On feb, 24 2017, pratik kulkarni, sales person from sterling holidays offers us trial member ship valid for 1.5 years and which can be further extended by 1.5 years having offers of 12 nights domestic free at sterling resorts in india and 1 week international free at rci and rs 7000 cash back to our bank account for payment of rs 106000, if we pay immediately and if we take it in name of my wife, for which we paid by our debit card. After our trial period of 3 years, after experiencing holidays at there resort if we are satisfied we would have option to take there 25 years membership cost of which would be rs 5, and rs 106000 we paid would be considered as down payment. We also asked him about annual subscription fee, for which he clarified that it would be only applicable if we take there 25 years membership after trial period. He asked us to give cancelled cheque and rs 100 rupees cheque as for cash back of rs 7000, this cancelled cheque and rs 100 rupees cheques was needed so that online payment can be made to our bank account of rs7000. All this offers were given orally and explained on white paper.
Instead we received email from sterling after 2 months stating we have taken there membership of 25 years for rs 5 lac for which down payment is paid rs106000. On april 25 we received member ship kit stating we have taken membership of 25 years cost of which is rs 5 lac and downpayment is rs 106000. Balance 12 emi of rs 31534 asf of 11659, asf due feb 2017. Special offers of 2 nights venue complimentary and 2 nights terling bonus nights.
We were shocked and asked them to offer us what was committed at time of taking payment.
They have even approached our bank on 26.5.2017 with a mandate to debit rs 18169 monthly installment for debit in march 2018. I called pratik what is all going on, we kept on replying please book you holidays and he will do all that he as commitmed. I ask him to stop approching bank as this is not he commited.
What pratik commited and what membership kit states was totally different.
I called and emailed there chennai office, manavalan from chennai office asked us to give what was committed by pratik, i send all forms and papers pratik gave while explaining about membership, after which manavalan agree to giv 8 sterling bonus nights and rs 7000 cash back if we agreed to taking 25 years membership. Infact we were offered trial membership of 3 years for rs 106000 which was offered by pratik.
We asked them to refund our rs 106000 if there did not have trial membership of 3 years which was offered to us by pratik. We have not used any of there holidays but manavalan keeps asking for valid proof of commitment. And refusing to refund rs 106000.
How can i give the proof of oral commitments given by them? Proof may only be possible if they have recorded the presentation of the scheme given to us. I have not recorded the meeting presentation. I was agreed for membership on presentation given to us by them.
How can i prove the oral commitment given in the meeting? We have to put faith for the presentation given by the executive. I have not recorded the presentation. You should record it like you are now recording our telecommunication.
We have been calling pratik and there company in chennai. Chennai office says now you cannot get refund as you have taken membership. They are forcing membership on us and misleading in name of thomas cook and fairfax company.

Since i have not used any of there holidays or facilities, i request for refund of rs 106000 for not offering what was committed at time to taking payment. I have been calling, sending email since last 4 months to refund rs 106000, for which manavalan is refusing to refund giving excuse of valid proof of commitments. Sales person of sterling are not giving any documents in writing of offers at time of taking payments.

Please refund my rs 106000. Hope you will do needful for resolving all my above issues & continue to keep our trust in sterling holidays permanently.
