above at attachment "Interest SD" and "Interest SD 2" for appreciation
of the issue involved for which your kind intervention, suitable judgment &
early orders solicited in terms of regulation act.


Kindly
see the recommendations cum opinion of the different persons of the society
viz: subham sen, bchhanda, nachiketa banerjee, binapanidevi & swapan ghosh
at attachment “Interest SD” in connection with refund of security deposit
deducted / held by BSNL Company wrongly / illegally with out any authority.
Such refund should be made with due interest accrued there upon @ prevailing
bank rate of interest & the interest payable should be realized from the
guilty official in pursuance with directive communicated by J&K State
Consumer Disputes Redressal Commission, Jammu headed by Hon’ble Mr. Justice
(Retd.) G. D Sharma and B.L Saraf, Member on[protected] copy placed at
“Interest SD 2’ so that the trend of sending wrong bill and directing customer
to go to the court for correction may be tuned down & arrested.

CAO /TR / Alipore vide mail dated[protected] at attachment Interest SD 2


TRAI is requested to examine the various noting made by
CGM / CTD dated[protected],[protected] &[protected]. It will be clear from CMG / CTD note that they did not find &
examine their own record to verify the factual position & claims made.
Further it will be interesting to find that both CAO & CGM are puzzled /
confused to take decision as what to do with return of BB SD of Modem. Further it is surprising to find all the
notes made so far in connection with the instant issue are self contradictory
& confusing to each other notes. However it is to mention that Teracom Modem
Type I supplied to the undersigned was dealt with by CGM exclusively vide
letter of TS to CGM mail letter dated[protected]See attachment “TS to CGM
5.8.2009”) and under para ‘f’ of the letter it was directed ‘f) One free
broadband modem (type-1) is granted as a very special case of humanitarian
issue. This will be effective from August’09.”

In view of the administrative directive
of CGM the BB Modem Type I supplied to me become free from August;2009 on
Humanitarian consideration as a special case. Bill for August’2007 for the
period[protected] to[protected] SECURITY
DEPOSIT BB MODEM = Rs. 500/- but modem
in question become free from Aug’2009, hence holding of SD for a free item of
supply treated as redundant deposited / as no SD can be held by any authority
for a goods supplied on free of cost / rent, & needs be returned on August’2009. TRAI i.e. competent
authority in terms of organization operational orders requested to examine the
issue on logical as well as legal point of view and pass suitable orders to
return BB SD with due
accrued interest there on at the earliest.


TRAI is requested to kindly see para 4
of my letter to Sri.K.C.Ghosh, Sr.GM / South/ BSNL dated[protected] sent as an
accompaniment to CMD’s mail to U/s dated[protected] placed at attachment
“Interest SD 2” . Monthly charges for Cable Internet UL of BCTN / Bongaon was
indicated as Rs.509/-. Happy to inform
that rate have been reduced to Rs.500/- per month.


However TRAI is requested to
kindly issue their orders on the issues placed before them at the earliest
possible & oblige.


CGM / CTD is yet to response to my mail
dated[protected]. Suitable reply
will be sent as soon as a response is received. U/s will be out of HQ for 2 months on
domestic reasons but will always e available on line.

Dear Sir,
It is for your kind information that following BSNL charges against Security
Deposit are for BB Customers :

1) BB Plan security Deposit – It is equal to One Month BB
Rental charge
2) BB Modem Security Deposit – Rs 500/- ( Refundable ) is
taken from the customer to whom BSNL provides modem on rental basis .

In your case, as per your letter attached to e-mail received from CMD BSNL
dated[protected]
BSNL granted one free
modem (Type-I) as a very special case i.e. no rent will be taken from you
for Type-I modem till this approval continues.
Your complaint is for Rs 500/- charged as “One Time Charge” in the bill dated[protected] . CAO/TR/ALP has already
clarified in his mail dated[protected]
that this is due to BB Modem Security Charge which is refundable .
BSNL has waived only rent for Type-I Modem, but not the Modem Security Deposit
amount Hence, it is payable by you & will be refundable after surrender of
the BB Plan.
Moreover, it is learnt
from your bill details that Type-II Modem is working against T/F no
[protected] in your residence . Rent for Type-II Modem is payable .
In such circumstances you are requested to contact with CAO/TR/ALP for
settlement of the same .

