There is illegal construction going on in flat 26 in C-Wing of Maheshwari Mansion since 2nd November, 2015. Complaints have been lodged time and again with Malabar Hill Police Station. Even higher and concerned authorities of Mumbai Mahanagarpalika, MHADA and Mumbai Police have been informed of damage caused to 80-year old building Maheshwari Mansion at 34 Nepean Sea Road in Mumbai. The police of Malabar Hill Police Station have been answering all calls made by me to Police Control Room 100. Today I have lodged complaint of hitting my ceiling with hammers at 11:03 a.m. with the Police Control Room. Complaint No. is S02091626. The Security Guard informed me painting work is going on in the said flat 26 but I doubt as in March 2016, BMC officers who visited the flat for inspection wrote to me that painting, carpentry and tiling work was going on in the said flat which comes under tenantable repairs. The illegal construction is being shielded with the collusion of Saraswatibai Bishwambharlal Charity Trust with ulterior motives.

The Wireless Police, after my call to Police Control Room yesterday, visited the said flat no. 26 on 3rd floor in C-Wing yesterday and were informed by the labourers working in the said flat that Mr. Devesh Sharma has been given permission by Mr. Sampat who is the Secretary of Saraswatibai Bishwambharlal Charity Trust to carry out additions and alterations in flat 26 in C-Wing above my flat. The said unauthorised and illegal work without the permission of Brihan Mumbai Mahanagarpalika and MHADA in 80-year old building Maheshwari Mansion at 34 Nepean Sea Road in Mumbai is being done since 2nd November, 2015. The office of the said Saraswatibai Bishwambharlal Charity Trust having its registered address at flat 8 Maheshwari Mansion on 1st floor in B-Wing is also occupied by Mr. Devesh Sharma. The said flat 8 is merged with the adjoining flat 10 on 1st floor in B-Wing. Both flat 8 and flat 10 in B-Wing are also occupied by Mr. Devesh Sharma. The original tenant of flat 10 was Dr. K U Jhatakia and the original tenant of flat 26 was Mr. Surud Patel. Postmen from Cumballa Hill Post Office still come with post addressed to Mr. Surud Patel. The letter box of Mr. Surud Patel in the lift lobby on Ground Floor of C-Wing has also been removed. The Secretary of Saraswatibai Bishwambharlal Charity Trust can be contacted only by his mobile phone [protected]. The Security Guards sitting in the lift lobbies on Ground Floor of B-Wing and C-Wing are appointed and paid by Mr. Sampat.

Website of best undertaking shows five consumer/account numbers have been allotted to devesh rajeev sharma and dr. Rajeev sharma in maheshwari mansion. The consumer/account numbers shown as of today on the website of best undertaking are :[protected],[protected],[protected],[protected],[protected]. This proves that even best undertaking in in collusion with devesh rajeev sharma and dr. Rajeev sharma.

    80-year old building maheshwari mansion at 34 nepean sea road in mumbai is presently managed by saraswatibi bishwambharlal charity trust. A security guard named guddu tiwari hired by saraswatibai bishwambharlal charity trust is sitting in the lift lobby of b-wing and is using the electric meter room on the ground floor for his personal use. Today morning at 9 a. M., he removed the pots kept on both sides of the main gate of b and c wings only after i reprimanded him. The potted plants were kept on the footpath used for pedestrians to walk and causing obstruction to enter and leave the small building gate on the footpath. Today in the afternoon, he allowed a driver to play with cricket ball knowing fully well that there are best electric meters on the ground floor and cctv wires and telephone wires are hanging loosely in the 80-year old building. There have been incidents of short circuits where entire building has been gutted in fire. Also in the morning today, a woman residing on ground floor threw a bucket of water towards me when i was walking towards the steps to reach my house. Now i came to know that this woman on the ground floor feeds and offers the watchman guddu tiwari food and tea daily. Just a few months ago i was charged for offence under section 379 ipc by malabar hill police station due to an incident in which guddu tiwari was also an abettor. I was acquitted in the same police case on 8th july, 2016. At that time security guard guddu tiwari was stationed in the lift lobby of c-wing as security guard of c-wing. When the police of malabar hill police station reached my house today for help just now, guddu tiwari has disappeared from the scene of offence.
    The police constables of Malabar Hill Police Station in Mumbai made no efforts to trace Guddu Tiwari who had disappeared from the scene of offence on 21st August, 2016. Today when I was entering the building, he instigated a driver working in the building to throw a large throw ball to hit me. Now this watchman Guddu Tiwari is in collusion with some residents, servants and drivers of the building to cause harassment, obstruction and nuisance to me.

