    Hi,

    I reside in sector-5, vasundhara, ghaziabad. We have been observing unauthorized construction by builders in the society.

    It is only allowed to construct 2.5 floors in our society but builders are constructing 4 floors which is not even as per approved construction design.
    Several complaints have been filed against builders ruining the residential society for building builder flats and selling them individually.

    Kindly take some action.

      Regarding unauthorised construction in our neighbors home, as there is an construction going on in our neighbors house we are facing a lot of issues, firstly they are not using proper metal sheets to cover there entire house due to which all the malwa and dust is entering our premises, large stones dropped in our premises damaging our property and household items, also the tractor full of badarpur are running all days, creating air pollution and chaos in street, the person concerned has taken up almost half of the street in his possesion also due to this construction our side wall has been damaged and sabotaged, their raw material is blocking our main gate and damaged our four vehicle.
      Kindly take action against this builder as it is deeply impacting our day to day life and sabotaged our property also. This construction is creating lot of miseries for the residents around and is a threat to normal living and if this unauthorized construction is not stopped immediately it will encourage others to follow the same practice. For safety reasons i am not disclosing my identity to you. It is therefore prayed before your goodself that immediate action should be taken against him to stop the ongoing illegal construction and to demolish the unauthorized structure that he has already built.

        Illegal construction of flat i. E bacha flat in parking area at ground floor. Builder nd owner throug which we buy our flats is do not take any action to dismental the bacha flat after many requests and he is trying to sell the flat (Bacha flat) illegally while he is not entitle to construct the flat.in last i file complaint to you for take proper action.           Plz help me as just now i've completed the loan and document process for flat and at the last movement bank required one noc from society on the name of seller and when we approach the builder to provide it then he is asking to give 1 lack rs to him and transfer the shares on buyer's name only after that he will provide it, where i've to go to cross check that whether he is asking for correct fees or not and if he is asking wrong amount then where i've to go as during the entire process i've spent all funds and now the builder is not supporting. Building age is approx 20 years old.

          Plz suggest me what to do now.

            I am urgently looking to sell my flat and builder is not ready to give noc without paying in cash. There seems to be no recourse. The builder is well connected, while we have no such connections and need to urgently complete the transaction. What do we do? Why is the builder noc required by banks who lend money. This is totally unfair for the seller as well as buyer as both have to bear the brunt.

              This is to bring in your notice that I am residing at RZF-763/42A street number-5 rajnagar part-II, palam colony near Dwarka sector -8 New Delhi-110077. It is a single floored house.

              In my neighbor, builder Mr.Purushotam sharma and Mr. karamveer has build a new construction which is a 4 storey building. They create lot of noise, thus leading to constant disturbance in environment. They have done illegal encroachment on my property by extending the wall, encroaching 4 inches of land .with every successive floor he has extend the wall even more. Despite of repeated notice and complaints they deliberately kept encroaching. Now they have started quarreling using abusive language and threats for the same. I am very much worried about my family in my absence. Now this harassment is intolerable.
              Not just that, the building is made with very low quality material and poor techniques, causing seepage and cracks in walls of my house. The structure is so poorly designed that there are high chances of building collapse.
              Kindly look into the matter and take strict action. Hoping for your positive response at the earliest.

                I've recently taken possession of a 2BHK apartment in Pune. I've paid for a covered parking on the ground floor of the same building. The parking which is allocated to me is clearly marked in the registered agreement that I've done with builder. This parking space is big enough to accomodate two cars. Now Builder has divided this parking space into two and is trying to allocate/sell the other half to another party who has purchased flat in the same building. The justification given by builder for this action is that the parking space which remains with me is still big enough to accomodate a car.
                In addition to this I'm also facing the problem of water leakage from ceiling in one of the two bedrooms of my apartment. This problem only occurs when it rains. Builder has taken some corrective action for this, however this problem is not resolved yet. Since this years rains are almost over. I'm afraid this problem will resurface again next year, and I'm not sure if he'll help me out then. When I tried to submit a complaint writing to the builder for this problem and asked for his acknoledgement, he refused to sign it.

                Please advise me as to the options available to me now and how to proceed with those.

                Builder — Parking space

                We are staying in a copoperative society in Thane since last 3 years. We own a flat in the building.

                The builder is forcing us to buy a parking space. He is not allowing the cars to enter the building premises if parking is not purchased. people from builder are standing at gate and forcing people to park their cars outside.

                The road outside building is vey narrow and trucks for the consturction from same builder are often travelling from that road. There is a risk of damage, theft to car.

