Spice Mobiles — Refund/ handset not working from the beginning

I was purchased the spice handset namely Spice smart pulse M-9010-Mobile for sum of Rs. 3, 999/- 12.07.2014 but same was not working from the very beginning. i was again again contacted to the customer care centre of the spice but till date my complaint was not resolve and phone was with me isn sealed pack condition. Kindly refund my entire amount or issued me credit note.. please do the needful.
