Refund of booking amount

We had booked 2 villas in Spanish Villa, Vasai E project with Shantee Realty & Life Space on 16th November 2020. Before paying the booking amount of 2 lacs, 1 lac for each villa, we had researched and inquired about all our questions and doubts.
We had asked their salesperson Anupama and their other office staff about the possibility of an Indian toilet built instead of western keeping in mind the elderly at home. The team (Anupama and her colleagues) sitting at their Chinchoti site office, had promptly agreed to abide by this and a couple of other minor requirements. We were told that after 1 month of booking the villas, we need to write an application to the engineer in charge and request for the changes required.
Only after receiving this confirmation, we paid 2 lacs as the booking amount.
After a month when we went to their other office in Sargam Residency where we were asked to submit the application, the office person Mr. Dinesh Pal casually told us that if we make any changes it will lead to a lifetime problem of leakage.
Shocked at this revelation, we instantly decided to cancel the booking and were appalled as to why we were given incorrect information before and at the time of the booking. He mentioned he has been in the construction business for many years and has seen numerous such cases wherein if there are changes made to the drainage system, there will always arise a leakage problem and will sustain for life.
Dinesh Pal suggested we go to the site office and get this clarified. The people at the site office denied any such complications and spoke very indecently when we asked about the cancellation. We again went to Dinesh Pal and this time he too went back on his words. He said he had said there may be complications not necessary that there will be so don't worry and go ahead and buy the property. We obviously didn't want to risk buying 2 villas at a total cost of 80 lacs and then deal with leakage problems so we denied his NEW suggestion. He said we will need to write an email if we wish to cancel to which we agree and sent an email on 28th Dec 2020.
On 3rd Jan 2021, we received an email from Ashwin Dubey as below:
"Your application has been rejected as you have told us that you are unable to arrange the payment. As your flat was supposed to be sold, but unfortunately you have not received the full payment of your sold flat.
As per your application commitment you have failed to make the payment for the applied Two Villas.
Mr. Dinesh has agreed for the changes as per your requirement of Indian Toilet but you have cancelled the deal with your own wish.
We have suffered losses as you failed to make the payment and suddenly cancelled the deal.
Cancellation procedure is as per your application. Kindly note the same."
This means that we they will deduct a total of Rs.50, 000 and return only the Rs.1, 50, 000 after 12 months!
We were shocked and upset at this unprofessional and cheating attitude of Shantee homes.
It's been10 months now and we have been calling and chasing and visiting their offices only to not get any response.
The booking was done by me, Sheetal Ram Singh, an ex-nurse who has served in the government office for 40 years and is now getting cheated like this.
Please help.

builder denying to give society formation noc and conveyance

We are the owner of the premises in the building known as " sunshine green park building. No 2, 3 & 4 situated at village gokhivare, bearing survey no 226/227 hissa no 3 & 4 and s. No 228. Vasai east. Taluka vasai, dist-palghar. Its approximately more than a year, the builder is denying to give society formation noc and conveyance. We all are from middle class family small with children and aged parents, with great difficulty we have brought this house on bank loan, invested our saving to buy a home. This builder is cheating and harassing us mentally and emotionally.
We have registered complain in maha rera against the builder and fir also been registered.
Humble request if you can help us to fight for our rights and teach a lesson to these cheater types of builders. Pleassssssss helppppppp

been told to pay gst despite of paying all my dues before 30 june 2017.

I have paid my full agreement value for the flat purchased and also registration of the flat done before the implementation of the gst. I have paid the service tax and vat in full before gst. Now i am been told to pay the gst minus the service tax and vat paid towards the full agreement value. Please help me. Their contact number is given on their website. They also do not allow to speak to the proprietor or the director of the company. We have been informed that we are not allowed to meet or speak to the proprietor or the director of the company. harassing to pay gst despite of paying service tax and vat for the entire amount before july 1st 2017

Dear sir/madam,
My name is ruby roiden serrao residing at kurla west mumbai. I had purchased an under construction flat from the above builder shantee homes realty llp and head office situated at ground floor, shreenath bhaven, 60 feet road, near indu hospital, k. T. Village, off. Ambadi road vasai west, pin - 401202. The project is located at father wadi vasai west know as sunshine green park. My flat no is g6 ground floor a-wing. My complaint is that the builder had delayed in getting my registration done and now they are asking me to pay gst which is i am not applicable for. I had paid rs.51000 as nft as booking amount on 23 rd may 2017. Since that day we use to call the builders office on a daily basis to get the registration of the flat done. They were delaying the process stating that person incharge had gone on a leave and so need to wait. When he came back from leave we were informed that we cannot register only one persons flat as we would do it on a bulk basis and said to wait to get the registration done. Everyday we use to call the builders office and complaint about them delaying the process of registration as we would be applicable for gst. They would always assure me that i would not get charged the gst. So they took the service tax and vat on june 19th 2017 on the entire amount of the agreement value. I have all the receipts and payment details of it. I had taken almost 99% home loan for which we had to get the amount from the bank. My registration was finally done on 26th june 2017. That is delay of almost a month in getting my registration done from the booking date. The bank finally gave a bank draft dated 29th june 2017. The bank reference was given by the builder as the bank was through them and they are closely connected. So despite of the construction still being on 70% work done, the bank had given the draft of the full remaining balance amount of the agreement value as of draft dated 29th june 2017 to the builder. I not sure how this was possible as banks normally give the payment as the percentage of work done. However my main issue is that they are now insisting us to pay the gst despite of them delaying the registration and also they had assured that they would not charge the gst as we have already paid the service tax and vat earlier then the gst implementation. They are now harassing and sending us demand draft for the gst and they have send us twice. We complaint about it but they would not listen stating that they have received the bank draft on july 13th 2017 which is incorrect. As we had spoken to the bank representative on 29th june 2017 and he said that the bank draft was given to builder. The bankdraft of the full amount was dated 29th june 2017. Well the main concern is that due to their fault in delaying the registration we have been penalised to pay the gst. This is inhuman and mental tortured as they had deliberately delayed the registration and now asking us to pay the gst. We have paid the service tax and vat on june 19th 2017. After july 1st that is the implementation of the gst we were called at the office on 16th july 2017 and they gave us a receipt a proof that we had paid them the service tax and vat and so we don’t have to pay the gst and only and society charges and maintenance is left to be paid. I would be attaching the proof of the payment done and also a receipt which mentions the vat and service tax paid and only society charges and maintenance charges are left. So please look into this matter as they are trying to extort money. I am feeling i should penalise them a huge penalty for playing games with the customer and trying to extort money. I would advise the consumer court to decide the penalty on such builders so that this will set an example to other builders to not to try to cheat the customers.