                Please guide us on whom shall we complaint about this.

                  Dear Sir,
                  We are residing at Venus Parkland, Vejalpur, Ahmedabad, Gujarat. There are almost 18 cases of dengue so far and its on rising day by day. In my own house there are two cases of dengue. The builder is not taking any step against it. It is very clear that it is due to builder careless and negligence. Even seeing so many cases he is not bothered for that. Its not the cost that matter but the lives are important. If your are not compromising on certain things at the time of construction of buildings why the builder is not cautioned about taking step against pooling of water which causes dengue. who will bare the hospital cost who will bare the pain of infected person. Why government is not taking any step against such builder. The cases have been reported only in that whole apartment only. I request gujarat government to take immediate action against such builder who are playing with the lives of people. Small kids used to play around the garden what about them. who will take care of all this things. Request to take immediate action.

                    Please don't ever go this builder for any construction and for individual flats.he is a bug cheater and tells all the useless stories till he gets the contract ,after that he behaves like a stupid.....Few of my friends had bad experiences with this guy and i have seen their problems very closely. we don't know how to control these kind o[censored]seless builders in Hyderabad.....all the owners need to have a community ....

                      Dear Sir/Madam,

                      Recently (Registered on 14th November 2011 and possession on 5th February 2012) I purchased a new flat in Villivakkam constructed by IKS builders, now there are lot of cracks (Horizontal & vertical) on both the side of the flat, when I asked builder about this he said will send a person and do rework but now he simply deny to do the rework and say that after one two years do putty finish and paint this will be resolved.

                      He never want to do the rework and the amount which I have paid to purchase this flat is not that much valuable.

                      Four months have been rolled out and till now he didn't handover the documents approved Plan, Corporation tax, Water tax cards to me even the completion cerrtificate, for this he has collected 1.5 lakhs he didn't give proper break up how much was paid to Governmentbut.

                      He took entire amount before giving the keys, on 4th February 2012 he has locked the flat and took the keys with him when I called the builder and asked he said 40000 is pending from my side and I have to pay that then only he will give the keys.

                      I have purchased car parking but till now he didn't mark the parking area which is allotted to me, mean while other flat owners saying this a common parking and builder conveyed to them that he is not going to sell the parking to anybody since it is common for everybody but he took 2 lakhs from me for the reserved car park I requested him to return the amount which paid for the reserved car parking but there is no responce from him.

                      I would request to take action against this builder so that any body who want to purchase the flat which is constructed by him will not be affected and infuture he will not repeat this mistake again.

                        When approached for purchasing an apartment they made all promises and had put those in sale deed as well. 24 hrs supply of water, milboxes, ..so far nothing is fulfilled. almost completed 2 years. r t from the begining we all started getting water thru water tank suppliers..there are days where there was no water for almost a day.

                        no name plate/banner for the building as well till date. when ever we ask them for it.. he tells something or other .

                        Kindly let me know is there any provision in the law to take legal action against him.

                          Hello Sir,

                          This is about issues we are facing with our builder in many aspects.

                          We bought flats from a novice builder. During registration of the flats he has given/committed to few specifications for the Flat/Apartment, but towards the end he failed to provide many specifications. I have listed down few major issues we had with him.

                          0. He committed in the document to complete the construction by May' 10 and agreed to pay Rs. 6000/- as penalty per month. But he literally delayed the venture by at least a year and simply ignoring his words and registered documents when we asked for the same, saying that no builder will actually give such penalties.

                          1. He failed to provided water (either from Bore or from Municipality connection)
                          - He pushed digging bore towards the end of final disbursements and finally found that water is not there in our plots after he dig the bore during the time of our occupation, which is too late for us to stop giving funds.

                          - He sold the flats for us claiming that we have ample ground water

                          - By knowing the fact earlier we would have bought it for lesser price or even ignored his venture

                          2. There is a seepage problem in lift room because of which we faced problems with left many times.. we raised at least 20 complaints with in a span of 6 months.

                          3. He promised to give generator backup for light and fan in each room but finally provided only for single bulb
                          - And its not capable of running Lift and Motor for pumping water to overhead tank at a time

                          4. He promised Intercom but finally installed some cheap quality phones which are not actually intercom but one way communication from watchman to flat

                          5. Quality of construction is also not good, at many places on internal walls, we are observing wet spots and paint is torn away because of that


                          With many such pending things in place, he came to hand over the house last month. But we insisted him to complete the things and hand over properly.

