[Resolved]  ICICI Bank Ltd — Wrong Communication False Deduction

Address:Uttar Pradesh

Dear Sandhya/Anshoo,

As you and your senior team members are mentioning many time that I had default on many occasions as my deduction is through EMI for which I have to keep the minimum balance. When I go through my loan statement I found that almost 2 years my all EMI are paid in time as earlier this account were my salary account so I don’t need to deposit the money by standing in queue at your bank.

As I have already informed that I didn’t received any sort of communication from your end nor via courier nor through, you can very well check from your record if you have. And as per your trailing mail if you want to know teach me the bank process then one thing I informed that we are professional and we not have so much time to read all your polices and guidelines which in your booklet so called” Granth”. At that time your sales executive or even your office staff tick the boxes where in the customer need to signature, now by this matter that all these guidelines are in the favour of ICICI only.

I just want to state that when my first EMI got bounced due to some personal/official reason than I understand that I will this EMI within next month and my EMI tenure would be increase, then I am not aware that still you are charging the bouncing and OD charges which gives you permit to called me defaulter.
FYI even your executive does not bother to give me my loan account number and when I mailed to customer care then I come to know to such charges and you are mentioning that you have checked your loan account and I have default in many question, can I ask you one thing when you come to that the person is a defaulter then why not you and your team contact me. I tell you the reason because I am your those kind of customer which you are looking for because they will EMI along with bounce and OD charges.

Lastly you have written that as a special case you can waive off me the only May’11 OD and bounce charges and please treat this is as your final communication. Mam I just want to say that you keep your special waiver which is more or equal to Rs 400. It is a just a thin percentage of interest which I had already paid to you so please don’t oblige me by considering it. I am giving you many option to settle the account but if you want to stretch it then its very much ok for me.

Anyways this is my last mail to you because I am very much fad up with your team members replies, everyone is pointing customer mistake but none of you don’t look yourself because If you looked then such type of issue will not arise.

Also If am a defaulter sort of customer then default very early not after paying 42-43 EMIs. Also If paid 6983 which I will not then again you charges OD and bounce charges because this month also your EMI date is over with your mail –mail talk.

Now after having so much fad up I am going to your ICICI branch and request to close the account so that EMI deduction part is over and now I want your team comes to full and final negotiation.

Regards

Amit Pandey

Dear Mr. Pandey,

As a special case, we can consider waiver of the bounce charges and overdue charges for the last EMI, i.e. for the month of May 2011. However we request you to clear the outstanding amount of Rs. 6983 ( June EMI of Rs. 6213 + outstanding of Rs. 770) to enable us initiate the reversal.

We regret that we will not be able consider any further reversals. Please treat this as our final communication in this regard.

Sincerely,

Dear Sandhya,

As I already intimate that I am not aware of the OD and bounce charges because of communication issue. If I am aware then such type of issue will not happened.

I again request you to waive off the amount so that I can pay my EMIs with in time, otherwise I’ll not be able to any EMIs dues. If you waived off such amount then I’ll assure that I’ll pay all the balance EMIS with in time.

I want to settle the issue not to stretch the issue so if you want to settle things mutually then waive off such charges then update me the balance amount of EMIs mentioning month so that I can pay asap, it’s not a very heavy amount which you can’t waive off.

Otherwise you add OD and bounce charges every month but I’ll not pay any EMIs and you are ready to take legal action if you want.

Dear Mr. Pandey,

We have examined your Loan account and found that you have defaulted on the EMI payments on multiple occasions. Since you have opted for the repayment mode through Autodebit, you were required to maintain sufficient funds in your Savings Bank Account to ensure that the EMI payments are regularly debited from your account.

In view of the above, we regret our inability to waive the overdue and bounce charges.

Sincerely,

Dear Mr. Anhsoo,

I have intimated your ICICI bank patna that I have changed my address and there is no branch at Patna who is dealing with you loan department. I had also intimated about my number change to local bank branch that my number has been changed from Mar’11 but before that I had not received any SMS from your end , you can very well check the failure report of SMS if you have and I am also assure that courier delivered by you is also returned.

