[Resolved]  ICICI Bank / Car Loan — Rejection of settlement request of a loan on a car that got stolen and freezing all funds in my ICICI savings account

I took a CAR Loan from ICICI BANK which I couldn't pay regularly after around payment of 24 EMI out of 36 EMI. I had financial problems which made me late on payments,but when I wanted to start catching up on payments ICICI would not accept any payment less than the total EMI due on the loan.It would have helped if they allowed more flexible payment option to get upto date.
Now when I'm trying to settle my loan on which I have a principal+interest due of only Rs.53300,they have rejected my request and frozen my ICICI savings account in which I have Rs.107772.75. This is totally extortion just because they can freeze my savings account.
It's just good faith that I want to settle the loan even though I have lost the car and I have also forwarded a copy of the police complaint for the stolen car.I had submitted a request to settle the loan for the outstanding principal Rs.48358.93.But ICICI rejected stating that now that they have placed a lien on my savings account which has more than the principal they are rejecting the settlement request.

Kindly help me and save me from this extortion, as I have 4 dependents including my parents.I can't even afford education for my younger siblings.
I know ICICI will not stop their extortion.They will keep charging me fee and ask me for more money sometime down the line.
Please save me from this extortion.

ICICI BANK — Car Loan

I have taken car loan from ICICI bank in 2005, LAN Number : LADEL[protected], I gave post dated 59 cheques till March 2010 on demand of the bank.There is sufficient fund in my account .But now I am getting calls from ( sometimes it mount to threat) that I am a defaulter and will face the consequences if not pay the EMI. When I asked ICICI bank give me the reson then they said that the cheque has been bounced because of insufficient fund, which is not a fact at all.I conved that there was sufficient fund in the account so give me the right reason, but they have not given any reason so far.
Please guide me what I should do ?

i totally agree with it. even i have an issue where in i have taken a car loan from ICICI bank. and while taking it they communicated a to me that 10.5% would be the interest rate(flat). and the loan amount they have given to me was Rs225000. i also confirmed with them that there is no other charges apart from those. as after getting the loan i didn't receive any documents from them, i called up customer care and requested a copy of the loan agreement and the cover note. where in after a month i have received the loan agreement but never received the cover note. however when i checked the agreement, i was shocked and found that the loan amount shows is Rs245000 and the rate of interest is 11.5%(flat). and it was unbelievable that when i spoke to one of the managers in the car loan sales branch, they says that it was my responsibility to check before taking it and ultimately blamed on me which is just nonsense. somebody please tell me that is it not their duty to intimate the customers? they are in banking sector. we are from IT. but does it mean that we are fools?

And then i stopped paying the EMI's of my car taken and one more very important reason is i lost my job which i have intimated the bank by calling them the same day. And these , whenever they called me, i have kept them informed and updated always. and now after a few months i trusted them and informed them that i will pay the EMI's as promised and will continue with the loan. At the same time a few rowdies from the Bank caught me in the middle of the road and tried to hit me and forced me to mentally and physically to sign on a paper and took my vehicle away.

When consulted the collections manager. he says that it cant be settled. where in he says that he will auction the vehicle and i have to pay the rest of the amount apart from the auction amount which is unfair and nonsense.

Here, kindly notice that the error and the mistake is from their side which they are not ready to accept. In fact they are blaming the customers from whom they are eating.

SO ALL OF YOU PLEASE TELL ME THAT DO WE NEED SUCH BANKS IN INDIA WHO EATS FROM US AND BITES OUR OWN BACK. THEY ARE FOOLING INDIANS.

So even i have decided to file a case against ICICI bank. as they are fraud and cheats INDIANS, we should prove that we dont need such banks in INDIA.

I have a couple of people in media and also in the law. So if any of you INDIANs are facing such problems, kindly approach me immediately in my contact no given below. i have updated the same in a few more forums.

ICICI — Regarding Settlement

I have done the settlement on my ICICI bank credit card No:[protected] and paid full settlement amount in three EMI . But I have delayed two EMI. Finally I had paid all three EMI. Still I am getting statement and Amount is going to bigger and bigger. This amount is totally interest. My original settlement doc is attached here. Please advise me

I have got the following email reply from ICICI bank. they are asking for another settlement .Please advice me

Dear Mr. Sawarkar,

We refer to your e-mail of May 28, 2010 regarding your ICICI Bank Credit Card.

We state that, settlement is offered only in exceptional circumstances after considering various factors and the same has to be in line with the Bank's policy.

We further clarify that, taking into consideration your request, a settlement was offered to you in the month of June 2009 for an amount of Rs.28, 000.00 in 3 installments. However, we have not received your payments as per the settlement due dates, the settlement was rendered null and void.

We regret to consider your payments made after the settlement due dates as the final amount towards your credit card dues.

We request you to confirm if want to settle your credit card remaining outstanding balance.

We hope you would meet the above explanation with understanding.

Looking forward for your co-operation in helping us to serve you better.

ICICI Bank — Settlement completed

ICICI has issued settlement letter on 23rd Jan, 10 asking pay Rs. 20,172 in two installaments before 28th Feb, 2010. I paid Rs. 10070/- on 30th Jan'2010 and Rs. 10000/- on 26th Feb'2010 and also returned my credit card to them. But from march onwards, ICICI bank kept sending credit card bills with interest.
When I asked ICICI bank, why so when i paid as per settlement letter, they replied which is as follows:-

Dear Sushil,
Settlement initiated in Jan'2010 in Rs. 20172/- in 2 installment. But you had paid only Rs. 20070/- ( Rs. 10070/- on 30th Jan'2010 and Rs. 10000/- on 26th Feb'2010) which is not complete settlement amount as offered and letter given to you,thats why settlement null & void. You need to settle his cards again to close the issue, we can offer the best settlement in Rs. 2500/-.
