Hyundai Motor India — gearbox manufacturing defect in new car hyundai xcent

Dear team,
I have purchased a brand new xcent (Petrol) (Mp-04-cu-7159)-on 11th april 2018 from m/s. Surjeet hyundai chuna bhatti bhopal.
My car has run only 2856 km till 02/06/2018.

I was travelling with my family from gwalior to bhopal on 02/06/2018, hardly i have driven 30-35 km from gwalior and found i am unable to shift the gear as per required speed.
I carefully parked my vehicle by road side and tried to shift the gear but it was taking only 3rd and reverse gear but not moving smoothly.

Then i call hyundai customer care rsa (Ref no-x[protected]ind) for assistance near about 6:30 pm. I have waited till 10:20 pm then after your toeing vehicle has reached on spot.
I was standing on highway where no street light were there, i was with my family, before hyundai toeing vehicle reach, my fried came from gwalior and has dropped my family back to gwalior.
It is not a complaint against rsa, at least they have help me.
This was the experience of hyundai rsa.

Now second point :

Rsa has dropped my vehicle on royal hyundai, chandrawani naka gwalior work shop.
Next morning i have approached to royal hyundai service center, they have told me that gear has been stuck, you have driven the car roughly (I would like to tell you that before this car i was having santro xing xk and have driven 170, 000 km) then they have open the top cover of gear box and release gear using screw driver.
After getting a test drive they told me that, there is some problem in gear box and same have to be check.
Next day they have opened the gear box and found one of the lock pin was fixed in wrong position due to this gear box is not working and it is manufacturing defect. (As told by service manager - mr. Vikas bhadouriya)
They told me that they will fix the lock pin properly and it will work properly.
There may manufacturing defect on other parts also.
Pls suggest how can i accept repaired gear box in hardly 2 months old car.

When i have insisted to change the gear box as it is not more than 2 month old, very hardly they get convinced to change.
I have asked for apsm number but it was not provided to me.
Today is 21/6/2018, 18 days gone but till date no proper update is there only fake commitments are made in regards of delivery.

Today too i have visited royal hyundai and i have been told that it will take 4-5 days more as order has been placed, i don’t think i can have my car back in said time.

I have not bought this car to move in auto or bike in 47 degree temperature of gwalior.

I am in gwalior, hottest place of mp.
I was planning to buy a new car from last 3 and half year, very hardly i decide to buy a car but it has not worked for me more than 1 and half month.
I am dropping & picking my children to school by using bike in 46-47 degree temp.
Today i myself is feeling heat stroke.
Just think, how my children will be facing this heat.
Hyundai has not provided any stand by vehicle.

Over all it is the worst experience with hyundai

All this scenario has forced me to approach consumer court for same.
