[Resolved]  Axis Bank Home Loan Account — Bounce charges twice

Hi

Loan account:

I am paying my instalment of home loan to AXIS BANK every month since last 2 years through ABN AMRO cheques. Last month when my ABN cheque went to AXIS bank for clearence they bounced it saying that signature is not matching and deducted charges for cheque bounce.

Till this time it was fine, i am ready to pay the charges if my signature is not matching because it is my fault (I have not seen my cheque and signatures till yet though). So i submitted the cash of my instalment amount in lieu of that cheque bounce direct to AXIS BANK.

But the problem arose when AXIS BANK again presented the same cheque for clearence, which was again bounced due to same reason of signature not matching with bank charges again deducted.

I know and understand that bank has to present the cheque twice but that is the case if the cheque was bounced first time due to the reason of insufficient funds, thinking that may be till next time customer submit the necessary funds.

But can somebody explain me that if the cheque has been bounced for the first time due to signature mismatching, how could the same cheque will clear the second time. Obviously that cheque is bound to be bounced beacuse god will not come on earth and make corrections in the signature before presenting it for the second time.

And again the second time also bank charges have been deducted.

I request the bank to please look into this and refund the charges they have taken second time because the cheque bounced due to signature difference cannot be submitted for the second time for clearence.

Also can you please send that bounced cheque back to my address so that i can see my signatures and stop submitting the same cheque again and again to take bank charges from my account.

I know that banks are going through bad credit crunch situations but that does not means that they should do illegal things to get money from customers.

If this is the policy then Banks should change the policy for the cheque bounce due to signature mismatch because no-one in this world can clear that particular cheque no matter how many times bank submit it.

But yes if banks want to make money they can present it as many times as they want. Good job done guys.....

Thanks for reading.

Ref: Arindam Mishra Loan account No. [protected]
Loan sanction on 17th November 2006 from your Jamshedpur branch for
taking flat No. 1934, Vijaya Home Maker Pvt Ltd (CCA), 2nd floor,
Gajraj Mansion, Bistupur, Jamshedpur

Sub: Non-disbursement of instalments agreed by you to the builder, M/s
Vijaya Home Maker Pvt Ltd, jamshedpur.

Dear Sir:
This refers to the subject matter cited above regarding disbursement
of instalments due on the respective dates already provided to you
during processing of my loan amount to be disbursed to M/s Vijaya Home
Maker at the appropriate time.

I have received an advise from M/s Vijaya Home Maker Pvt Ltd,
Jamshedpur that the instalments due to be received by the on the
respective dates already intimated to you were not deposited by you in
time. In view of this, they had intimated me that an additional amount
of Rs. 52, 289.23 is to be deposited immediately by me.

My contention is that, the delay on your part in disbursement of
instalments due to M/s Vijaya Home Maker Pvt Ltd in time was not made
by you made me to pay the additional panel interest calculated by the
has comes to Rs. 52, 289.23.

In this connection, M/s Vijaya Home Maker Pvt Ltd has informed me that
unless I pay this panel interest, they are not going to hand over the
flat within the specified scheduled time and they have unduly delaying
handing over the flat more than one year.

In view of the above, for no fault of mine, I had to face lot of
mental agony and financial burden, is purely on the part of the
bankers delay in disbursement of instalments. Therefore, I am once
again requesting you that this additional amount of Rs. 52, 289.23 is
totally, to be borne by you.

However, after a prolonged negotiations with M/s Vijaya Home Maker Pvt
Ltd, they had agreed to reduce the panel interest to Rs. 35, 000.00,
which has been paid by me on your behalf.

Since I had already paid this additional panel interest (negotiated
amount), I would request you to adjust with one of the instalemnts and
credit this amount to my account, under intimation to me.

I am once again requesting you that the instalemnts that falls on the
respective due dates are strictly adhered or otherwise, M/s Vijaya
Home Maker Pvt Ltd, will not entertain any further about handing over
of the said flat.

Your personal intervention in the matter is very much required and see
that the instalemnts are paid regularly well within the specified due
dates.

Finally, I am once again informing you that this additional panel
interest imposed by M/s Vijaya Home Maker Pvt Ltd is purely on the
delayed payments made by you. Therefore, this additional burden needs
to be borne by you only.

On enquiry from your Jamshedpur branch, they are still scrutinizing /
verifying why this delay has occurred in disbursement of instalments.

Kindly looked into the matter and advice.

With regards,

Arindam Mishra
