[Resolved] Food Panda — Excess amount charged and also bill not provided by food panda | |||||
Dear sir, With reference to my food order booking done on 15.04.2017 using food panda mobile application vide order id no. R3ki-x0nr, i have few concerns for which i had lodged my formal complaint (As attached) on the national consumer helpline, union ministry of consumer affairs vide complaint number 238591 dated 24.04.2017 & pursuant to their instructions, i am writing this mail to get the following issues clarified from your end at the earliest:- I) total payment of rs. 309.25 was charged by food panda from me which is higher than the actual amount as per my calculation as below:- Quantity Item Total amount as per fp Total amount as per customer Difference 2 Butter naan 55.30 55.30 - 5 Tandoori roti 39.50 39.50 - 1 Kadhai paneer 142.20 142.20 - 1 Dum aloo 118.50 118.50 - Total amount 450.00 355.50 94.50 Delivery charges 25.00 - 25.00 + service tax inclusive of swachh bharat cess 3.75 - 3.75 Discount applied (94.50) (74.66) (19.85) Voucher (Fp40) (75.00) (142.20) 67.20 Net payment due 309.25 138.65 170.61 Ii) no bill was given to me for the above payment either by the concerned restaurant or by the food panda despite clear guidelines by the ministry of consumer affairs, government of india to provide the bill to the customer in each & every case Iii) as per rule 4 a of the service tax rules, 1994, the service provider has to provide the following details vide invoice/bill/challan to the customer /service receiver, I) name, address and the registration number of such person; (Ii) the name and address of the person receiving taxable service; [ (Iii) description and value of taxable service provided or agreed to be provided; and] (Iv) the service tax payable thereon: But as a matter of fact no such details along with the invoice copy was shared with me but service tax was charged from me as above Iv) regarding delivery charges of rs. 25 charged from me by food panda, no such charges were disclosed to me before placing the order on mobile app but it was charged to me V) regarding applicability discount @40% on voucher fp40, it is communicated to me by food panda team vide mail dated 26.04.2017 that maximum discount can be availed of rs. 75 only & they referred few terms & conditions available online on the website, whereas contrary to the facts mentioned by fp team, i have the following observations: A) as a matter of fact, as i had the booked thru mobile app, no such condition was available on mobile app and customer is not supposed to check the website for terms & conditions without any such information available on mobile app You are again kindly requested to clarify the above points at the earliest otherwise i would be compelled to take appropriate action/s against the food panda.
