We are a group of buyers of villas in a project called Westend Greens in Mokila, Hyderabad.

It is conducted by a company called Countryside Realtors.

We formally present this complaint against the disqualified director Masood Hasan.

These are the illegal activities Masood Hasan of Countryside Realtors has engaged in with us buyers for years now:

1) He befriends potential buyers with lies and deceit. He promises that their villas will be constructed and ready in 8-12 months. Even after 5-8 years the villas are not ready. He will not communicate with us buyers, ignoring all of our phone calls and emails. If we go to his office he tells his secretary to inform us that he is out of the country.

2) He will not allow us to do an inspection and measurement of our villas, prior to the handover. We want to do this to ensure that the villas were built properly according to what was on the agreement of sale (AOS) and that the SFT matches what was on the AOS.

3) Once the handover happens, and then we get an inspection report, Masood refuses to fix any of the numerous deficiencies. The villas are essentially uninhabitable and we have to pay out of pocket to fix the deficiencies.

4) Masood will not provide us with the original documents. For example we need the original sale deed of the plot from Countryside Realtors.

5) Masood promises in writing that he will pay the registration cost of the villa. But at the time of registration he demands that we pay that cost.

6) Masood will not provide an NOC to us so that we can sell the villa.

7) Masood will try and prevent us from selling the villas. Unless we pay him extortion money.

8) Masood will turn off the water and electricity and/or completely cut off the water or electricity in an attempt to extort money from us.

9) If we do not pay him extra extortion money, Masood has blocked our entry to the property or to our villas.

9) Masood Hasan will try to extort additional money from buyers at every stage: at time of handover, at time of registration, even after the handover. Masood has made it a habit to extort buyers for extra amount of money for extra SFT (that he never built), GST or registration. If we refused to pay this, he will not give the handover. We are also not allowed to measure the villa to see if any actual extra SFT was built.

10) Masoood had promised a long list of amenities in the agreements of sale, that have never been built, and most likely will never be built.

Amenities he has promised in writing include: Garden, Play Area for kids, Badminton Court, GYM, Indoor Games, Swimming Pool and a Hall.

None of this has been built and none of this will ever be built by Masood, but he has taken money for amenities from all o[censored]s buyers.

11) If buyers complain he will threaten them with bribed police officers at the Shankarpally police station and with legal notices from his crooked lawyer.

12) If buyers try to unite with chat groups or on social media, he is so afraid of the potential consequences that he will threaten them to close those groups.

Important Facts against Masood Hasan implicating him as a criminal:

13) There are several lawsuits filed against Countryside Realtors. There are lawsuits in Hyderabad and in Delhi. Masood has bribed the lawyers who filed the suits against him. As a result the lawyers have taken unnecessary adjournments and those lawyers have also purposely lost important incriminating documents.

14) Masood Hasan has been disqualified as the director of Countryside Realtors since 2014. Therefore he is not legally allowed to be involved with the company in any way. So his continuous involvement with the company is illegal and for that he has been reported and will be prosecuted.

After 2014 he has been actively involved in Countryside Realtors, making sales, signing documents even after he was formally disqualified as the director by the Ministry of Corporate Affairs (MCA).

Under the Right to Informations Act (RTI Act) answers we have discovered that

"As per Companies Act, 2013 the director Mr. Masood Ul Hasan MD cannot be acted as director up to[protected] for ANY company until instructions/directions/orders received from the court"

Therefore if Masood is claiming in court that he is the director of Countryside Realtors then he can be prosecuted, as he is essentially committing perjury.

Masood has no legal authority to run Westend Greens/Countryside Realtors anymore. He can not accept payment, deny services, deny entry or anything related to Westend Greens/Countryside Realtors. He continues to actively run Countryside Realtors, despite the fact that he was disqualified as the director in 2014. Therefore his continued involvement with the company is illegal.

    Evidence

    On verifying http://mca.gov.in website i found below evidence which proves that countryside realtors india pvt ltd, mr. Masood ul hasan and mr k. N simha and their charted accounted used “straight through process (Stp) to upload below mentioned forms which are self declarated and do not need to go through manual verification by roc hence they were able to restore mr masood ul hasan as director on[protected] without getting the forms verified by roc hyderabad.

    But in this process they made mistakes which prove they committed fraud, forgery and malicious intention to carry out their illegal business by filling and declaring false information.

    Below is the list of document countryside realtors india pvt ltd uploaded in http://mca.gov.in portal using stp process to reinstate mr. Masood ul hasan as director on[protected].

