Respected Sir,
I refer to my earlier communications with Xiaomi India Grievance Desk, including your reply [dated …], wherein you declined to refund the excess amount charged by your authorized outlet, Amar Communication Pvt. Ltd. (MI Store, V3S Mall, Laxmi Nagar, Delhi-92). I hereby place you on formal notice of the legal consequences of your failure to act, and demand immediate redress as per law.
Facts (restated with emphasis):
On 10 September 2025, I purchased a Xiaomi 14 CIVI (Cruise Blue) from the authorized MI Store (V3S Mall, Laxmi Nagar) for ₹36, 999 (Invoice No. MH[protected], Serial No. 56729/X4TT00020).
The very next day, the exact same model, same color, same configuration was listed on Amazon India (official portal) for ₹28, 999, as a brand-new unit with full warranty.
The dealer’s sales staff (Mr. Kishan and Mr. Garvit) falsely claimed that Amazon sells “refurbished” or used items and that the phone was “not available online”. Both statements were misrepresentations, as the phone was available brand new on Amazon at a lower price.
Due to this misrepresentation and concealment, I was induced to pay ₹8, 000 extra — which is more than 30% profit margin above the prevailing online market price.
The excess amount is not trivial — it represents deliberate exploitation of a consumer, amounting to cheating, misrepresentation, and unfair trade practice.
Legal Grounds:
Consumer Protection Act, 2019
Defines “unfair trade practice” to include misleading representation of goods and deliberate concealment of material facts. By hiding the true availability and price of the phone online, your dealer misled me into paying an inflated amount.
Central Consumer Protection Authority (CCPA)
Has power to act against such misleading and unfair trade practices, including cases where retailers exploit brand reputation to charge excessive margins.
These show that Consumer Courts recognize overcharging / concealment of true market price as unfair trade practice, and order refund plus compensation for harassment.
My Demand:
Refund of ₹8, 000 – excess amount charged.
Written apology acknowledging misrepresentation and unfair conduct.
Legal Consequences if Demand Not Met:
If Xiaomi India fails to act, I will:
File a formal complaint with the District Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, seeking refund, compensation for harassment, and litigation costs.
Approach the Central Consumer Protection Authority (CCPA) for regulatory action.
Escalate to the Competition Commission of India (CCI) if the conduct indicates systemic unfair trade practice.
Seek exemplary damages for erosion of trust in the MI brand, which has already been severely damaged among my family and peers.
Conclusion:
I trusted Xiaomi’s authorized store, believing I was getting a fair deal. Instead, I was misled into paying over 30% more than the prevailing market price, which is outright exploitation of a loyal customer. This amounts to cheating, misrepresentation, and unfair trade practice.
I demand immediate refund of the ₹8, 000 excess amount, failing which I will be constrained to pursue all legal remedies without further notice.
