[Resolved]  Tata Sky — unfair means

Subject: tata sky indulging in unfair means to exploit customers interest.

Dear sir/madam,

The complainant, mahesh parmar, having subscription id [protected], and registered phone number [protected], has been harassed by the customer service providers of the tata sky dth service company (Herein after called as “said company”) by exploiting his interest in the company’s subscription service through different unfair means, and upon registering complaint to the help line numbers said company is not at all interested in solving the issue and are least bothered to do so, instead they use to inform the complainant through text message “dear subscriber, your request number ‘1fo37y73’ is resolved” before actually resolving it. And with that complainant has faced other problems after subscribing tata sky, but company has never bothered to solve complainant’s problems with the same or complaints registered. Thus, with the same purpose to solve issues, complainant hereby wants to inform and solve the below mentioned complaints complainant has.
1) complainant has subscribed services of the said company long ago and have used it regularly, but this raised an issue with regard to billing of subscription amount complainant used to pay on monthly basis. The said company has never ever provided any bill, instead they are sending statement of the service complainant has subscribed to. Complainant believes that this is misappropriation of funds or an escape route to the tax department of india. Complainant came to know when he requested a bill on updating of setup box and they refused to do so and asked him to make top up of the said amount of rs.900 which complainant was needed to pay for the update to be installed. And with that they have not issued any bill for the same. Would like to direct the tax authority to see into this matter and request the said company to provide bill in print or in digital form.
2) another issues complainant has faced before updating the set up box was that suddenly his last setup box started malfunctioning and showed the issues of weak signals for weeks of which he complained to the authority and few technician came to solve the matters but instead of solving they directly suggested to make an update to hd setup box of which he had no need to, as he never subscribed nor wanted subscribe to the hd channels, but they forcefully tried to convince and installed hd setup box to extort more money. The said company has intentionally interfered with the non-hd setup box so that he has to buy a new hd setup box of the said company. Thus, hereby i request the concerned authority to analyze the matter and solve it in favor of customers, as many other customers might have been harassed or cheated with the same issues by the said company.
3) after updating the setup box, complainant was encountered with another issue of change in subscription, which was made without complainant’s permission and no information was given to him on the same, said company has never called him to discuss such matter of change in subscription. Prior to the change complainant was making a monthly payment of rs.256 and after updating the setup box the said company has changed the subscription which made him to pay rs. 251 on monthly basis. With same complainant also want to inform that his old subscription was ending on the 19th day of april 2019, where they forced him to make an update to hd setup box on 13th day of april 2019, after installing the new setup box it worked till midnight of 14th april and it stopped from then as the screen showed the message of need to pay subscription amount for further viewing experience. There, said company didn’t stop manipulating and harassing him, instead screen showed negative balance of rs. - 46 without any reasons on 15th of april, thus, complainant allege that the same company has intentionally ended the subscription on the midnight of 14th april 2019 which is 5 days prior to the expected date (19th april 2019) of ending subscription and which compelled me to make another payment of rs 251 on 15th of april 2019, for the further viewing experience. Which out rightly changed the subscription cycle he opted to follow, and after making recharge of rs 251 it allowed complainant to use its subscription service till the 8th may 2019. Which again lead to misappropriation of the payment made, as complainant paid rs 251 for a monthly service, which comes to rs. 8.36/day, which shows that where the subscription plan was ending on 15th of may after updating to the hd box has been preponed to the 8th of may without any prior permission to make any changes. Thus, with the same complainant is going to lose rs 58.56 and total 7 days of subscription from 8th may 2019 to 15th of may 2019.
Further, complainant has clearly explained this matter to the customer care helpline number where he talked with ms. Naina, who told him to wait for the call of senior executive and registered his complaint with number 1fo37y73 on 25th april 2019 and assured that executive will call him or legal advisor on 28th april 2019 at 2:41 pm. But the said company was not bothered to solve the issue so instead of calling they sent a message on 26th of april 2019 which showed “dear subscriber, your request number 1fo37y73 is resolved, happy viewing”. And with that no complaints were solved, nor they called to listen the problems complainant has faced with fund embezzlement or misappropriation.
Thus, with this complaint i request the concerned department to look into the same and kindly solve these issues complainant is facing with the said company.
4) and the last issue which again leads to misleading information shared to the customers to buy the universal remote with the setup box, which they tell that it will work with both your television and with your new setup box. Complainant bought that and it didn’t work with his television and after buying same they told him that it might not work with few televisions. This also leads to mislead the customers on buying a product and which unlawful activity carried out by the personnel of the said company. So, with this complaint i would like to inform this to the concerned department to look upon the same.

Thus, with above mentioned list of issues and complaints, the complainant prays for
1) to solve above mentioned issues/ complaints as soon as possible and request you to extend the next subscription date to the 19th of may 2019
2) consider reimbursing the amount in the sum of rs.104.56 (Rs 46 + rs 58.56) which was misappropriated by the said company from complainant’s subscription account.
3) special damages in the sum of rs. 10, 000 for the mental harassment and agony complainant has suffered
4) reasonable legal advisor’s fee in the sum of rs 7000.
5) such other and further relief as the authority shall deem fit.
