[Resolved]  Dalmia resorts — time share property unit of which is sold does not exist

More than a decade ago I bought two units of Manali Dalmia Time share .
I was promised property would come up soon. till then i could use the exchange scheme and use other properties of the company.If we use other properties the charges of electricity etc are more than the existing hotel rates of that area.
The property has not come up in all these years and there seem no liklyhood, as there seems to be some dispute.may be the dispute existed before the timeshare was sold to me.
The company has refused to refund money.But tried to persuade to change it into some other property of the company, which i dont want now.
Can someone guide me
Has there been any other court case/ decision on any similar case.

I AM A SIMILAR SUFFERER OF THE FRAUD PLAYED ON ME BY AN EXECUTIVE OF DALMIA RESORTS.
I request all time share holders to unite and take the fight to its logical destination.
We are suffering at the hands of the management of Dalmia Resorts. In March Dalmia resorts sent us a hefty bill of 39000 towards AMC plus 18% interest since 2007. They apparently referred to a letter of 2007 which we never received in which they indicated they will charge an AMC of Rs 3500 each year, even if we do not avail of the time-share. I believe it is a conscious strategy of Dalmia resorts to suddenly stake a hefty claim on the unsuspecting time-share owners so that they can forfeit the time-share from the owners as they will not be able or willing to pay the hefty amount. We have a timeshare with Old Anchor Goa. Would like to hear if others had the same experience and how they dealt with it.

We have just received a similar letter from Dalmia Resorts asking us to pay up the maintenance dues. We had replied to their demand letter in 2007 stating that Dalmia Resorts should first take suitable measures to build up trust amongst the timeshare owners in view of the fact that the company and its resorts are in shambles and have been thus since 1998. We would very much like all time share owners to get together and fight the management so as to force them to first actually restart the timeshare company for all practical purposes and then come back to the owners for help

I never got any letter till date, but was foolish enough to pay AMC charges for 2 years. Now they have sent an email claiming that I should pay about Rs.189000/= but have been generous enough to make it Rs.30, 000/= @Rs5000/= per year per unit week. That makes Rs.2, 50, 000/= or more per year maintenance charge for the shoddily maintained rooms.

Dalmia Resorts is a fraud and cheat organization.
They never sent any letter to me too which they say they sent in 2007.
Obviously I am going to take action against them.
Got a mail today after I said I would like to surrender and spend my time doing better work.

They say that I have malafide intentions.

We are in receipt of your mail Dt.08.11.12 and we would like to take liberty in reminding you that you without prior information visited our resort in the high season, when you happen to be a member of middle season. You were accommodated by the staff in the front office as a Hotel guest, only while checking out your/guests revealed their identity, of being a time share member of Dalmia resorts. As an afterthought to conceal your malafide intentions you are blaming the company of “the 4 inch thick mattresses were 2 inch thick”.

Please look into the clause:-

“PROMOTER:-

The Promoter shall maintain the Resort cum Hotel under and in accordance with the following proposed agreement:-

Under the proposed Maintenance Agreement

“Under the said proposed Agreement, the Promoter shall maintain all sold Unitweeks/Units/unsold units, the Unit amenities and the following facilities.

The promoter shall maintain these items including common areas from and with the help of monies lying in the Maintenance Fund.”

“All the unsold Units shall be maintained from the Maintenance Fund”.

& still people like yourself do’not pay their AMF & AMC dues and it goes to the credit of the promoter that today, our resort, which was a 3 star property but has been rated by classical Holiday Pvt. Ltd. as 5 Star by the side of the Leela, Taj, Doona Silvia etc. etc.

We request you to please mind your language and we can put you to strict proof for any accusation on the contrary, we are entitled to claim damages too.

However we accept your wish to surrender your unit week.

As desired by you in accordance with the rules & regulation there is a balance amount of Rs.161, 077/- to be paid by you to D.R.I. But upon surrendering the document of your membership we will be pleased to square up your total account against your surrendered documents.

