[Resolved]  Flat Booked With BPTP Resort Faridabad — URGENT:NEED HELP AND ADVISE TO RESOLVE A DISPUTE AND HARASSESSMENT BY BPTP

I HAD BOOKED A FLAT WITH BPTP ONE OF THE REPUTED BUILDERS.....IN THEIR PROJECT RESORT IN 2008.WHILE BOOKING A FLAT WITH THEM MY PRE-CONDITION WAS I WANTED ONLY A GROUND FLOOR.... AND THEIR MARKTING MANAGER MR.RAJAT VIR SINGH PERSONALLY INTERVENED AND PERSONALLY SANCTIONED A GROUND FLOOR UNIT NO CG-001.I HAVE A RECEIPT PERSONALLY SIGNED BY HIM.

I SUBSQUENTLY RECD AN ALLOTMENT LETTER FROM THEM SAYING THAT I HAD BEEN ALLOTED A GROUND FLLOR AND RECONFIRMED THE UNIT NUMBER AS CG-001.

THEREAFTER I RECD MANY LETTERS ASKING FOR PAYMENTS(SINCE MY PAYMENT PLAN WAS CONSTRUCTION LINKED) SAYING TOWER C WAS REACHING BASEMENT LEVEL AND CONSTRUCTION WAS HAPPENING ON TOWER C....ALL PAYMENTS WERE MADE ACCORDINGLY.

NOW SUDDENLY IN NOVEMBER THEY SEND A LETTER TO US SAYING THEY NEEDED 8 LACS MORE(I HAVE ALREADY PAID THEM 14.52 LACS SO FAR) BECAUSE BASEMENT SLAB FOR TOWER A HAD BEEN COMPLETED AND MY FLOOR A-2001 WOULD SOON HAPPEN...I THEN CALLED UP THEIR OFFICE TO KNOW WHY THEIR LETTERS WHERE REFERRING TO CG-001 AS A-2001....TO MY SURPRISE I WAS TOLD WELL "YOU ARE NOW ON THE 20TH FLOOR SINCE WE HAVE REALLOTED ALL FLATS BECAUSE TOWER C STANDS ABONDONED...."

A SHOCKED ME... WAS THEN REFERRED TO HARJESH JOLLY BY MR.RAJAT...BECAUSE ACCORDING TO HIM ..HIS JOB WAS ONLY SELLING THE PROPERTY AND WITH THAT HIS REPONSIBILITY FINISHES...AND FOR ANY OTHER AFTER SALES PROBLEMS MR.HARKESH JOLLY WOULD RESOLVE.

WE CONTACTED HARKESH JOLLY...HE SAID HE WOULD SEE IF SOME ONE IN TOWER A WAS READY TO EXCHANGE WITH OUR FLOOR SINCE HE ACCEPTED WE OUGHT TO HAVE GOT A GROUND FLOOR...

WE WAITED FOR A WEEK...AFTER A WEEK WE RECD AN E-MAIL SAYING THERE WAS A GROUND FLOOR AVAIALBLE IN TOWER B...HOWEVER THAT TOWER WOULD COMMENCE ON SOME UNKNOWN DATE...AND IF THAT IF I AGREE I SHOULD WRITE BACK GIVING THEM A NOD AND THEY WOULD CONFIRM THE SAME THROUGH A LETTER...

WE WROTE BACK SAYING IT WAS NOT ACCEPTABLE SINCE I NEEDED A GROUND FLOOR IN TOWER A ....WHICH WAS ALREADY UNDER CONSTRUCTION AND NOT IN A TOWER THAT WOULD COMMENCE SOME WHERE IN THE FUTURE ...SINCE APYMENTS WERE MADE KEEPING IN MIND THE FACT THAT CONSTRUCTION WAS ALREADY UNDER WAY...

THEY DID NOT EVEN BOTHER TO ACKNOWLEDGE OUR MAIL AND INSTEAD SENT A NEW ALLOTMENT LETTER ARBITARILY CHANGING MY UNIT FROM CG-001 TO B-002.....

WHEN I SPOKE TO HARKESH JOLLY AND TOLD HIM THIS WAS NOT ACCEPTABLE AND THAT WE WANTED A GF IN TOWER A OR OUR MONEY REFUNDED HE SAID" GO DO WANT YOU WANT....WE WILL NOT DO THE NEEDFUL....CONSUMER COURT OR THE PRESS NOTHING WILL MAKE US CHANGE OUR DECISION...


WELL MY QUESTION IS WHY SHOULD A CONSUMER BE FORCED TO ACCEPT ANYTHING...COULD YOU PLEASE INTERVENE AND HELP US GET THE REFUND WITHOUT DEDUCTIONS OR A GROUND FLOOR IN TOWER A...

MR.AMIT JAIN IN BPTP IS THE PERSON WHO HAS ALWAYS TAKEN SUCH ARBITARY DECISIONS AND WE WOULD REQUEST YOU TO KINDLY TAKE THIS UP URGENTLY AND GET US OUR DUES...OR WE WILL HAVE TO MOVE THE CONSUMER COURT.I HAVE ALL THE CORRESPONDENCE NEEDED TO SHOW HOW THEY ARE BEHAVING WITH THEIR CUSTOMERS.