In this context it
can be said that proposal made by Sri.Subham Sen dated 27.03.2014 &
Sri. Nachiketa Banerjee, dated 28.03.2014 lying with your office may kindly be
connected and necessary orders be issued treating this as MOST URGENT. It is however
not understood as to why a consumer has to suffer financially every time for
erroneously / wrong bill by BSNL Company and TRAI remain silent.

It is usually seen that
Bharat Sanchar Nigam Limited Company used to charges “Late payment of bill”
though payment made in time, charges an amount towards SD, subsequently found
SD in question already paid / not required, charges made for a specific item against
supply of a lower quality etc but refunded at a later date without paying any
interest thereon for holding money unnecessarily / unreasonable period with
BSNL Company. BSNL Company used to charge late fee even on the schedule date of
payment (in case payment is not made within 10.00 hrs). As such for holding /
blocking of money for unnecessary / unreasonable reasons why BSNL Company will
not refund payment adding prevailing bank interest rates. Telephone Regulatory
Authority of India is requested to issue
necessary orders in this respect immediately for adding interest. Intentional,
Careless, Nonsense type of billing may be stopped in case it is proved that
wrong billing has been made the amount involved be deducted from concerned
official at fault. It should not be expected that every time customer has to
bear cost of careless billing. Suitable orders solicited immediately.

Kindly please check up the bill in question once again as it appears some
mistake exists in the bill. The bill in question has been paid on 26.11.2013
under protest vide this letter which may kindly be noted. It is noticed
that BB UL 750/- is now being charged as 800/- & thereby increase may be
within Rs.60/- but should not be 100/- . Retired Government employees were
allowed 20% rebate on BB connections provided to them (Copy at attachment). I
case any change is made kindly let me know the authority issued orders duly
quoting reference number etc for perusal & further necessary action.

4. I
have Cable Operated Broad Band U.L similar services at my home town
Bongaon but it is interesting to note that monthly charges are only Rs. 509/-
(inclusive of all taxes) < in comparison to very high charges by
BSNL. Thus none at Bongaon interested to have very costly (+) BB / BSNL connection. I was having
a list of 138 friends & relatives having BSNL telephone connections over
the years but this time I found that only 16 / 17 out of 138 retained BSNL
connection, others left due to some reason or other which I do not like to
pen here . This is however a very poor & unhappy situation prevailing for
BSNL organization. It is however mentioned that the organization still running
smoothly only because it has very few well experienced, efficient and good
administrative officers.

CAO
/ Alipore is requested to kindly refer to para 3 above & do needful at
the earliest and send revised bill to my address noted below. All relevant papers in this regard and copy of tenant
deed, certificate by the Councilor, KMC Ward 115, Banks statement including
present address etc have been sent to your office for record & necessary
action. As regards para No. 4 higher administrator’s kind attention are being
invited to find out reasonable solutions as well as competitive betterment
plans in the interest organization / valued customers. Thanking you all

from delinquent officers

Jammu, April 22: The J&K State Consumer Disputes Redressal
Commission, Jammu headed by
Hon’ble Mr. Justice (Retd.) G. D Sharma and B.L Saraf, Member on
[protected] has given a very significant judgment against BSNL
Department and has given a direction to the administration of the
department to recover the awarded amount in the sum of Rs. 20, 000/-
by way of compensation and Rs. 10, 000/- as litigation charges finally
from the personal dues in the form of pay, pension and other service
benefits of the delinquent officers who had failed to settle the
genuine claim of the complainant for years together and carried on
the unfair trade and practice by sending him inflated and fake telephone
bills. The amount of the so called inflated and fake bills was in the
sum of Rs. 13663/- but the Commission has disallowed the payment of
the above stated false amount except the rent charges of initial two
bills for the months of 01-03-98 and 01-05-98.
The complainant who is a senior citizen and retired conservator of
forests was the aggrieved complainant in this case for the issuance
of fake and inflated bills regarding the Evacuee Property House which
he had abandoned as his residence and it was lying vacant. On his
written request to disconnect the telephone, five years’ bills for
rent and call charges were issued against him. On his last request to
disconnect the telephone which was addressed to the General Manager,
Telecom, Jammu on 03-10-98, it took 4
months to disconnect the telephone and a bill was also issued for
that period.