Now I don’t want to conclude this issue any more, I am ready to pay EMI but I want waiver of all bounce and OD charges which you charged to me. If you are ready to waive off all the bounce and OD charges than update me the balance amount by clearly stating the month which I have to pay than I have no issue otherwise it’s become difficult for me to pay the balance EMIs

Dear Mr. Pandey,

We refer to your appended e-mail of June 3,2011 addressed to Mr. K V Kamath.

We would like to confirm you that as per the loan agreement signed by the borrower, he is supposed to maintain adequate balance in his account to ensure the clearance of EMI. In case the loan EMI (Equated Monthly Installment) for the any month is returned due to the reason 'Insufficient funds'. EMI bounce charges Rs. 200.00 + service tax (10.30%) as well as overdue charges @ 24% p.a. or 2% p.m.

In your case, we have observed that on several occasions the EMI had returned due to the reason 'Insufficient funds' and accordingly charges have accrued on your Loan accounts.

As per the banks process, in case of any outstanding reflecting in the customer Loan account, bank is authorized to debit the customer account for the outstanding amount. A debit intimation letter dated May 31,2011 was send to your communication address through normal post. Please find enclosed statement of account for your reference.

Apart for the regular EMI Banking date, Bank had represented the Auto Debit to recover the overdue outstanding amount on May 31,2011. Since Rs. 13000 was available in your Savings Bank Account, it was recovered and adjusted against the outstanding payment on your Loan account. We would also like to state that an SMS is sent to customers initimating about the outstanding payments. In your case it was sent to you in January 2010 , November 2010, January 2011, February 2011, March 2011 and May 2011 .

We hope the above details clarify the query to your satisfaction.

We thank you for writing to us.

Hi,

I am a loan holder of ICICI bank and my loan number is LAGOR[protected] in the name of Amit Pandey. In this regards I never get any update from your end regarding EMI deduction and other sort of charges which you incurred.

On 31st May’11 I have deposited Rs 15000 in my account and withdrawal Rs. 2000 on the same day and at that time my account balance was Rs. 13000. When today I checked my account then I found that there is zero balance in my account. On the same time I called to your customer care and they informed me that that due to some ECS were not debited into my account that’s why they have deducted Rs. 13000.

Now I want to ask that how much time I got information from your end regarding ECS bounced. Also I come to know that there are lot of OD and bounced charges which were also deducted by to this.

I have transferred this amount of Rs. 15000 for some urgent purpose and will deposit your EMI on between 05-06 of this month but due to deduction of Rs. 13000 before EMI date I had incurred a big loss.

This clearly shows that you are not trusting your subscriber who are paying you since last 42-43 months. Due to such type of response I would like to clear one thing that from now onwards I will not pay you a single amount of money if you have not again credited the amount deducted into my account and I want waiver of all bounced and OD charges which I was not aware off.

If you can’t do so then you are free to proceed to do anything.

Regards

Amit Pandey

ICICI Bank — Wrong information communicated from Customer Care

Hi,

My Credit Card billing date is 7th of every month. In the current month i.e. June, i did a transaction on 9th of this month and my billing date get change suddenly to 11th of every month.
Before doing this transaction i did a call to ICICI customer care regarding my billing date and EMI options available on my card. They told me that your billing date is 7th of every month and you can avail the 3 months EMI option on your card usage for any transaction above 2500 amount.
After doing the transaction, when i called customer care, now they are telling me you can not convert this transaction in to EMI and your billing date has been change to 11th of every month.

So the transaction i did on 9th of june was supposed to get bill on 7th of july but that has been billed after 2 days i.e. 11th of june.
This happen because of two reasons: first, the Bank didn't communicate me prior regarding billing cycle change and the information provided by customer care executives are fake.
Please look into this issue because the services of ICICI bank to their customers are very fake especially for Credit Cards. They say something else and do something different from there words.

Thanks in advance.
