Bajaj Finance — Fraudulent recovery mechanism by the RBI registered NBFC Company

Sir/Madam,
I am maintaining five loan accounts vide Loan account nos. _4030CD29374154, 4030CD29374168, 4030CD30100560, 403SOL08089542 & 403SOL14340236 with Bajaj Finance Limited. I am paying all my dues for all the loan account through Equated Monthly Installments (EMI) via ECS mode on 2nd day of every month regularly through HDFC bank. Recently due to unforeseen technical issue with my personal bank account the due amount for the month of May of Rs.35, 723.00 for all my loan accounts has not been maintained. Due to which the ECS has been rejected for insufficient funds. But I have made available the required funds for ECS clearance on 5th May, 2017. Further I have escalated the issue with the Bajaj Finance Customer care executive on the same day. During my call I have explained the situation and also informed about the availability of funds for ECS clearance and I was also told that the company will definitely make 2nd attempt to clear the ECS amount from my account. Even after number of follow ups with customer care executive, the amount was not taken for ECS clearance.

On 11th May 2017 I have received a call from Bajaj Collection agent (Mr. Anish - [protected]) asking for default of loan amount for my loan accounts and I have also instructed to issue cheque for the due amount of respective loan accounts. Upon which I have issued a Cheque vide no. 000023 dated 11/05/2017 for an amount of Rs. 7833/- favoring Bajaj Finance Limited for my Loan A/c Nos.. ( 4030CD29374154, , 4030CD29374168, 4030CD30100560 = 1667+3083+3083). The same has been debited from my account on HDFC bank (statement attached herewith for your consideration). Proof of collection of cheque also attached herewith. The same cheque has been cleared and debited on 15/05/2017. (proof attached herewith).

On 13/05/2017 I have also issued a cheque vide no. 000024 dated 13/05/2017 for an amount of Rs.27890/- favoring Bajaj Finance Limited for my Loan A/c Nos. ( 403SOL08089542 & 403SOL14340236= 21302+6588) where I have been maintaining the sufficient balance for the cheque clearance.

On 17/05/2017, the office has debited my bank account of Rs. 3083/- for the loan account number. Since because of this duel debit to my account, the Cheque no. 000024 issued on for the above mentioned loan has been rejected due to insufficient funds and my bank has debited charges of Rs. 402.50/- for the same as eCS return charges. Since because of this my reputation gets spoiled with my banker.

Recently I have undergone a surgery and I am under medication and bed rest now. Since because of their wrong debit of amount and fraudulent practices of recovering loan many of their executives and collection agents calling me every day and asking me pay the amount which they have debited to compensate their mischievous mistake. Because of this I am getting pressured and tortured and my health is getting affected day by day.

Here I am praying the Honourable authority to get me a right and compensation for the defamation, depression and stress due to them and their fraudulent recovery mechanism.
