[Resolved]  Ing Vysya Bank — demanding for no due certificate

I am Cheela Venugopal taken a loan vide Loan account no.7000PL630178 in ING VYSYA Bank and I have cleared my due amount in the month of September 2008. Recently I have approached CIBIL to know about my status in CIBIL credit rating system, strangely, in CIBIL my loan account with this bank is still showing that I have not cleared my dues. I was shocked and realized that something went wrong in communication, so, I am writing this complaint for your information and immediate necessary action.

I have taken a loan vide above said loan account and cleared my dues in September 2008 itself. When I asked about no due certificate, your bank officials said you will get it once the post dated cheques have been cleared. I thought the bank will send it by courier but I have not received the same and same time there is no communication from the bank. I tried contacting bank people for no due certificate; in reply they said you will get it by post/courier. I thought anyhow my dues are clear so need not to be worry and taken easily that I will get the letter sooner or later. Adding to that after clearing the account there is no single call, message, mail [or] sms from the bank.

After two years, exactly on 8-2-2010 I have received a letter on[protected] regarding the overdue of Rs.95,855. For the same letter I have replied that I have cleared my dues and approached the bank official namely Mr. Prosanto Kumar Jena. I have clearly explained to him and to the bank vide letter dated[protected]. After the discussion with Mr. Prosanto Kumar Jena himself feels guilty and replied me that sometimes systems will make errors. Because of that you have become defaulter. I will look into the matter and I will see that you will get a no due certificate from our bank within short period of time. As per the conversation, I am supposed get a no due certificate as per his version, but unfortunately, I have not received the same till date.

After one more year, Again in the month of November, same kind of a letter with due of Rs.1,30,768 received from your end.

I thought the problem was solved and I will get no due certificate soon or later but I never expected that my credit rating is affecting badly.

As I am a principle person with ethics, I, by myself even though I am admitted into hospital for heart attack and multiple diseases like diabetic, kidney problem etc., I have approached all the Banks & individuals and explained them about my health & business position by showing the documents and came to an understanding with them for pre-closure of my loans under one time settlement [OTS] against the agreed payment after reaching an understanding on the settlement amount against proper receipts which includes closing of my personal loan account with your bank which I availed wide loan account no.7000PL630178. I have settled the account as per the understanding reached figure [under OTS] of Rs.3,25,000 which paid by Post dated Cheques in September 2008 itself after negotiating with your bank officials.

As a responsible citizen, as a good client, because of my health, business conditions, family position etc I have voluntarily come forward on my own and pre-closed the account to avoid tensions and complications but unfortunately since last several months I am facing heavy tensions because of this issue and I am in helpless condition. Even now it is a surprise to me if really my loan account is not closed why more than 4 years bank has not approached me for payment? Why your bank not claimed EMI’s for 3 to 3½ years? And why applying pressure on me and creating tension to me which is effecting my health? If my health is affected and in turn effects my family is your bank takes responsibility? Is it wrong that I am honestly come forward with a trust to close the account by paying the agreed amount as a settlement?

I have taken loans from 20 to 25 various banks and cleared the dues with one time settlement although I was admitted into hospital with a principal and good intention. But this ING vysya bank, Axis, RBS and Barclays Bank only have created this kind of problem and trauma. Please refer my loan account no.[protected] with Barclays Bank for which I have given a complaint. They have given me apology letter and also ready to give compensation but I have refused.

So, I request your goodself to look into the matter and take severe action against the bank, bank officials etc and get me the justice.

After clearance of the above said cheques, I have called and reminded to your bank number of times for the issuance of no due certificate but unfortunately I have not received the same and I was under the opinion anyway the loan account is closed and I have the receipts for records and stopped following up after sometime.

All these days I was feeling very tense, because of this, I have made written complaint to your bank but not to your ombudsman [or] to RBI ombudsman with a hope that the issue will be settled and I will be free of the problem. But now I am making a copy to them also.

Generally, any individual will tear off/destroy the any receipts after may be year and so. But fortunately I have kept these receipts even after 3 years and some safety I have atleast to quote. Please understand what would have been my position if I have not maintained the records of receipts and what I feel that “your bank has taken advantage of my innocence and goodness” and in this situation to safeguard myself, forced to make this written complaint to your bank and all the higher authorities of your bank, and to your banks ombudsman and ombudsman of RBI.

Atleast now, your bank and bank officials have to seriously look into this complaint and have to issue the no due certificate for the personal loan account no. 7000PL630178 immediately and should relieve me from this issue.

Even after this justice is not done I have decided to go to any extend including approaching human rights commission, media, etc for my rights and justice.
