Dainik Jagran — ONLINE SHOPPING-SNAPDEAL-DELAY IN DELIVERY

I have yet not received the item ordered on Snapdeal, the original date of delivery being 24th Dec 2014, & revised delayed date of delivery being 30th Dec 2014. Today when I contacted Gojavas, courier partner of Snapdeal, I was informed that due to some sales tax issues the order is held, & yet not dispatched from Delhi to Lucknow, & the same shall not be dispatched until the sales tax issue gets resolved on part of Snapdeal. Prima facie, the Snapdeal company being the defaulter in this case, why should the customer suffer. I have already made advance payment. This is again requested to yourselves to immediately refund my payment, else I am going to sue Snapdeal in court of law. Now the things are clear, & I do not understand why yourselves are not refunding the payment . This is in reference to Complaint Number[protected]. I had received a call from Mr. Sachin (Snapdeal Executive) on 27-dec-2014 at 01:10 PM & on 29-Dec-2014 at 12:12 PM from [protected] & [protected] respectively. I was assured by yourselves (Sachin from Snapdeal) on 27 Dec 2014 that the issue will be resolved within 24 hours. But the same did not happen. I received a call again from him today, the 29th Dec 2014 giving the same words that the issue will get resolved by today's evening, I was also assured by yourselves (Sachin from Snapdeal) that I shall be given a fresh invoice bearing date of actual delivery to the customer . PLs note: 1). Clearly mention whether or Not yourselves will issue invoice of the date of actual delivery (whenever the product gets delivered) .If yourselves cannot issue the invoice dated as said above, I shall not accept the delivery. Pls update the status of my complain & the above confirmation sought by me, in writing on my email :[protected]@gmail.com, by today's evening, by 06:00 PM. Else I am helpless & I need to escalate this complain further. Below is the summary of the complain, for your reference. I have contacted yourselves several times via email & contact number for the delay in the subject mentioned order. In absence of a convincing & justified solution, & negligent behaviour of yourselves, I have raised a complaint with Indian Online Consumer Resource & Grievance Redressal System, managed byConsumer Coordination Council (CCC), Supported by Dept. of Consumer Affairs, Ministry of Consumer affairs Food & Public Distribution-Govt. of India, Complaint No-128285.3.2014. Below is the summary of the subject mentioned issue: Complaint Description: I have ordered a mobile phone (ACER LIQUID E700) on[protected], 20:25:08 pm. ORDER NO. : [protected] The payment was made using online banking system: PAYMENT DETAILS:- 1) PAYMENT DATE-16-dec-2014 2) NARRATION-to transfer INB AVENUES INDIA PVT. LTD 3) REF.NO.- CCABL1FVT623IG00IFIYU7 TRANSFER TO [protected] AVENUES INDIA PRIVATE 4) AMOUNT PAID-12, 010.00 1. It was informed that the product shall be delivered within 4 to 6 working days of placing the order. 2. The maximum due date by which product shall be positively delivered was promised on 24-dec-2014. (After 7 days). However, i did not receive the product till date, i.e. 26-dec-2014. I tried to contact GO JAVAS, the courier partner of snapdeal, but they do not have any idea as to where the item is lying. I tried contacting SNAPDEAL several times & even emailed to them regarding the delivery of the order, but did not get any satisfactory reply. 1. I requested them to provide me with the rule/terms & conditions of SNAPDEAl Company where there is delay in delivering the product, but they did not provide the same. 2. I requested them to cancel the order (since the same cannot be delivered upto the agreed date) & refund the money. But i was told the same cannot be cancelled & money cannot be refunded .it shall be refunded only when the courier company comes to deliver, & customer refuses to accept the delivery & the product reaches them back. But this will take at least a month time to get the refund. 3. Due to such delay in delivery, the end customer using the product shall be facing loss of warranty (from date of placing the order to date of actual delivery to customer). 4. Alternatively i requested them to issue me the invoice of the date on which it gets delivered to the customer to prevent warranty loss due to such delay. But the company denied doing this. Due to company’s carelessness, negligence, and irresponsive behavior, I have faced a huge inconvenience. Damaged Occured: I have made payment in advance. This has resulted in blockage of my money.I cannot buy from any other place but to wait for the product to be delivered. I am in urgent need of a new mobile handset. Smartphone being so important these days, due to such delay in delivery on part of Snapdeal, my professional work & personal life is being affected, & Iam put into huge inconvenience. Relief Sought: Since the product has yet not been delivered by the promised date. I want: 1. Immediate delivery of the product without further delay along AND Invoice to be dated not before the date of actual delivery to prevent loss of warranty period. Or, 2. Immediate cancellation of the order AND refund of the money.
