Tata Motors — Tata Motors Refund of booking amount not given for Tata Tiago

I had visited TATA showroom (Malayalam Vehicles India Pvt Ltd, ALUVA, Kerala) to enquire about TATA TIAGO. Although it was my initial visit, the executive Mr. Kirandas insisted me to book the vehicle at Rs. 1, 000. When I asked him about the cancellation charges mentioned in the Commitment Form (Number: 4948 - attaching the copy), he assured that the amount will be completely refunded if I change my plans. Since he provided this assurance, I paid the amount .

After few days, I decided to purchase Maruti Wagon R and asked Kirandas to cancel my booking. He asked me to send a signed request in white paper indicating my account details so that the amount will be refunded. I did so (Attached copy)

When I followed up with him, he told the amount will not be credited directly to bank account, instead a cheque will be given to me. I have records of our communication in WhatsApp and Voice call.

Since then I am having constant follow up with him and he now tells the amount will cannot be given back since it will be considered as Cancellation charges. This is completely against what he had assured in the beginning.

I want to proceed legally in this regard. Kindly let me know your views.
