I am an NRI. I had paid to the building back in 2013 booking amount for commercial unit and the builder failed to deliver the unit in time so I requested the builder to refund the amount and after a year of follow up I got my refund in May 2016, by way of local cheque without interest which I deposited with my NRO account with Standard Chatered Bank on Friday and I kept following up on Monday, Tuesday and on which bank replied me that 3 working days I need to wait and on wednesday I called and they told me that they need the cancellation letter from the builder, as the cheque itself and my declaration is not sufficient for them. Subsequently I requested to the builder begging for the cancellation letter, which was provided by the builder, which I gave to the standard Chartered bank. Subsequently bank asked me to show the entry from my which account this amount was paid me to the builder. I said it is a matter of 3 years back and I do not remember from which account it is gone also I did not find it necessary to keep my three years old account statement. So the bank is threatening that if I don't show them the entries in the bank statement, they will reject the cheque. However they already wasted my one week of time and further I have an overdraft with the standard chartered bank on which I am charged interest on daily basis and need to settle the overdraft. The bank has been ignoring the valid negotitable instrument i.e. the cheque, my declaration, copy of the cancellation letter of my units with details of the unit and amount, my confirmation and so on. Everyday they are coming up with new requirement and making it tough to clear the amount to my account and to clear the overdraft.

Hello Sir,
It is really a serious issue that you are facing. In such you should consult a good consumer lawyer in your town who can help you in the said situation. The lawyer will send a legal notice to the bank and after sending notice there is the time period in which the bank has to reply to the notice. If the bank does not replies or neglect the notice then you can file a case in consumer court and solve your case.
