Worst apartment developers in kerala –hanco developers of palakkad in kerala where the builder has handed over the owner with one car park each but never alotted one to each owner. Now mr.. Ananthanarayanhariharan of hanco developers says ” park anywhere” after owners paid 2 lakhs for car parking

We would bring to the notice of the public, as a knowledge sharing about the scrupulous builder hanco developers headed by a developer mr. Ananthanarayan who have not handed over car park after registration about 2 years ago. Car parking is being used by outsiders and there is no control. Those who paid money looking for space every day. Every day the owners/residents look for a car parking area. Ananthanarayanan of palakkad kerala wish to keep control of car parking’s.
Car parking is not marked and alotted to owners.
This problem was shared to media and other media reporters who advised to bring this builder to book and justice for the owners /residents who paid separately for car parking. Normally the car parking is allotted as to the registration basis or priority basis who registered in the order of preference. Here this “garbage developer in the name of hanco”is allotting to his relatives and friends and has no standard for allotment and we reported to the media who took over in settling through various websites.
His caretaker - damodaran was asked by several people and he says –ananthanarayanan has cheated the owners and don’t wish to alott car parking at all, as of the 27 apartments there is only 16 car parks available below the building.
But at the same time, if any fool - proof method is not followed by the builder, in allotting car parking space to the purchasers and discretion is given to a builder, there is every possibility of the builder showing discrimination in allotting parking places among the flat purchasers and they may allot car parking places at their whims and fancies. The builder has to see that no inconvenience is being caused to any of the purchaser of the flats, while allotting and marking of parking spaces.in the first place he has not allotted more than 2 years and no completion ready and no plan to hand over the apartment.
The apartment was handed over in january to may 2016 and the status is seen in below pictures.in year 2018, still several unfinished works and media persons already visited –enquired and now wish to make this matter public against the cheat builder – mr. Anantha narayanan. He has given good parking lot of people like land developer subhash, who keeps his car 24 hours a day, who has not even registered their apartment.
Damodaran, the caretaker has told residents that the builder/developer is against few residents and he wish to trouble them to the maximum. He has intentions to make owners sell their apartment and drive them off so that his like-minded buyers can be cheated. Damodaran has allowed the outsiders car parking slot being used those who travel to coimbatore /cochin/thrissur/calicut. He indicated that the builder has allowed his friends to park rather than olavakkod railway station.
Of the 27 apartments, several registrations completed in year 2016 and as to this year 2018, no car parking is marked and handed over at the time of giving possession. Possession was given when the apartment work was not completed, and no fire approvals given leaving the residents to high risk zone.
This developer and builder and self-proclaimed managing director, thinks he is too clever and suppress the owners who paid their hard earned money and bought one units each.
Other major issues: any one is free to visit this mountain mist apartment and carry out his own investigations, before making any comment remotely.
• occupancy certificate is not issued and resident’s staying at their own risk.
• fire clearance is not approved. Fire clearance stopped due to information received by hanco engineers, who were sacked and reported to fire services trivandrum. The diesel generator is put in the car parking space which is a fire hazard. One small fire and 27 cars will vanish in thin air.
• electricity is not approved and clearance not sought, even after 2 years of possession of the apartment.
• water connection is also not ready and people use the bore wellwater, paying extra electricity charges. He charges 750 rupees every month o[censored]sing the commercial meters. He is cheating residents and owners.
• painting of the building is not completed –see photos as on date. He had a case with a painting contractor as he did not settle his money and contractor left the job unfinished.
• car parking is used by his friends to park two wheelers and keep the building materials
• no cctv camera is fitted so as to identify who is parking in who’s slot.
• now buyers are coming one by one him to court.
• builder must mark the car parking slot and hand over to residents on first come first serve basis like apartment booking or as per registration order. Anybypassing of this process would end in court, as builder already has 3 or 4 court cases and this one will add to his list.

