[Resolved]  Droom Technology — Promised a refund for token amount but citing strange reasons and denying now.

Hello Sir/Madam,

On 1st January 2022, I paid a token amount for a used motorcycle through Droom since they were providing a 6 month warranty on their vehicles. The owner of the bike (a dealer) was already known to me since I had gotten his contact atleast 10 days earlier (on 21st December 2021) through another platform (OLX). The only reason I was going through Droom was for the 6 month warranty.

I went to take a look at the bike on 2nd January and was not satisfied with it. I told the Droom executive to look for another bike since the bike wasn't good.
In the meanwhile, I found another bike listing from the same seller on OLX which was in a much better condition so I went with that bike instead. Keep in mind that Droom had nothing to do in this deal. It was a completely different bike from a seller I knew even before Droom provided me his contact details. Droom is now refusing to refund the token amount citing that they provided me his contact details and that it is because of them that I got the bike.

I am hereby attaching all proof to back my claims.
1. Droom provides contact details of seller on 1st January 2022. (Note the last few digits of the mobile number).
2. My call logs which shows that the first call I had with the same seller was on 21 December 2021. (Proof that I knew the seller before Droom gave contact details)
3. The bike that the Droom executive shows me which I paid token amount for and was not satisfied with.
4. I find the same bike on OLX (notice the same picture) and the executive somehow convinces me to pay the token amount since Droom provides warranty and promises refund if I am not satisfied with the bike.
5. The OLX listing of the bike that I finally went with. (notice location of the ad and picture background which confirms that it's the same seller).

Droom has cleverly cheated me of Rs.1763 through cunning tactics and I request you to please help me with this. They did not help me in any way but still have held my money.

Droom claimed to have initiated a refund on 8th March and promised that the amount would be credited in 5-7 working days, but it still hasn't been credited yet till today (25 March). I wrote an email and called their support center and there still has not been any update from their end.
Droom Technology customer support has been notified about the posted complaint.

It's been almost 10 days since I posted this complaint here and neither have anyone from Droom contacted me regarding this nor has there been a resolution even though I've laid everything out in such detail with all proofs.

Since it seems like Droom has no intention to resolve this issue, I've decided to wait for 1 last week after which I will be filing a case in the consumer court. Going the legal way is the only option to deal with this fraud company.