    Very important point: din no: 02542799 – this din was applied and approved on 20/02/2009 but as per documented uploaded on[protected] masood ul hasan with din no: 02542799 was appointed as director of countryside realtors india pvt ltd on[protected]. A person whose din was approved in the year 2009 was made director in 2005 with same din, this is clear case of forgery and show to which extent both masood and simha can go to continue their illegal business.

    On carefully checking the 3rd from “form dir[protected]”, it is found that in page no.2 date of appointed for director is[protected]. Now refer to page no. 4 of section “certificate by practicing professional” and observe the digital signature of chartered accountant. This digital signature is obtained from a company called e-mudhra and its validity period is[protected] to[protected].
    On same page, page no.4 digital signature of director “mr. Kavinarasimham simha” is obtained from a company called sify technologies limited and its validity period is[protected] to[protected].

    Above point proves that form dir12 was filed on 4th dec 2019 and not on[protected] as claimed by countryside realtors india pvt ltld
    The company e-mudhra from which digital signature obtain they themselves mentioned on their website (https://www.e-mudhra.com/about-us.html) that they started issuing digital signature in india from year 2008 then how came a chartered accountant in year 2005 got this digital signature and signed the form dir-12. This is proves they completely manipulated the form.

    Din number mentioned in page no 2 of form dir12 shows din:02542799 for masood ul hasan but as per forms form 23ac and form 20b filed by countryside realtors india pvt ltd on[protected] shows digital signatures of director masood ul hasan with a different din no. 01364177.

    How can a director maintain 2 din numbers for same company?

    Mohammed masood ul hasan through his advocate mr. Jaysurya vishnu vardhan filed a case in hourable high court wp no. 21860/2019 on[protected] between mohammed masood ul hasan and 1. The union of india 2. The registrar of companies to reappoint mr. Mohammed masood ul hasan as director but case is still pending and no order passed by the hourable high court.

    Countryside realtors india pvt ltd was struck off by registrar of companies on[protected] for non-filing of annual returns for financial years 2006-07, 2007-08, 2008-09, 2009-10, 2010-11, 2011-12, 2012-13, 2013-14, 2014-15, 2015-16. Subsequently countrysde realtors india pvt ltd filed a case in nclt with ca no 636/252/hdb/2018 and order has been passed on[protected] to restore the company status to “active” by directing countryside realtors india pvt ltd to file all statutory documents along with prescribed fee as decided by roc within thirty days from date on which its name is restored but till today company did not file any documents with roc thus not complaining with the nclt order.

      Part One:

      Saurabh Pandey, the assistant of Masood Hasan (disqualified director of countryside realtors) has been committing illegal actions with buyers, which include:

      • Blocking entry to their villas
      • Not providing water connection
      • Not providing electricity
      • Bribing local police officers so that they do not take action against him
      • Asking buyers for more money for GST, registration etc (monies that buyers NOT responsible to pay).

      We are forwarding all these matters to the necessary authorities.

      The strongest legal actions will be taken against Saurabh Pandey and his criminal boss Masood Hasan.

      Part Two:

      In our ongoing research we have uncovered a document, that shows that Masood Hasan of Countryside Realtors was sued before. You can view it online here:

      The only person actively listed as a director for Countryside Realtors is:

      Navkar Classic Aparments,
      Flat NO. 304 Prasanth Enclave,
      Pet Bashirabad, Qutubu Llapur
      Hyderabad 500055 TG IN

      Even Shruti Singh (another director) has been disqualified.
      These criminals (Masood Hasan, Saurabh Pandey and company) will all be in a prison soon.

      They recently saw what happened when the Panchayat official demolished the properties that they illegally constructed.

      Now watch what happens when the rest of authorities come after them.

      We are aware that Masood Hasan has been disqualified as the director of Countryside Realtors since 2014. Since then he continues to advertise, sell, and sign on documents related to properties built by the company.

      In addition:

      • We are fully aware that they have bribed police officers at the Shankarpally police station in the Mokila area. Those crooked police officers are calling buyers and threatening them to remain silent about these issues.

      • Masood Hasan has been disqualified as the director of Countryside Realtors since 2014. Therefore he is not legally allowed to be involved with the company in any way. So his continuous involvement with the company is illegal and for that he will be reported and prosecuted.

      • The construction of villas at the Westend Greens location is illegal since they have not received the completion certificate from HMDA to this day.

      • Masood Hasan and Saurabh Pandey have tried on numerous occasions to extort extra money from buyers for extra SFT, GST, registration costs etc.

      ALL of this is being reported by us buyers to the:

      • Ministry of Corporate Affairs (MCA)
      • Registrar of Companies in Hyderabad (ROC)
      • National Company Law Tribunal (NCLT)
      • Hyderabad Metropolitan Development Authority (HMDA)
      • Cyberabad Police Department
      • Tax Authority of Telangana