Mountain mist apartment by Hanco developers have cheated 27residents.see the car parking plan in his website, all spread around the building and has cheated the buyers. There iis no space and now says …park anywhere.
It also reiterated that a builder could not sell open or stilt parking space, as it is not covered within the floor space index (FSI) and is a common amenity meant for flat purchasers.
The builder has kept the building materials from 2014 until 2018 january and now it is to take him to task, said one of the resident presently residing in the apartment .
Ananthanarayan of Hanco developer abuses all owners except his relatives and friends compelling them and sending emails that he would sue for defamation. MrAnanthanarayan does not understand the meaning of the word –Defamation . Let him give a one crore defamation suit and lets watch after 10 years, he will lose his deposit amount also. Many lawyers provoked him to act strict and not to alott car parking but at end of the day he will lose heavily.
Fire services Kerala Trivandrum allowed the generator to be placed near car park. This is a fire hazard and one hot spot will char all 27 cars and even the building would catch fire. The Fire services were informed by Hanco engineers but no action taken so far. So when any real fire takes place, the comments mentioned will make them realize what is far from truth.
Let AnanthaNarayan hariharan of mountain mist apartment refund the 2 lakhs to all the buyers including his friends and relatives.Thisstuid guy is acting like a child and his childish behavior brought him to this day. How long residents wait . All are venting anger against his company Hanco and mountain mist project .last word he says is I pay the money you gave me and you may leave the complex. This is the tactics he used with several buyers.
MrAnanatha Narayanan, Hanco developers Kalpathy Palakkad of Mountain mist apartments is a first time builder who does not know the rules and has messed up all Projects . The buyers are even uneducated with what they have to pay and what not.
Way back, on 31st August 2010, the Supreme Court of India ruled that a builder/ developer/ promoter (of flats/ group housing) cannot sell open or stilt parking area (meaning uncovered or covered parking space) once the owners’ society is formed, as the said space becomes a part of “common areas and facilities” of the Society.
The judgment was delivered by a bench of Justices R M Lodha and A K Patnaik in the case of NahalchandLaloochandPvt Ltd (a promoter from Mumbai) vs Panchali Co-operative Housing Society Ltd, subsequent to an appeal made by the former against a Mumbai High Court ruling. The promoter wanted to sell some unalloted car parking space in the building premises and the Society had opposed it, because of which the promoter went to Court.
The judgment goes on to observe that parking spaces in flats (includes open/ stilt/ podium/ basement or any other that is not enclosed on three sides) cannot be termed as ‘garages’ and therefore cannot be sold separately. However, “insofar as the promoter is concerned, he is not put to any prejudice financially by treating open parking space/stilt parking space as part of ‘common areas’ since he is entitled to charge a price for the common areas and facilities from each flat purchaser in proportion to the carpet area of the flat.”
“If a promoter does not fully disclose the common areas and facilities he does so at his own peril. Stilt parking spaces would not cease to be part of common areas and facilities merely because the promoter has not described the same as such in the advertisement and agreement with the flat purchaser.”
Further, “As soon as the Corporation issues the occupation certificate and the Society is registered, the building as well as the stilt parking spaces, open spaces and all common amenities become the property of the Society. The stilt parking spaces cannot be put on sale by the developer as he ceases to have any title on the same.”
Based on this order of the Supreme Court, in September 2013, the Consumer Disputes Redressal Forum in Mumbai directed Tata Housing Development Company Limited to refund to the complainant, Rs 50, 000 that it had collected as car parking charges, along with interest and compensation for mental agony.
A point to note is that any clauses in the agreement with the builder that violate the law and associated acts are not enforceable by the builder, AnanthaNarayan of Hanco developers Palakkad and can be contested. In this context, most sale agreements will have an arbitration clause, which the builder will try to invoke. However, arbitration is not the only means of redressal, as per the order from the National Consumer Disputes Redressal Commission. Buyers can approach the Consumer Forum for relief. The builder like Mr. AnanthaNarayan of Hanco developer Palakkad cannot charge you separately for car parking. The cost of construction, i.e. the sqft rate, (which apart from your apartment, includes the cost of common areas) should include one car parking space. If you look at your sale agreement, you may find that your builder AnanthaNarayan of Hanco developers Palakkad has charged you Rs 2, 00, 000 separately for car parking.
If the builder has charged you for car parking, which is illegal as per the law, you could consider asking him for a refund quoting the Supreme Court order and the other rulings that serve as precedents.
If this fails, you could join a few active citizens in Bangalore who are working towards getting their money back
Mr.ananthanarayan of Hanco developer has charged Rs 2 lakhs from 27 residents and not allotted the car park and now stating park anywhere. We request Mr Anantha Narayan to refund the car parking amount immediately to all the 27 owners/buyers. If not then legal proceedings will take place.
Why Ananthanarayan hariharan did not alott car parking along with the possession letter.Registration of the apartment was done in 2015 and 2016 and he is still to alott car parking. We residents have paid 2 lakhs each and he is still keeping in posseion the car park.