As per clause (c) of 90 Rules and Regulation of the Club.

The clause reads as:-

“Failure to pay the Annual Maintenance Fee will attract interest at the rate of 18% per annum for the First six months, thereafter at the compound rate of 24% per annum for the following 6 months & thereafter at the compound rate of 30% per annum, all calculated from the date the amount becomes due till the date of actual payment. And until the said amount together with interest thereon remain unpaid, the member shall not be entitled to exercise his rights & privileges & promoter shall become entitled to use such Member’s Unitweek at such time and in such manner as it deems fit and shall be entitled to recover from the income, if any, there from, all such amounts including interest thereon together with each and all Charges/Fees/Levies as may have accrued to the Promoter with respect to or connected with such Member’s Unitweek, the recovery method/proceedings adopted by the promoter and the promoter shall pay the balance, if any, to such Member.”

As per the above clause we have prepared your statement of account which is enclosed herewith for your perusal.

In case you submit your documents for surrender we will simply square up your account against our dues. And you will be exempt from the above liability. In case you fail to surrender your documents, “you the Vacation Owner shall continue to be liable for all dues owed by the Vacation Owner to DRI which dues the Company or as the case may be DRI is unable to recover from the said proceeds.”

Please surrender all your documents at the earliest for us to do the needful.

Yes, I got exact similar letter Dalmia Resorts p ltd demanding payment of maintenance charges with interest for my one bedroom time share in old Anchor Goa-Resort. There is no justification for their demand.From 1987 to 2007 there is demand for such a maintenance. Apparently they have a clause in the fine print that enables them to claim such charges. These people are running a scam scheme.
First they make it difficult at every step, and then they rent the vacant time shares (Through their website) and pocket the money. They should in effect should(ethically..which they are not)credit the owner of the Time share after deducting their charges/commission.

It will be in the interest of all Time share owners to take up with Consumer court /Competition commission or in any other court.

I have a time share week of Dalmia resorts in manali for high season ( June 2nd week )which for whatever reason has not been made till date. Further I also have a week at Goa for high season (1st week of march) which Iam not able to utilise as the property has been in shambles for a long time. The sales executive while selling me the two bed unit in manali had offered to sell our goa unit at a premium so that we could use the funds to pay for the manali unit. While we paid for the manali unit the sales executive conveniently let his job and in the process we were suckered into holding two time shares of which none were usable. Need advice on how to go about getting our claims from the company.

Dear Time Share Holders,

I too is a sufferer of abnormal annual maintenance charges being demanded by Dalmia Resorts citing certain fine prints clauses of the agreement entered between vacation owner and Dalmia Resorts. I have been requesting the company to help me in disposing off the time share I have in Tirupati Property but no help came forward. It appears that few executives of the company are misleading the promoters i.e. Dalmia Group. Dalmia Group was known for adopting ethical business practices as also known for their generous philanthropist activities. Promoters should come forward to help small investors who have invested their hard earned money by refunding their deposit amount and take back the time share. I believe, Dalmia Resorts have three properties - one at Goa, other at Mussorie and one at Tirupati.and they can a good price on disposing off the properties.

Can some one or the company's promoters help me as neither I can not afford to pay abnormal annual maintenance charges nor I am interested to retain the vacation ownership at Tirupati Property? So far I could use the facility only once. in last 17 years.

I am an owner of Dalmia resorts Goa time share unit. Time share was sold to me in 1993. I have the regd. Time share certificate and title deed.
I have gone there and stayed 2 times before 2007.
In 2009 they have asked for a big sum as Annual maintenance charges arrears for past years .
in 2014 they said they are forfeiting the ownership .as per the original agreement there is no need to pay AMC every year.
When you go there you pay. Otherwise they will sell my time share and earn.
What is the way to reclaim my interest in the time share. Ownership was perpetual on the property.
If any one of same predicament I would like to join for getting back my interest in the property
