Uber India — about a driver

I've lost my phone when I was travelling from maruti suzuki ertiga with the driver saikul. I contacted the driver but he totally refused and I definitely know that he has my phone because it was still ringing. He was also so damn rude with me. He was saying that I've ruined his morning and I could do anything about it and he just didn't care enough about the situation

I placed order of food on 07 Jun at 04:00 pm and till 6:30 i worked in same location but uber eats doesnt delivered and their executive fails to reach destination before 6:30 pm so i left the office after working hour and now the charged me whole price of food as penalty.
I have escalated issue with customer care but didnt get resolution.
Fare excess charged against the fare shown at the time of booking of trip on 26 july 2019 registered mobile no. [protected] and registered email [protected]@gmail.com. refund requested.