      Since about 6:30 p.m. a bag has been lying in the lift lobby of second floor of `C' Wing of Maheshwari Mansion. I called the Police Control Room about an hour ago to complain about the unattended bag in the lift lobby. The Police Officers of Malabar Hill Police Station visited the site and questioned the residents of flat 18 on second floor in `C' Wing. Sailesh Merchant residing in flat 18 told the Police Officer that the bag belongs to them and is their garbage and also that it will remain there till it is picked along with their garbage the next morning. Garbage is cleared only once a day around 8 a.m. every morning by an employee of Saraswatibai Bishwambharlal Charity Trust. There are rats in the building and they are allowed to feed on the garbage . So the bag remains in the lift lobby even now. Public nuisance is being encouraged in the building by Saraswatibai Bishwambharlal Charity Trust. The Police Officer of Malabar Hill Police Station told me on the phone that it is the work of the building Trust which is Saraswatibai Bishwambharlal Charity Trust to keep the building premises clean.

        There is lot of noise and damage in the building due to illegal construction activities in some flats which amounts to disturbance of peace and tranquility. Under the guise of repairs, walls of some flats are being demolished and illegal additions and alterations are being carried out in some flats of Maheshwari Mansion. The building Maheshwari Mansion is being controlled by Saraswatibai Bishwambharlal Charity Trust. There is no Court Order to redevelop the building and this work is not being done by MHADA or the Charity Commissioner of Mumbai. Lot of damage has been caused to my flat too due to the illegal construction activities in the building by Saraswatibai Bishwambhalal Charity Trust.

          Saraswaribai Bishwambharlal Charity Trust is responsible for the upkeep and maintenance of the building Maheshwari Mansion at 34 Nepean Sea Road in Mumbai. Garbage is piling in all nooks and corners of Maheshwari Mansion on the back side. Neither the Trust nor the people who have been throwing the garbage are getting it cleaned. Old bamboo sticks, an old and broken bath-tub, and rubbish has been lying under my flat on the rear side of the building. Today big rats are moving under the old bath-tub. This photo clicked from above shows the condition of the rear side of the building.

            One Security Guard of Master Guard Force is sitting in a chair in the lift lobby of Ground Floor, near the lift of C Wing, in the building Maheshwari Mansion. The building is managed by Saraswatibai Bishwambharlal Charity Trust. It appears the prime duty of the Security Guard' is to see that I am being continuously harassed by the illegal residents, tenants, hawkers, dogs, servants, drivers, couriers and people who frequently visit the building. On 14th January, 2016, at about 7:30 p.m., when I was waiting for the lift, two ladies Shobhana Merchant and Daksha Merchant who came later from outside quickly closed the lift doors and took the lift up. Today morning at about 10:15 a.m., when I came from outside and wanted to come to my flat, the Security Guard Guddu Tiwari alerted the persons who came down in the lift and before I reached the lift, the persons who came down quickly took the lift up. This Security Guard Guddu Tiwari stationed in the building is often seen ferrying bags and luggage for the Kotharis and is paid separately for the personal work he does for some of the residents during his duty hours. I had even caught him when he kept some cardboard boxes in the Electric Meter Room adjacent to the lift for Jayesh Vira/Veera. He is on duty in the building since August 2015 in different shifts and in different wings but it appears his main duty is to see that I am being continuously harassed and obstructed in some way or the other when I enter or leave my flat. Even when he is stationed in different wings of the building, he has been harassing me in collusion with the other two Security Guards of the three wings of the building.

              The Secretary of Saraswatibai Bishwambharlal Charity Trust with its office address at 8 Maheshwari Mansion, 34 Nepean Sea Road, Mumbai 400026 has been wilfully neglecting the maintenance of the building Maheshwari Mansion. A pile of garbage is lying in the building compound on the rear side since past few days and even today under my flat in the building.

