[Resolved]  Flat — complaint against builder

I have purchased from Manmohenshree Associates in
2005 & Paid Rs: 20000.00 towards Maintaince so for i have not received
the
Maintainance Receipt .Builder has showen club house as amanities in the
advertisement for the sale of the flat but since the date of purchase
he
converted he club house in to his permanant office . He has formed the
soscity in 2005 but he is not handing over the soscity to us after so
many
times request made by the members . For the maintaince amount collected
from members he is not getting the books of accounts audited & so for
he
is not called for the general body meeting .So many cracs found on the
wall after makeing complaints for so many times he is not taking care
of
the complaints . He is keeping the students in the flat on rental
basies
& spoling the image of the soscity .

i have purchase from Balaji Swaroop Associates in year september 2008. i it was told to the builder that the entire payment will be through loan only, no cash will be given . The builder agreed for the same .i was working with a bank every thing was fine . but due this recsssion i lost my job and by this time about 90% of the flat amount was paid to the builder, by cash & cheque . in the begening it clearly mentioned to the builder that i wont be able to pay any interest if i am unable to pay the entire balance on time, builder said Ok first you arrange for the remaining Balance, any who im have manage to arrange the funds from my family & friends

NOW THE BUILDER I DENYING TO GIVE THE POSSESSION OF THE PURCHASE FLAT, SAYING THAT YOU NEED TO PAY THE INTEREST / PENLATY DUE TO DELAY IN PAYMENT . I IT WAS CLEARY SAID IN THE BEGAINING I WON'T BE PAYING ANY INTEREST THOUGH WHO MUCHTIME IT WILL TAKE TO CLEAR THE REMAINING BALABCE .

THE BUILDER IS NOW ASKING TO PAY 155000/- Rs as a interest Or i will not give the possession at any cost and said do what ever you can.

Flat — delay in payment of sell flat

I sell my flat to mr. fadtare
our registration copleted on 22 feb. 2008
almost three months are over but he did not pay me balance amount due to his loan delay.
In our agreement I am not mention the ti, ing period of balance payment, shall i agiable for interest from agreement date to full settelment. what can i do now?

Flat — Builder blackmail us for buying a car parking

I have purchase a flat in Kamal Park, LBS road, bhandup, with adjoining terrace. All the aread including terrace has been mentioned in the agreement. Now as I want to build up a shade which was agreed by builder when he ask me to buy this flat, now denying the permission and ask us to buy a parking first.

Can anybody tell me, does the permission of builder is require in this connection.
Bu Bhandari Acolade Builder asking for 1 lakh as transfer fess and not giving any receipt too.Agreement states Rs 10000 as original transfer fee but there people at office demand 1 lakh and that too in black .IS it justified. Nor giving any receipt for Maintenance too.
Parking problem still exist from 2 years in BU Bhandari Acolade situated at kharadi.

Builder — Complaint Against Builder

Dear Sir,

I have being allocated a house as per as Slum redevelopment act. The slum was taken for redevelopment by a builder in Thane. He has promised on few things that he Will be giving me in written all this promises are part of the agreement done with him, but now he is not ready to fulfil his promises.

My question is will you be able to help me in this case if so i will write the whole thing in details. Secondly is your decision considered legal by the court of law?

Flat — Disaster by ANA group

I am resident of Amravati Enclave Panchkula, constructed by ANA group. All the complaints that I have seen on this site are facts. Promises that have been made by the authorities of ANA group are not being fulfilled. So I request the concerned department to take the immidiate action on all these complaints as early as possible. Otherwise ANA group will mess up the things for their own selfishness and greed.

what care i must take while dealing with builder
I have purchased a 3 BHK flat in Sector 89 Faridabad from Ferrous Infrastrcuture Pvt. ltd., 1st Floor, Block -B, Vatika Towers, Golf Course Road, Sector-54, Gurgaon-122002. This builder is failed on all aspects of earning customer confidence due to the poor management. As I have paid update payments even then this builder has manupulated the things to earn extra money from me details are as under :

1) Collected Fourth installment in advance which is against the agreement.
2) Imposed wrong interest by changing demand letters
3) Wrong demand letter send to LIC housing Finance without my consent this is big fraud. and collect Rs. 48112.00 which was adjusted by the builder by changing open parking to covered parking and balance in interest without my consent and knowledge. This shows the honesty of the Builder.
4) Builder is forcing me to take 5 KVA but 3 KVA is sufficient from 3 Bed Room as per agreement (Min 3 KVA and Max 10 KVA).
5) Builder is also forcing to take club membership but I have purchase a flat not a club
6) No reply of serveral letter written by me. This shows deficiency in services and staff are suggesting me to go to consumer court.

