Samsung Corby — getting hanged

i am extremely dissappointed with the samsung company. i got samsung corby one month ago from my first salary and the very third day i had problems with the phone. when checked at the service station i was told that it is a software problem and cannot be guaranteed that the problem can be set right. i really hope to get some help with this.what am i suppose to do?? go to retailer 1st. ask him to exchange the phone, send 1 letter to company office request them about your problem and ask them for exchange and then go to consumer court or nowadays better way to go to media news channel
tv 9 has there own consumer complaint board so ask them for help make your first salary count dont let them go easily .

I have purchasef L700 Samsung mobile in July 2009 . But I have lost that phone in the month of december. Can I get that mobile?. I have also availed mobile tracker option. But i didn't get that mobile.