                The electric meter rooms of all the three wings of Maheshwari Mansion are adjacent to the lifts on the ground floor of each wing. The electric meter rooms of B and C Wings are being misused. Wooden doors have replaced the old collapsible iron doors of both the electric meter rooms. Garbage, plastic, wood, paper, cardboard boxes, etc., are being dumped into the electric meter rooms and the electric meter rooms are being used as garbage bins and store-rooms. Yesterday, at around 4 p.m., Jayesh Veera who is a resident of flat no. 32 in `C' Wing, handed to the security watchman of `C' Wing, two cardboard boxes and a bag and further instructed him to keep them in the electric meter room. At that time, I was ipresent n the lift lobby on the ground floor. Upon my complaint to Malabar Hill Police Station, two women police constables from Malabar Hill Police Station visited the site and the boxes and bag were removed from the electric meter room of `C' Wing. Just a few months ago, in March 2015, officers from Mumbai Fire Brigade had inspected the building for violation of safety norms in the building.
                This complaint is posted by me on 18th October, 2015 at about 7:45 a.m., and not on 17th October, 2015 as shown.

                  A Security Guard assigned by Master Security Force by the name of Bablu Pandey was not on duty as he was sent to buy cigarettes for Ghanshyam Mundra residing on the Ground Floor of Maheshwari Mansion. Complaints against Ghanshyam Mundra are already lodged by me with Malabar Hll Police Station.

                    A servant of Muktaben Mehta, a resident of flat 17 in `B' Wing of Maheshwari Mansion, has been playing dirty tricks on me . Several times he has caused obstruction and harassment to me, when I enter or leave the building for my work. The building has three gates on the footpath. When he again blocked my way intentionally today, on the footpath near the gate of `A' Wing, I called the Police Control Room. Three Police constables took the servant to Malabar Hill Police Station. My complaint was registered by Duty Officer Pramod Salokhe of Malabar Hill Police Station.

                      A garage being used by Sarla Madangopal Maheshwari and her son Manoj Madangopal Maheshwari is being used to store bamboo, wooden doors and empty cardboard boxes. They are now lying outside the garage below my bedroom and kitchen windows and balcony. A plumber Anand who is hired by the Trust was found entering my rooms in 1995 for which I had lodged complaints with the Poilice. Complaints were also lodged against Sarla Madangopal Maheshwari when she caused illegal construction in my flat with the connivance of my relatives. They are a threat to the entire buidling and the building Trust is also controlled by them. Beat Officers and Constables of Malabar Hill Police Station have inspected the site today.

                        A person is guilty of a public nuisance when he causes any common injury, danger or annoyance to the public or to the people in general who dwell or occupy property in the vicinity, or causes injury, obstruction, danger or annoyance to persons who may have occasion to use any public right. A common nuisance is not excused on the ground that it causes some convenience or advantage. Ghanshyam Mundra, his wife Suman Mundra and his two children who are occupying one room on the ground floor of B Wing in Flat no. 4 have been causing public nuisance in the building compound, ground floor common area and B Wing lift lobbyof which are all the common area maintained by the building trust. The wall of the lift lobby of B Wing has been broken at two places opposite the lift by these persons. The wall of the building near the window of the room they are occupying has been broken. The compound area which is used as a public way and is adjoining the footpath is used to play cricket by the son of Ghanshyam Mundra and his accomplices. Ghanshyam Mundra drives his motorbike on the footpath adjoining the building. Ghanshyam Mundra and his family are causing obstruction, danger and annoyance in and around the building, Maheshwari Mansion at 34 Nepean Sea Road in Mumbai.

                          Saraswatibai Bishwambharlal Charity Trust is the landlord of Maheshwari Mansion, 34 Nepean Sea Road, Mumbai. The Constituted Power Of Attorney who was the Secretary of the Trust and represented its four trustees Krishnagopal Bishwambharlal Maheshwari, deceased Madangopal Bishwambharlal Maheshwari, Hiralal Murlidhar Somani and G. P. Sharma used two names. It was upon his death on 25th December, 2011 at a Lions Club function at Babulnath in Mumbai, his true colours and his two names were exposed. He was from Vadodara where his body was taken for cremation on 26th December, 2011. He was the Constituted Attorney of the four trustees and represented them as Anirrudh C. Bhatt and his name in the Lion's Club at Nana Chowk, Mumbai was Arvind C. Bhatt. The Small Causes Court passed orders on applications filed by and against Anirrudh C. Bhatt in RAD Suit 2110 of 1994. Litigations against the Trust and its Trustees are still pending in Small Causes Court at Mumbai.