Beware about this builder. Thing 100 times before investing. Those who have invested in Ferrous Infrastructure, kindly join hand to recovery the excess amount of Power back up and Club Membership from the builder.

Chowgule Real Estate and Construction Company Pvt. Ltd. (CREC) have developed Plots and residential Flats at Zorint, Zuarinagar, known as Chowgule Gardens, which comes under the Funnel Area of the Naval Air Base at Dabolim, Goa.

CREC has obtained N.O.C. from Navy vide letter No. 15/143/20 dated 18/11/92 by Flag Officer Commanding, Goa Area (FOGA). Under point No. 3 of the said letter it directs, “You are also requested to submit fresh applications if plots are allotted to different individuals with Site Plan and Building plan for final approval before undertaking any construction at the site.” And under point No. 4 the said letter says, “This Headquarters have no objection for development of plot without undertaking any construction.”

However, CREC has constructed 10 buildings with 114 numbers of residential flats and sold the same. Recently it has come to the notice of the residents that the FOGA NOC letter dated 18/11/92 does not permit construction on the Plots and CREC has not taken the final approval of Building plan as directed in the letter.

With real estate rates soaring, some residents are in a hurry to sell the flats and move to a legal dwelling elsewhere so as to escape the consequences of not having a NOC from FOGA or with fear of demolition of the buildings in the future.
Chowgule Gardens is a buitiful place to stay but the Builder has not taken the NOC from Flag Officer Commanding, Goa Area for the 10 buildings consisting of 114 flats falling under Funnel Area of Naval Air Base at Dabolim, Goa.

Should I sell the flat and move, will the building be demolished by the Navy.

Flat — Cheating customers

I have booked an apartment in Pavani Oakridge project at Kundanahalli , Marthahalli, Bangalore. The builder cheated me. He is neither alloting the flat nor giving back the booking amount. Beware of Pavani Builders....

I have booked a Ground Floor with M/s Ferrous Infrastructure Pvt. Ltd. in their project BEVELARY HOMES in Sector 89, Faridabad (Haryana). I paid 25% booking amount. The company issued me flat buyer agreement, receipt and other papers but now this builder is forcing me to accept Second Floor. It is not understood when I have booked Ground Floor and paid 25% booking amount for this booking then why the builder is forcing me to accept Second Floor. The builder has further sent a demand letter for 20% but I have denied to make the payment until unless ground floor is being allotted to me. The builder is threatening me by sending notices for cancellation of booking and forfeiting of booking amount. I am very much upset. I have paid all my savings to this builder for booking of ground floor but now he is cheating me. It is truth and if do not allot me ground floor or refund my money then I have no alternative but to commit suicide and only this builder Ferrous Infrastructure will be responsible for all this.

Dear Friends, you see the mentality of this builder. The builder is completely fail to maintain the customer relationships. The management of the builder is very poor. The mentality of the builder is only to earn money by hook or crook. Very stick on paper work only for customers but ZERO for himself.

So dear friends, think 1000 times before you book any flat/property with this builder. Trust me, whatever I have written is 100% correct. I am the real sufferer.

I HAVE PURCHASE A FLAT AT MEDANKARWADI IN CHAKAN BUT SHOCKED TO SEE THAT THE BUILDER IS TOTALLY CHANGED AFTER I PURCHASED THE FLAT.HE IS TAKEN 75% AREA OF THE PROPOSED GARDEN TO SELL IT TO THE SOME OTHER PERSON FOR HIS PERSONAL INCOME.EXCEPT THIS HE IS NOT PROVIDING THE FLAT OWNERS LIGHT, DRINKING WATER COMMON PASSAGE, NO SECURITY AND NO GATE OF THE SOCIETY.WHEN WE SAY HIM SOMETHING HE ONLY DEMAND'S MONEY IN THE NAME OF MAINTENANCE CHARGES WHICH HE IS NOT PROVIDING AT ALL AND TELL US DO WHAT YOU WANT TO DO.BY THE SIDE OF 25% GARDEN HE HAS MADE TOILETS FOR HIS WORKERS WHICH IS SHOWN DAY AND NIGHT FROM FRONT VIEW OF THE SOCIETY.IN 25% OF THE GARDEN SPACE THEIR IS ONLY JUNGLEE GRASS AND NOTHING ELSE.

ANYBODY PLEASE HELP WHAT TO DO REGARDING THIS BUILDER
