to the R. C Service Point, (Authorised service centre for Spice), Narayana Shastri Road, Mysore – 570 024, on 26 Dec. 2014. The service work order number: 739. Till date, from my part, with repeated phone calls, multiple visits I have NOT got any solution. The last oral communication is on 10 January 2015, that the instrument will be sent to the company, and I will have to wait indefinitely or at least ten working day. The service centre also takes care of another brand mobile phones, hence I have serious reservations as to the quality of service offered to me and to spice customers. Owing to the all the reasons mentioned above: I seek the following: 1) full refund of money OR 2) another new mobile phone instead OR 3) within 15 days the rectified mobile phone, with extended warranty by making good all the days taken by the service centre and an acknowledgment & reply to this letter, and all other remedies I am entitled to. Hope good sense will prevail and you would attend to it at the earliest. In any case, I reserve my other rights, Thanking you, Sincerely, Sd/. Dr. C. DSouza
