Vatika Group — booking amount for delayed project turning point in sector 88b gurugram not being refunded

With great pain I want to submit that we were trapped in booking of a 3 BHK flat with an amount of Rs 10, 04, 895/- (Rs Ten Lakhs Four Thousand Eight Hundred Ninety Five) in Vatika Turning point project in sector 88 B, Gurugram, Haryana by Vatika Group on 30 Nov 16 with false promises and commitments. (Copy of receipts and booking letter enclosed).
3. Unfortunately neither the Vatika Turning point could get up from the drawing stage since last 15 months nor was the VATIKA SHIELD given shape as per initial commitments at the time of booking. The safety shield which was supposed to be given at the time of booking was hidden and was extracted only after a prolong tussle with the staff to get a shock of Vatika levying all surcharge, taxes and misc charges etc on the customer, who would lose out his booking capital.
4. We have written numerous emails since Apr 17, interacted with Vatika representatives, called on phone, met with Mr Gaurav Bhalla, director Vatika Group in second week of Nov 17 and written three personnel letters to the Mr Anil Bhalla, the Chairman and whole time director but have not got any positive response from their side.
5. We were actually trapped in the scheme by two false promises of the Vatika, firstly that the project shall commence in Apr 17 and provision of VATIKA SHIELD assuring complete safety and zero risk of capital erosion even if customer decides to exit from the project after six months of booking up to three years. 5. Due to non-response of Vatika on withdrawal requests through email since Apr 17, we also had to fulfill our personnel obligations in last 15 months and have taken various Loans to include a 3 BHK house in sect 83 Gurugarm, which now negate us of any additional loan for the Vatika turning point project under subvention scheme within my drawing capabilities.
6. In view of the inordinate delay in launch of the project, broken promises and incorrect commitments of safety shield, to REFUND OUR BOOKING AMOUNT OF RS 10, 04, 895/- as per Haryana RERA norms no PART V Para 15 section 12.
