Tata Motors — COMPLAINT - Damaged Vehicle by Dealer (M/s Arya Tata, Gurgaon)

Sir/Madam,

Introducing, I am a Central Government Employee, who, after having saved from his hard-earned money, decided to go for only a TATA’s car, an Indian Brand.

2 However, I had a harrowing experience of buying Tata Nexon XM White through the tie-up of Ackodrive.com and the TATA Motors Dealer (M/s Arya Tata, Gurgaon), which I would like to bring in the knowledge of all concerned.

3 I had booked Tata Nexon XM White on ackodrive.com at an on-road price of Rs. 9, 05, 484/- with free home delivery of the vehicle at my residence in Faridabad. The booking was allotted to M/s Arya Tata, Gurgaon (Dealer of Tata Motors).

4 I intimated the Dealer at several occasions that I would visit on 09.01.2022 (Sunday) for further formalities and the balance payment. I also confirmed with ackodrive.com on 06.01.2022, 08.01.2022 and in the morning of 09.01.2022 for providing the driver on 09.01.2022 for free home delivery. On assurance, my aged parents and I visited the Dealer (Gurgaon) on 09.01.2022.

5 After completing the formalities, when I asked for the free delivery, the Dealer demanded another Rs.1, 000/- for the driver. Consequently, I had to approach ackodrive.com, which, however, arranged a driver through the Dealer without any extra cost.

6 We left the Dealer with its Driver at the Steering Wheel of my vehicle. Excited about the purchase of my first car, I started recording (video) of our journey from the Dealer (Gurgaon) to my residence (Faridabad) as a memory.

7 However, it was found that, the Driver was not driving properly, like he would speed up at red light, apply brake suddenly, drive dangerously close to the divider, drive in wrong gear etc. By the time I realized that he was not a good driver, we were already out of Gurgaon on the Aravalli Road, which is a deserted stretch. At that point of time, I had no option but to continue with the same driver. So, I requested the driver to drive safely.

8 When we reached Bata Chowk (Faridabad), the driver, instead of lowering the speed or applying the brakes at an intersection (T-point), accelerated and hit a passenger auto (3-wheeler). It may not be out of context to mention that, I had noticed the oncoming auto and even warned the driver but he didn’t care and chose to ignore my warning.

9 This harrowing and heart-breaking incident also got caught on the video, which evidences the fault on part of the driver. The speed of the vehicle was around 35kmph, where any sensible person would slow down and furthermore, the Driver chose to ignore my warning. This mishap could be averted had the Driver been careful and attentive.

10 Afterwards, instead of taking any responsibility or be apologetic, the Driver started misbehaving. Resultantly, I called the Dealer (the salesperson and his team-member, i.e. Shri Hitesh Katyal and Shri Rahul Punj) but they both did not take my call.

11 In the following days, I also raised the matter with the Senior Management of the Dealer, Ms Bushra Khan, ACRM who reverted through Ms Dupinder Kaur, CXM but to no avail.

12 One ought to acknowledge that, I had paid in full for a brand new Tata Nexon XM White to be delivered at my residence, whereas, I received a damaged one. It is disheartening and appalling that those, who were responsible to deliver the vehicle safely at my residence, have delivered a damaged vehicle.

This overall experience has caused me and my family immense discomfort, stress, mental trauma and harassment, which cannot be compensated by any means.

Therefore, your intervention is requested in the matter to ensure that I get exactly what I have paid for, i.e. a brand new Tata Nexon XM White.