We visited the hanco office and Hanco civil engineers told us that they have only 16 car park against 27 parking area. after completion certificate is received then he would erect illegal structure s like open car parking and hand over to residents.

The palakkad municipal authority must not give completion certificate until car parking is handed over on first come and fist alott basis. If he plays around with car parking then we will take him to court and stop all further constructions in palakkad -thrissur- kochi...

Kerala RERA and cREDAI must look into these scrupulous builder headed by inexperienced builder -Anathanarayana n Hariharan and Vani hariharan, both are directors and sitting in the nest and enjoying without looking into buyers woes.
Car parking in Mountain Mist apartment by hanco developer and builder –Mr Anantha narayana hariharan and vani Hariharan, both directors of the company has not handed over car park after registration and possession given and is obstructing the owners car parking area.
The most untrusted developer and builder of Palakkad is Hanco developer from Kalpathy who is now into real estate business from 2011 onwards and now cheating customers for car parking. After giving possession, say after registration, he has blocked car parking. The guy who whistleblowed has been sacked. The caretaker Damodaran is sacked as he let the personal news of Anantha Narayan and vani Hariharan. Difficult times approaching for both husband and wife to abandonreal estate business as they made total mess out of it.
As on 18th January2018 we residents complained several times but his has put building materials in car parking area and trying to obstruct car parking. The photos taken today is attached.
I saw several people had complained against Hanco developer –AnanthaNarayan Hariharan, but it looks like he does not care at all. The residents also has a mixed response and few got some slot to park and rest are parking in the pathway.
Two securities are working with 12 hours duty on daily basis and they have no control over parking. The car parking is not allotted even after 2 years of possession and registration and his building work is still continuing and no completion certificate is received so far.two wheelers are parked in car parking area. Also noted outsiders two wheelers are parked inside the apartment complex. Some people who work in coimbatore and calicut oor cochin are keeping two wheeler and four wheeler inside the apartment.
All owners car must be provided sticker so that they can park in their designated and marked slot. If he does not alott and keep under his possession then we owners will go to consumer forum to get justice.
Ananthanarayan hariharan like scrupulous builder cannot say- If you don’t like then I will buy back the apartment so that he can sell at a higher rate .This trick wont allow. We have taken loan to buy this apartment and your modus operandi will not work any further. Hand over to association and then we will run the show.
Completion certificate even after 5 years is not received . How did Fire and safety department allow residents to stay in this apartment. How the apartments were registered without completion certificate.
Till he allots car parking we will be going to consumer forum against him. Let the forum take action against him. He was not available for comment at the time of posting. The Civil engineers told us that he has not allotted car parking now because he will not get completion certificate .After getting completion certificate he would erect temporary sheds and hand over car parking around the building .

Please do not buy any apartment from Unknown Builder without any knowledge for construction . Several consumer court cases against him and his company- Hanco Constructions and hanco Property developers.