                          Yesterday he stopped supplying usage water all of a sudden without prior notice/ handover of flats. :-(

                          If this is not the right place, kindly advice me where/how to proceed.

                            Hello sir,
                            A building is being made by a builder at C-73, Jeevan park, pankha road, uttam nagar, new delhi-110059. This building is not following the standard laws and procedures of a residential building. Following are the points of objection:
                            1). It is a five storeyed building, which is not allowed in a residential area.
                            2). Its walls are 4 inch thick, which makes this building weak.
                            3). The construction material is of poor quality. Ratio of cement and dust is 1:15, which makes this building very weak.

                            So, I would request you to stop the construction of this building as soon as possible. It can be dangerous for the society in the near future.

                                No one paid for construction work as always (It may be Policy), Builders only getting problem to providing pay for Raw materials, workers and Transportation etc...Every owner has to pay for Construction work whoever doing for them...But No one understand that...Work only need to finish by on time but they can’t pay for that...And Builders can't do Services (OC)
                                Any Contractor can't do free service, If he get paid he can provide enough Man work...Because Worker never do work for Free for Contractors...

                                  I have purchased flat from Kamala Developers Mr. Akshay Jain . Building name is Ashok Enclave
                                  at Chincholi Link Road, Malad West This builder has harrased us and not completed the building construction work. He has not got us OC and other BMC permissions.We have got possession in
                                  the year 2007

                                  Last 20 days lift not working and we have senior citizen in the building who are harrassed and tortured. No compound created or childrens park created.

                                  Had given false promises at the time of construction of the building.
                                  Building is in most pathetic state and owners of the flats are harrassed on daily basis from
                                  builder .

                                    This is regarding Mittal Brother's construction named Atria at Tingre Nagar, Vishrantwadi.
                                    The construction quality of buildings is very poor and the accessories used in the flat are of very low and local quality and not same as sample flat shown.

                                    Inspite of repeated followups with the builder , the flat owners are facing problem in delayed possession .
                                    There are no technical specifications being followed.


                                    The first floor was supposed to be divided into half parking area and half residential but now they have changed plan and converted parking into flats and now creating a chaos for parking area.

                                    Would request to take some steps against the unplanned , irresponsible builder.

                                    Builder — Quality of Construction

                                    A builder near my house is constructing a 10 storied building without proper piling. He digged 2-3 feet on the ground and started constructing the pillars. Is it enough to build a 10 storied building? If not, what action I can take against them?

                                      Hi,

                                      There is apartment in Electronics City Doddathogur village named Celebrity Classic, besides that some space is there which has been sold by the builder to some local builder. The local builder is constructing g+4 apartment totally blocking this apartment and has only village panchayat approval which is illegal since the plot is owned by BDA. The local builder is not listening to anyone and proceeding with the construction.

                                      Thanks for letting people know about it. I have visited 2 apartments in that area named Ambika Residency and Supreme Enclave. Both were inside Celebrity Campus. When I asked about it they said it is not Celebrity property but just they have put the board at the main entrance of Campus.

                                      Could you please let me know if these are the building you have mentioned in your post above.

                                      It will help me to decide whether I shold go for this apartment or not.

                                        I own one flat in DLF colony ghaziabad near dilshad garden. At the time of registry builder guarantee to provide the electrical & water connection at the time of possession. But it is now almost 2 years after registry of the flat the builder fails to provide the electrical & water connection without which we are unable to shift their. Please realise our position as even after 2 years of registry i am residing in a rental house for the reason that builder has not provided the electrical & water connection in the flat.                                           This is to bring to your kind notice that, I am a resident of Rani Bagh area and wish to inform you that there is serious unauthorized construction going on in our locality (Multani Mohalla, Ranibagh) which has made the life of the residents miserable beyond your imagination.
                                          Mr. Sanjay Kukreja, r/o WZ 2040, Rani Bagh, Delhi – 110034 presently undergoing unauthorized construction at the aforesaid address. He has already illegally completed that construction work upto 4th floor despite innumerable complaints to the competent local authorities resulting in publicly making a mockery of all government and administrative bye laws and MCD regulations. Local residents of this area have given several warnings to him to stop the unauthorized construction but he has ignored/neglected all such requests and warnings and has not stopped the illegal construction. He is often seen and heard boasting of political connections and challenges everyone publicly to dare stop the illegal construction. Even the police personnel are very often seen visiting his residence at every now and then, thus proving that he is doing all this in collusion with them.
                                          This illegal construction is also making the surrounding more unhygienic which may cause a lot of diseases, especially to the kids who are more vulnerable. Moreover the scare of H1N1 virus and Swine flue has made us worry more.

