[Resolved]  Standard Chartered Bank Credit Card — physical and mental harassment

Respected Sir,
I Sri Dipankar Nag aged about 32 years, son of Sri Prabhas Chandra Nag presently residing at 1/3/1 Padmapukur lane, Adwitiya apartment, flat G4, Howrah, West Bengal – 711 109. Wish to inform you that for the last six (6) months some agents of Standard chartered bank credit card division is threatening me on my mobile phone number [protected]. A few months back the aforesaid agents tried to harass me on my mobile phone stating that they will put up a case at the court of Chandigarh Punjab in regards to my credit card and they will succeed to get a court order of a personal warrant against me and if I want to avoid this circumstances, I will have to pay the bank an amount of Rs.25000 within a week time, which was duly an impossible task for a unemployed family man alike me. They also informed me to meet the collections department in Kolkata within 2 days, I requested them earnestly to send an agent to my house to settle the disputed matter however they denied to do so and hence again threatened me with unlawful languages. After that I disconnected the phone of mine immediately.

Sir, this credit card issue was disputed a few years back and was once put up on one of the Lok Adalats in Kolkata and the matter was not settled there as the bank persons were threatening to pay the full amount; however it was illegal as the dispute was created by themselves only. After this incident I sent a letter to their Kolkata office however there was no response.

Lastly on Saturday 21/11/2009 at about 09:30 AM in the morning, I received a phone call from the number [protected] to my mobile [protected] threatening me to vacate my residential place as the caller named as Mr. Jaswant Thakur police employee for the state of Punjab have obtained allege court order from the court of Chandigarh Punjab to seal my residential place, when I queried about the case, he (Mr Jaswant Thakur) told me that I can call up the concerned lawyer to know the details, and he is only a police employee and he will come around 02:30 PM to seal my residential place which actually doesn’t belongs to me. Mr. Jaswant Thakur told me about the Advocate named as Mr. Virendra Sahi and his phone number is [protected] to know more details. I accordingly called up the above named Advocate Mr. Virendra Sahi to know about the details; however he told me that if I can deposit Rs. 50,000 immediately on account of my Standard Chartered credit card then only they can stop that process of sealing my residence. I then immediately called up my family friend, philosopher & Lawyer, Advocate Tapan Jana of the High Court Kolkata and gave him the details of the caller. Mr. Jana then called up on that number [protected] and tried to decipher the identity & motto of the caller, however the person named above as Mr. Jaswant Thakur a police employee of Punjab did not disclose anything to my lawyer or rather denied to talk to him. Mr. Jana then advised me to lodge one complain at my nearest police station, which I did with Shibpur P.S being P.S GD number 2170 dated 21/11/2009 at about 12:50PM. ( A Xerox of receipt is attached herewith).

Sir, I therefore wish to place an FIR against the aforesaid persons named a Mr. Jaswant Thakur and Mr. Virendra Sahi with the aforesaid phone numbers [protected] and [protected] and the Standard Chartered Bank authority. As the aforesaid threat was suspicious and they didn’t even turn up at my residence as intimated. Sir so far as I read the RBI credit card rule provides as follows “Banks, NBFCs or their agents will be barred from putting through threatening and anonymous calls or making false and misleading representations.” And also the bank authorities have been told that “ Not to indulge in acts intended to humiliate publicly or intrude on the privacy of the credit card holders’ family members and friends.” etc.,etc.

Sir, I will be highly obliged if you kindly note a FIR against the aforesaid persons and with their numbers and also concerned bank personnel for such humiliation and harassment and causing mental anguish. I will also forward this copy of my letter to the concerned persons and department. I will also share the same with the media to stop this nuisance of physical and mental harassment of general public by the banks if so necessary further.

Standard Chartered Bank — Telephonic Harrassment at Office & Residence - PL

I had taken a PL from SCB in Oct'07 and have been paying EMI regularly through ECS since Dec'07 till May'09(18 EMI) without any return history.
Due to certain unforseen circumstances funds were not available in the bank and the current month (Jun'09) ECS got returned.
I received a collection call from Mr. Ramesh, SCB-Delhi-Collection representative, from[protected] on 25.06.09 for the due emi. I conveyed to him that I would be giving cheque on 29th as the funds would be available on 30th evening. But on this statement Mr. Ramesh repeatedly urged on payment by cash or DD on 29th and didnt even bother to understand the problem. This urge led to him for using slangs and abusive languages involving myself, my family members & even my organisation in which i work for including threats of sending muscle men at my home & office to collect money.

The same guy again gave me repeated a call on 26.06.09 from morning 11:30am to 3:00pm on my mobile number & Office landline number. Today also this guy started the conversation with abusive langauages and in my absence from office for 15-20 min did the same treatment to other colleagues of mine. By fortune i could record a part of the conversation in my mobile (which i am not able to attach as not allowed)

I have communicated the same to my organisation concerned person & also trying to lodge a complaint at the local SCB collection

My only grudge being that how can banking instituition like SCB can afford to keep/hire guyslike Mr.Ramesh for collection followup to a customer who has never defaulted to them and is also committed to pay the dues.

I hope my grieviance be considered and would request other customers to atleast make the forum & the financial instituition know that these kind of collection guys are doing harm to FACE of the bank in society.