EXPECTING A REPLY/SOME ACTION SO THAT I CAN GET A REFUND FROM THESE CHEATS

BPTP cheated me as well..have filed a consumer complant..final hearing tomorrow after 2 yrs of wait..let see what happens

THIS IS REGARD0ING THE BPTP RESORT PROJECT
BPTP Project is reduced and have no date of completion. We dont know which of the six towers are being constructed out of 22. We dont know where we will be relocated in the barren land of 28.5 acre of land with only one- fourth construction. Their changed, shrinked and delayed construction plan is not disclosed to investors.I too FULLY AGREE that we are helpless middle class investors with our hard earned money at stake. Several visits to Delhi office and several trials to contact them has mentally, physically and financially tortured us. We have no faith left at BPTP .Can BPTP transport us to anywhere... They promised us township project which they are not giving us. Is undertaking signed by us of minor changes enables to gulp our money. Kindly help us to get our money back with interest. As they say refund is not their policy BUT they can change the plans of delivering promises.

Hi, I too had booked a flat in BPTP Resort. As per the previous plan I had opted for a flat with balconies facing east. Recently i received an update where it was stated that construction plans have been changed. Now my balconies will face west. I dont know whether my grievences will ever be entertained.
We can only wait and watch...

Hi, I have also booked a flat like all of you in resorts, i was also reshuffled couple of times, i am really very fed up by ther construction and delivery. As said above this is a very hard earned money by all of the middle class people which is being treated very badly. I want that something should be done to get our money back, as after seeing the location i dont feel any development will take place for another 10 years or so. Or i would feel the site should be rellocted to some another good developed place where we get worth of our money. As all o[censored]s know that they sold this project at high rates and the project they started after this are much cheaper. We all people who have purchased flat in BPTP Resort should meet someday together and finalise what to be done, but it should be all... meeting together
I am ready to form a group to negotiate with BPTP... They are building only 25% of the project so either they should reduce the price of our flats or else should not demand any money till they complete the project as a whole ie 28.5 acres
I agree, lets group someday and also I was not able to locate Facebook community.

yes we all who have invested deserve to know when is the date of possession/completion as they keep changing the dates on us.like i understand from this blog they are only doing 25% construction of what they originally wanted to do and i am fine with that as long as they dont sell the rest of the land to another builder to build and make our community cluster fobic and take away the green land and also since theu are less flats being built we will unfortunately have to pay more maintainess per resident household cause originally more people/flats would have been there to share the overall maintainess cost of the community like exteriors/exterior electricity/cleanliness ect.can someone who live closer look into it and let all o[censored]s know?
Infact have they already told us how much our community maintainess dues are? home owners association fee?

Thats scarey now that only 25% of the flats are being built. its nice to have more greenlands as long as we are not being penalized into paying higher dues every month/year.
And i could find the face book page either please give me the name for it and lets all join hands against the builder and form a community so we can get our answers from those builders,

I have the same problem.

Customer Service, is bad. I purchased a flat a few years ago, in the BPTP Resort. At the time of signing, I was allotted a flat which we agreed on and as time went on, BPTP changed the original building plans several times and shuffled us from our originally allocated flat to the 20th floor. After dealing back and forth with different customer reps, (Manjushree, and her peers who have now left BPTP), we were moved to another unit.

In the past few days, it has been brought to my notice that we are required to pay a preferential fee for the corner unit, and couple of lakhs due in a few weeks or else there would be a penalty.

I am extremely frustrated at the lack of customer assistance, and sensitivity shown by BPTP. My complaints are as follows :

1. To begin with, the project is delayed and this was not communicated with the customers.
2. Second, BPTP should not have built 8 extra stories on a tower originally designed for 12. as the facilities will be stretched to meet demand. For example. BPTP have not doubled the elevators that will be used to commute residents. This short sightedness has raised my concern on what other shortcuts BPTP have implemented.
3. We were moved without our prior consent and after a lot of back and forth, finally settled on a floor but now recent communication from BPTP indicates must clear the preferential fee
4. Last by the most critical, BPTP cannot send a letter a few weeks ahead of a due date. I am not a resident of India, and I have no means to immediately send this amount. We have been in the dark on the project progress, and BPTP has not I REPEAT HAS NOT BEEN EFFECTIVE in their communication with us.

There are no updated floor plans and building plans. What are the new completion dates? When is the soccer pitch being completed, the spa, the clubhouse, swimming pools etc?

They have not shown any sensitivity towards their customers! I am looking to invest in more properties residential and commercial - why would I use BPTP now? Why would I recommend BPTP to my business social network? Reputation and branding are the most important factors - and theirs is compromised.

Frustrating - my next properties will be with their competitors.

I am also facing the same problems and want some help as our hard earned money as a middle class is being explited like anything.
i too booked a flat in bptp resort in 2008. now after three years .they levived a huge penalty at 18% and which is very huge and unjutified, they cancelled my booking and asking me book at new rates else surrender ur money. these bptp are making peaple fool . friands time has come to put a brave front against them in unisom. see what happened in DLF case. if we all make united stand, surely we can win and justice will prevails.

I have same complaint and now bank is already started my EMI even thou it was in the agreement that they will start EMI only after we get the possession.Did anyone else started paying the EMI?
agree, we are also in the same boat unfortunately... original allotment changed without notice... no new completion dates and EMIs started. Can someone take the lead and file case in the consumer forum? we can all pay for us to be represented.