                                          This illegal construction is causing great threat to the safety of the neighbors, as the building structure is very weak.

                                          We had requested almost all the concerned local administrative bodies to come into action to stop the unauthorized construction but all such requests have fallen on deaf ears. It is pertinent to state that the local administrative body is allowing him to carry on the unauthorized construction by becoming mere spectators. This construction is creating lot of miseries for the residents around and is a threat to normal living and if this unauthorized construction is not stopped immediately it will encourage others to follow the same practice. Such unauthorised construction is a serious threat to the peaceful living of this residential area and it is therefore prayed before your goodself that immediate action should be taken against him to stop the ongoing illegal construction and to demolish the unauthorized structure that he has already been built.

                                          Now they are stopping construction but damaged my roof. thats why my rain water dropping my rooms. we have calls many times for repared damaged roof but they are negleted.
                                          File a Class-Action Suit against the Builder, the court will definite give a stay order and halt the construction.
                                          As for damaging of roof due to activities carried out by Builder is concerned, you can file a case under Civil Procedure Code for recover of damage due to negligence by the Builder.The court is generally lenient to the consumers as they know that Builders all across the country do the same thing, especially small-time & novice construction firms like Sharif Builders Pvt. Ltd.Court in such cases ask the Builder either to pay for damages or get it rectified to its original state, also asks the builder to compensate the consumer for legal expenses incurred along with financial liability such as loss of rent during the period of non-occupancy of the premises.Such builders should be brought to book.

                                            I have purchased an apartment wherein altogether 7 flats are exist, last 19 years builder doesn't want to form an apartment and on top now he wants to build the another one floor on the existing construction(we don't know the condition of the existing construction structural details etc.).
                                            out of 7 flats , only 5 members are in opinion to form an apartment 2 are out of country and we have all related documentation for only 6 members.
                                            having this brief info. kindly guide us how to proceed further to form the apartment with in this constrain and how to restrict builder from the further construction.

After So Many Complaint & Reminder, Mr. Naveen Not Take Any Positive Action. Yesterday On Date[protected] At 12.30 Labour Of That Building Were Working On 4th Floor & My Daughter In Law With Her 1.2 Year's Old Son & With My 2.5 Year's Old Grand Daughter Was On The Top Of My Home's Ceiling Doing Some Work, Uncertaily The 4th Floor's Newly Constructed Wall ( 4 Feet X 9 Feet ) Drop Down From 40 Feet Height With Material Onto Our Home. Lukely By GOD's Blessing In This Accident Our Family Members Safe. Only 2 Second Before That Accident, They Were There This Material Fall. Due To Height The Whole Material 250-300 Bricks Come By Pressure On Our Home's Top Ceiling & Damage Our Storage Water Tank & Supply Of Water Pipes. Due To This All Ceiling & Wall Gets Damage & Bricks Come Into Our Ground Floor's Living Room By Stairs. All The Walls & Ceiling Get Cracked Of My Home By This Forcefully Atack. I Already Call 100 Nos. PCR & Mr. Hari Singh From Bindapur Police Station Come For Investigation & Assure Me & My Family To Repay The Amount Of Damages From That Builder Mr. Naveen. After So Many Request They Don't Wright Any Complaint Agianst Him & Call Me In Bindapur Police Station. They Receive My Complaint On Plain Paper, But Not Large FIR & Tell Me To Wait For SHO Bindapur.                                               SHO Bindapur is busy in collection of bribe from the builders. What will you give to hin? There are hundreds of illegal constructions going on at uttam nagar without any sanction plan due to active participation of SHO Bindapur. Senior officers are also deaf. Hon'ble LG should intervene in it to stop massive illegal constructions.

                                                We got ourselves a flat in a society.After giving the complete possession 2-3 years back, the builder is demanding more money on the basis that land rates have increased. Many others who bought flats in the society have paid earlier the amount of 1-2 lakhs extra. I would like to know whether it is possible for a builder to demand more money on such grounds after giving the complete possession. If yes then on what grounds. And if no, then what can be done to negate this claim of his.

