[Resolved]  Axis Bank — *****Harassment & Threat by Recovery Agents****

I am writing in with regards to the harrasment and mental trauma me and my entire family is going through from Axis bank and it's associates.

A person named Manjunath. C from Aricent Business Solution walked into my house regarding my outstanding loan #PPR[protected] on the 15/06/2021 asking me to make an immediate payment right away. I did explain him my situation and the reason for me to default on the account however the representative called his manager named Shankar . I did agree to speak and for my shock the manager threatened and made me sign a settlement letter right away and asked to make a payment by the 22/06 in the amount of 2, 50000 rs . I never agreed to this intentionally and I was forced to sign this letter even after explaining my entire circumstances.

I m not a wilful defaulter and I ve tried everything possible even beyond my limits to settle every loan I have with Axis . I lost my job in March 2020 and did not have a job until March 15th 2021. I ve suffered losses in my business. I have also surrendered my car to settle the loan with Axis . Unfortunately as I could not arrange the money on the 22/06, I was abused over the phone by Shankar and Manjunath along with another person named Suresh (not sure with this name ) came to my home on the 23/06 at 8:00 am and started shouting deafeningly asking me to make a payment immediately on the same day.

I have always agreed to make a payment and clear the loan as soon as my finance starts flowing however the person continued to harass and threat me in front of my home and said they won't move from the house until the payment is settled . I ve a 65 year old mother at home and I was getting ready to report to work. Without having any other choice I agreed to make a payment by the 28th of June. I again tried every possible way to arrange the money and I could not.

On the 28th of June, Manjunath again visits my place for a follow up on the payment at 8:00 am . I was leaving to work and tried explaining yet again but he refused to listen and said he will stand in front of my gate till the payment is cleared today. After me leaving to work the person walks into my house in the afternoon even after knowing I m not at home and asks my brother at home to call me on my phone with a clear attempt of character assassination. I have also been called about 10 times in a span of 4 hours even after knowing I am at work. I understand I owe the bank money and I am trying to do everything possible to settle this loan but harassing and character assassinating your customers is unlawful.

Banks are supposed to communicate when they initiate recovery proceedings and also provide borrowers with the name of the recovery agency or the agent who will handle the case. But in this case Manjunath & Suresh visits my place unannounced at 8 in the morning and he does not even have the Id card when he visited on the 15th of June.

The recovery agent must carry an authorization letter from the bank for the meeting and this person did not even have the Id card. He also refuses to give his managers number.

I completely understand that I m responsible to payback the money that I have taken. Like I previously mentioned my circumstance is worse and I m just surviving, I don't even have anything to pledge. My earnings used to be about 1 lac 3 years back and it's dropped to 20000 Rs now . I do have opportunity to earn incentives but due to Covid people are scared to invest so all I m requesting you is sometime till the situation gets better. I ve ensured 4 loans of mine is settled with your bank and I will surely settle this.

RBI clearly states that you cannot harass the customer at any point and the way these people have behaved in the last 15 days has been put me and my entire family in a trauma during this covid situation.

Again on the 29th June 3 people claiming themselves to be employees of Axis Bank came at 8 am and started to shout by abusing me asking for a payment of 250000/- to be cleared immediately. I explained my current situation where I still have not received salary my company and explained about the effort I put in to try and arrange the money. Still not willing to listen all 3 started harassing me in front on my gate. My brother who was watching this started making a video . Seeing this the agent got agitated and started shouting at my brother. I called the police but like it happens in movies the police took their own time to come to the scene. After all this a 4th person arrives claiming to be the collection manager and settles the situation and agreed to negotiate the payment terms. These people do not care for anyone and are ruthless.

Also, I have attached the copy of the ID card issued to Manjunath by Axis .It has a date of 16/06 and the person visited my place on the 15/06 without the ID card and harassing me.