Dear Sir,
It is for your kind information that following BSNL charges against Security
Deposit are for BB Customers :

1) BB Plan security Deposit – It is equal to One Month BB
Rental charge
2) BB Modem Security Deposit – Rs 500/- ( Refundable ) is
taken from the customer to whom BSNL provides modem on rental basis .

In your case, as per your letter attached to e-mail received from CMD BSNL
dated[protected]
BSNL granted one free modem (Type-I) as a very special case i.e. no rent
will be taken from you for Type-I modem till this approval continues.
Your complaint is for Rs 500/- charged as “One Time Charge” in the bill dated[protected] . CAO/TR/ALP has already
clarified in his mail dated[protected]
that this is due to BB Modem Security Charge which is refundable .
BSNL has waived only rent for Type-I Modem, but not the Modem Security Deposit
amount Hence, it is payable by you & will be refundable after surrender of
the BB Plan.
Moreover, it is learnt
from your bill details that Type-II Modem is working against T/F no
[protected] in your residence . Rent for Type-II Modem is payable .
In such circumstances you are requested to contact with CAO/TR/ALP for
settlement of the same .

a) 5 (five) adjustments

I have been
directed to refer to T.S's letter quoted above and convey comments as follows
for your kind information and further necessary actions:-


Para (a). Since this
is a reproduction of internal letter of DET to HQ- CGM and rectification of
mistakes by BSNL itself no comments. No action seems to be taken with regard to
refund allowed towards wrong excess realization for Modem Type-1 as pointed out
vide 6th Status Report sent to CDM/BSNL on 25.0409, copy to CGM. Detail
calculations mentioning periods, relevant rules mentioning Act etc, refund of
service tax element and penalty for late refund of excess realized amount to be
clearly indicated for verification, acceptance for clearance of the case.
Present status of the case- Outstanding.


Para (b).
Application was made to provide "Plan UL750 (Reduced to 500)" which BSNL accepted on[protected]
and as such status o[censored]ser stands on[protected] was "Plan UL750 (Reduced to 500)"
and not Plan UL750 as indicated by you. BSNL's
interpretation is not acceptable. Probably this interpretation is made to get
an extra amount of Rs. 250 as security deposit erroneously billed for. However
since the bill has been paid in due time the issue sands closed duly recorded.


Para ©. Matter of
records. Up to Feb'09 bill it was O.K, .A.O / III / Alp's letter dated 13-04-09 remains uncomplied. Post manufactured reasons for discontinuance
of 20% discount is treated as a deliberate withdrawal of a benefit allowed,
virtually an official impropriety as
well as differential treatment to a PWD. Withdrawal of 20% discount is however
objected hence case not closed.


Para (d). Security
Deposit of Rs.750/- demanded since paid, case dropped. Justifications for
payment of Rs.750/- as one month Plan charges do not stand as explained vide Para-(b) above and hence
treated as arbitratory and not acceptable.

Para should be (e).
Please refer E-mail dated.06.08.09 to CMD & CGM. Being extremely
dissatisfied with the attitude and performance of BSNL Data one E-mail services
it has been decided to 'Stop' using Data one E-mail services. All concerned are
being notified accordingly.


Para should be (f).
This dialogue will be on. Mean while kindly see the real picture from your BBST
records annexed.


Para should be (g).
Too late decision. Unhealthy atmosphere prevailing months together could have
been arrested at initial stage between March to May'08 by allowing this.
However many thanks to BSNL for a sympatric kind consideration shown to an Old
Aged Disabled Person. Tel.Bill for the period 01-06-39 to 30-0609 and 01-07-09 to 31-07-09 are 552/- respectively. By allowing free Modem from Aug'09
necessary reduction in this regard effected in bill for the period 01-08-09 to 31-08-09 will be watched and
noted


On a careful
examination of the letters received from T.S. / H.Q., DET / ALP and A.O /
Tr.III / Alp, were interesting to note that each letters are contradictory to
others. However since the BSNL have shown some sympathy to Old Aged Hemaparasis
Disabled Patient, an offer remains open which is as follows:- "In the
event 20% discount is restored to the all other issues lying pending unsettled
can be discussed with between the parties at appropriate authorized level, duly
drawing out a Jt.minutes & settled with in 10 minutes time. Liability of
settling a case, lying outstanding with accepted default by BSNL rest with them
only.