                                                  There is a contractor L.Ravi he stays in Laggere in Kuruburahalli beware of him he has taken excess money from me and is now absconding without reporting to work. No one should give him any building for construction. This guy does not have proper skills to construct houses but has all the skills to extract money and runaway. He has also told me that this is India and all politicians and everyone is a criminal and no one can do anything. He can give bribe and escape punishment. He is not educated. He has a 3 storeyed building and also has two wheeler and has made a lot of money and puts Govt employees and hard working people to shame. He has never paid even a single ruppee in income tax and is living royally by all wrong means he should be brought to book if law is strong and is unbased and lets good people and activites progress in the country. Because of him I had to resign my job and lok for someone else to construct my house,

                                                        I was promised by the builder on the date of handover of my flat by 05/04/2010. (2 months delay). But till now he hasnt completed the work.

                                                        Pending work as of today:
                                                        1. EB meter not fixed.

                                                        3.Common Pavemant not fully laid.
                                                        4. Sorroundings not cleaned.

                                                          I booked one flat B1,7th Floor, Madhurapuri, Guruvayur (SRK Constructions) on 16/09/2008 & given advance Rs.1,00,000.00 (Rupees One Lakh only). Due to fianancial crisis the project cancelled or postponed. I never asked refund of money up to December 2009. After my permanent enquiries SRK Muscat representative given post dated cheque in December 2009(Cheque date 05/02/2010). March 1st week, I deposited the cheque & the same bounced due to shortage of money in SRK refund A/C. Before coming to Kerala I informed SRK Muscat representative cheque depositing date. After bouncing the cheque I called from Kerala to Muscat 2-3 times & given SRK cheque no. to their Muscat office. They informed SRK Cochin office accounts department informed their bank for clearing the cheque. I am returned to Muscat after my annual leave on 20/03/2010. 26/03/2010 my bank informed me that the my cheque again bounced. Information passed to SRK Muscat & Dubai office & they confirmed the amount availble at my bank A/C on or before 30/3/2010.

                                                          I trusted SRK cheque & I am also given a cheque from my bank A/C. After bounced SRK cheque first time, my cheque holder created problem & informed me that they can wait upto March 31st.
                                                          SRK constructions not interested to credit the amount in my bank A/C up to 30/03/2010 3.00 pm. I called from Muscat to Cochin office several times & finally they transferred Rs.1,00,000/-

                                                          I lost 18 months bank interest, my cheque bouncing charges & several international telephone charges. Apart from all these my family faced lot of problems after bouncing SRK cheque second time. All details I sent mail to CMD Mr K R Malik & SRK Brand Ambassador. So far their office not given any reply.

                                                          Builders Deposit — Project not received approvals - Deposit return

                                                          We invested in an Apartment project in bangalore in Sept 2005 with an intial deposit of Rs 10 lakhs as booking amount. Since the appropriate approvals have not been given to the builder so far, we decided to withdraw the booking, by writing a mail to them and also having a telephonic discussion with the builder. We've been chasing the builder for the almost 2 months now but the booking amount is not being returned to us.

                                                          I would please like to know what action can we take against the builder and to get our money back

I had invested in a project in Bangalore in Sept 2005 with a deposit of 10 lakh Rupees as the booking amount Its been almost 3 years hoping that the project would start but to no use. The builder has not yet got the final approvals to start the project and therefore we've been asking the builder to return our booking amount. Its been 2 months that we've been chasing them to return our money but to no positive response.

                                                          I would like to know if I can take any legal action and force the builder to return our money ? How ? what is the process ?                                                           SRK constructions not interested to credit the amount in my bank A/C up to 30/03/2010 3.00 pm. I called from Muscat to Cochin office several times & finally they transferred Rs.1,00,000/-

                                                          I lost 18 months bank interest, my cheque bouncing charges & several international telephone charges. Apart from all these my family faced lot of problems after bouncing SRK cheque second time. All details I sent mail to CMD Mr K R Malik & SRK Brand Ambassador. So far their office not given any reply.

                                                          I have gone through your complaint which is absolutely baseless. It is true that your cheque got bounced but we kept out promise to refund it before 31st march 2010 and the money was transferred to your account .. plz go through following details

                                                          We have transfered yestarday itself Rs.1.00L to Mr.Gopakumar M A/c No.[protected], ICICI Bank. The transfer is effected as per UTR No.ORBCH[protected]. The money is tranfered in consultation with Mr.Manish of ICICI BAnk. The money is debitted from our account and if the payment is not reached; it is the bankers only can resolve the matter and have given our banks tel. no.[protected] to ICICI Bank people to resolve the issue.

                                                          Regarding Bank interest.. Its actually me who informed you that the project is shelved and we will refund you the money . But again you had waited for months hoping that the project will take off..so the interest part is not our mistake. please stop blaming us for your mistakes.
